s1 3 s6 Dental Amendment (No. 1) No. 371, 1995 ˙ Short title 1. This by-law may be cited as the Dental Amendment By-law (No. 1) 1995 . ˙ Commencement 2. This by-law commences on 1 January 1996. ˙ By-law amended 3. This by-law amends the Dental By-law 1988 . ˙ Amendment of s 4 (Interpretation) 4.(1) Section 4, heading— omit, insert— ‘ Definitions ’. (2) Section 4, definition “the Act” — omit . (3) Section 4— insert— ‘ “annual fee” means annual licence fee or additional annual licence fee.’. ˙ Omission of s 5 (Forms) 5. Section 5— omit . ˙ Amendment of s 13 (Register of Dentists) 6. Section 13(e)— omit .

Section 14— insert— ‘(e) dental specialty.’. ˙ Amendment of s 15 (Prescribed qualifications) 8.(1) Section 15(1), ‘the Third Schedule hereto’— omit, insert— ‘schedule 1’. (2) Section 15(2), ‘the Fourth Schedule hereto’— omit, insert — ‘schedule 2’. ˙ Amendment of s 16 (Advertising) 9.(1) Section 16(8)— omit . (2) Section 16(12)(a)— omit, insert— ‘(a) be made in the approved form; and’. ˙ Insertion of new s 16A 10. After section 16— insert— ˙ ‘ Telephone directory entries ‘ 16A.(1) A dentist or dental specialist must not place an entry for a practice in a telephone directory unless— (a) the directory has been approved by the board; and (b) the entry—

s 10 5 s 10 Dental Amendment (No. 1) No. 371, 1995 (i) is an entry mentioned in subsection (2); and (ii) does not include anything other than the information mentioned in subsection (3); and (iii) is in the small type common to telephone directories. Maximum penalty—5 penalty units. ‘ (2) The entries that may be made in a telephone directory are— (a) 1 entry under the alphabetical listing of subscribers; and (b) 1 entry under the alphabetical listing of dentists or dental specialists; and (c) under the locality guide listing of dentists or dental specialists—1 entry for each premises of the practice. ‘ (3) The following information may be included in an entry— (a) the name and registered qualifications of each dentist or dental specialist who works in the practice; (b) for a dental company—the name of the company; (c) for each dentist or dental specialist who works in the practice—the title ‘dentist’, ‘dental surgeon’, ‘dental practitioner’ or ‘dental specialist’; (d) for each dental specialist who works in the practice—the specialist’s dental specialty; (e) the address of the practice; (f) the telephone number of the practice (including any after hours number). ‘ (4) The board may approve a directory if it is satisfied the directory— (a) is a genuine directory of telephone subscribers; and (b) does not state or imply that the persons mentioned in it have special expertise. ‘ (5) In this section— “practice” means—

Section 18(7)(b), ‘Form 16’— omit, insert— ‘the approved form’. ˙ Amendment of s 19 (Breaches and penalties) 12. Section 19(4), before ‘penalty’— insert— ‘maximum’. ˙ Replacement of ss 25–31 13. Sections 25 to 31— omit, insert — ˙ ‘ Fees ‘ 25. The fees payable under the Act are in schedule 3. ˙ ‘ When annual fees must be paid ‘ 26.(1) A person who is already registered as a dentist or dental specialist at the beginning of a year, or becomes registered on or before 30 April in a year, must pay the annual fee for the year on or before 30 April in the year. ‘ (2) A person who is not registered as a dentist or dental specialist on or before 30 April in a year, but applies to be registered in the year, must pay the annual fee for the year with the registration fee. ‘ (3) If a person is registered as a dentist or dental specialist on or after 1 December in a year, the annual fee for the following year is waived.’.
