The Parliament of Victoria enacts:

PART 1—PRELIMINARY

1Purposes

The main purposes of this Act are—

(a)to provide for the revocation of the permanent reservation of the former Dental Hospital and Dental School site in Parkville to facilitate the construction of the Victorian Comprehensive Cancer Centre on that site;

(b)to make consequential amendments to the Royal Melbourne Hospital Act 1935.

2Commencement

(1)Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed.

(2)If a provision of this Act does not come into operation before 1 July 2011, it comes into operation on that day.

PART 2—REVOCATION OF RESERVATION

3Revocation of reservation

The Order in Council specified in Schedule 1 is revoked.

4Consequences of revoking reservation

On the revocation of a reservation of land under this Part—

(a)subject to section 5, that land is deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests; and

(b)the appointment of any committee of management of that land is revoked to the extent that it relates to that land; and

(c)any regulations under section 13 of the Crown Land (Reserves) Act 1978 are revoked to the extent that they apply to that land.

5Preservation of lease between Minister for Health and CitiPower

(1)Nothing done by this Part affects the status or continuity of the lease entered into on 17 March 2011 by the Minister for Health with CitiPower Pty ACN 064 651 056 and in force immediately before the commencement of this Part relating to part of the land specified in Schedule 1.

(2)Nothing effected by this section—

(a)is to be regarded as placing any person in a breach of or as constituting a default under any provision prohibiting, restricting or regulating the assignment of the lease; or

(b)is to be regarded as fulfilling any condition which allows a person to exercise a right or remedy in respect of, or to terminate, any agreement or obligation; or

(c)releases any surety or other obligor wholly or in part from any obligation.

6Registrar of Titles to make necessary amendments

The Registrar of Titles must make any recordings in or amendments to the Register under the Transfer of Land Act 1958 that are necessary because of the operation of any provision of this Part.

Situation and area of land: City of Melbourne, at Parkville, Parish of Jika Jika, County of Bourke, being Crown Allotment 3 of section 13A.
Instrument and date of reservation: Order in Council dated 26 March 1936 published in the Government Gazette dated 1 April 1936, page 915.
Description of land by reference to Government Gazette: Government Gazettes dated 26 February 1936, page 593 and 1 April 1936, page 915.
Purpose of reservation: Site for a Dental Hospital and Dental School.
Extent of revocation: The whole.

The long title for the Bill for this Act was "A Bill for an Act to provide for the revocation of the permanent reservation of the former Dental Hospital and Dental School site in Parkville to facilitate the construction of the Victorian Comprehensive Cancer Centre on that site, to make consequential amendments to the Royal Melbourne Hospital Act 1935 and for other purposes."

The Dental Hospital Land Act 2011 was assented to on 31 May 2011 and came into operation on 7 June 2011: Special Gazette (No. 177) 7 June 2011 page 1.
