An Act to amend the law relating to dental benefits, and for related purposes

The Parliament of Australia enacts:

1Short title

This Act may be cited as the Dental Benefits Amendment Act 2012.

2Commencement

This Act commences on 1 January 2014.

3Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Amendments

Dental Benefits Act 2008

Insert:

FTB(A) person has the meaning given by subsection 24(2).

Subsection 24(3) (definition of FTB recipient)

Repeal the definition, substitute:

FTB recipient, in relation to a person (the child), means:

1. (a)

   a person of whom the child is an FTB child in relation to family tax benefit; or

2. (b)

   an approved care organisation of which the child is a client (within the meaning of the A New Tax System (Family Assistance) Act 1999).

Subsection 25(2)

Omit “FTB(A) teenager”, substitute “FTB(A) person”.

Subsection 62(2)

Repeal the subsection, substitute:

1. (2)

   Conditions, limitations or restrictions specified in the Dental Benefits Rules may include, but are not limited to, imposing a specified monetary limit on the amount of dental benefit payable in respect of:

   1. (a)

      a specified dental service; or

   2. (b)

      specified dental services provided to specified eligible dental patients; or

   3. (c)

      specified dental services provided to specified eligible dental patients during specified periods.
