[ASSENTED TO 10TH DECEMBER, 1935.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the a:uthority of the same, as follows:- Short title 1. This Act may be cited as "The Dental Acts and . Amendment Act of 1935," and shall be read as one with construction. *" The Dental Acts, 1902 to 1933" (being "The Dental Acts, 1902 to 1931," as amended by Parts Ill. and VII. of t" The Medical and Other Acts Amendment Act of 1933 "), herein collectively referred to as the Principal Act. The Principal Act and this Act may collectively be cited as "The Dental Acts, 1902 to 1935." Commence- t2. Subject as herein provided, this Act shall come m nt of Act. into operation on a date to be proclaimed by the Governor in Council by Proclamation published in the Gazette, which date is herein referred to as the commencement of this Act. Dental Acts Amendment Act. 15555 hundred and thirty-five, the Senate is enabled to confer the Degree of Bachelor of Dental Science on such persons as shall be qualified therefor in accordance with the regulations mentioned in such statute: And whereas it is desirable that after the commencement of this Act the course of study, training, and examination of students in dentistry shall be removed from the powers, functions, and jurisdiction ,of the Dental Board and shall be conferred in and placed under the authority of the University of Queensland- It is hereby declared and enacted that from and after the commencement of this Act the University of Queensland shall be and constitute the authority charged with full powers, functions, and jurisdiction for and in respect of the prescribing the course of study and training of students in dentistry, the teaching and training of students in dentistry, and the conduct of examinations therein; and the Dental Board shall no longer possess or exercise such powers, functions, and jurisdiction. The Senate shall have full power and authority to make such statutes as it deems necessary dealing with all matters and things regarding the Faculty of Dentistry and, without limiting the generality of these provisions, including the entrance examination and all other examinations and the course of study and training in dentistry, and the teaching and training of students in dentistry, and the conferring the Degree of Bachelor of Dental Science on qualified students on the completion of the course of study and training and on passing the necessary examinations; and the provisions of *" The University of Queensland Act of 1909" (and in particular section twenty-four thereof), and all statutes in force or which may hereafter be made therein shall extend and apply accordingly. 4. 15556 MEDICAL. Dental Acts Amendment Act. 26 GEO. V. No. 30, Provided that the Board shall not register any such holder until he shall have attained the full age of twenty- one years. Existing students. 5. Where any person at the passing of this Act is undergoing a course of study and training prescribed under the Principal Act, or under any statutes made pursuant to*"The University Act of 1909," such person may nevertheless be permitted to continue his study and training under the authority and jurisdiction of the University, and the Senate shall have full power and authority to make such statutes herein as shall be deemed just and equitable; and upon the completion by any such person of the requisite course of training, study, and the passing of the necessary examinations he shall be registered by the Board as a dentist under the Principal Act whether such person holds a certificate of pass issued by the University of Queensland or a diploma in Dental Science, or the Degree of Bachelor of Dental Science: Provided that the Board shall not register any such holder until he shall have attained the age of twenty- one years. The Senate may also make statutes whereby, instead of requiring any person to undergo the whole course of training and study and the passing of all examinations, it may accept in substitution for any part thereof a certificate of examination in any subject or subjects granted by any university established within the Commonwealth of Australia or any college or other public educational institution of this State, and to the intent that such certificate of examination shall have the like force and effect as if such examination had been held by the Senate. This section takes effect from the passing of this Act. Statutes 6. 1935. MEDICAL. Dental Acts Amendment Act. the Governor in Council and published in the Gazette of the twelfth day of March, One thousand nine hundred and thirty-two- (1) Relating to the constitution of the Joint Board of Dental Studies; and (2) Relating to the grant by the University of a diploma in Dental Science after a prescribed course of training and study and the passing of the necessary examinations: And whereas prior to the passing of this Act certain persons pursuant to the statutes referred to have received from the Senate of the University the diploma in Dental Science after the completion by such persons of the requisite course of training study and the passing of the necessary examinations: And whereas subsequent to the passing of this Act certain persons may receive such diploma in Dental Science: And whereas it is desirable that such diploma in Dental Science should be recognised by the Board as entitling the holder thereof to be registered by the Board as a dentist under the Principal Ac~ It is hereby declared and enacted that from and after the passing of this Act the Board shall recognise the holding of a diploma in Dental Science as hereinbefore referred to as entitling the holder thereof to be registered by the Board as a dentist under the Principal Act; and the Board shall and is hereby required to register the holder of such diploma in Dental Science as a dentist under the Principal Act accordingly: Provided that the Board shall not register the holder of any such diploma until he shall have attained the full age of twenty-one years: Provided always, that the Board shall register the holder of such diploma in Dental Science as a dentist under the Principal Act, and whether such diploma was received by the holder before, on, or after the passing of this Act. (2.) The provisions of this section shall come i.nto force on the passing of this Act. 15557
15558 MEDICAL. Derntal Acts Amendment Act. 26 Goo. V. No. 30, Examina- tions in 8. Notwithstanding anything contained in the special cir. Principal Act or in this Act, if it shall appear to the cumstances. Board on .application by any person that such person has before the passing of this Act commenced the study of and/or training in dentistry, or that there are special circumstances existing in his case which in the opinion of the Board render it equitable that such person should be permitted to present himself for an examination in dentistry, the Board shall certify accordingly to the Minister; and if the Minister shall approve of the recommendation of the Board the Board shall permit such person to present himself for such examination in dentistry as the Board in its discretion shall prescribe: Provided that if any person has so made application to the Board for permission to present himself for any such examination and the Board shall refuse to recommend to the Minister that such person shall be so permitted to present himself, such person may appeal to the Minister and the Minister may, after hearing the applicant and the Board, dismiss the appeal or order the Board to permit of the applicant to present himself for examination subject to any terms and conditions as he may deem fit to make. If any person so permitted to present himself for examination passes such examination the Board shall issue to such person a certificate, and such certificate shall entitle him to be registered as a dentist accordingly. Consequential Amendments of the Principal Act. Consequen· 9. The following consequential amendments are tial amend· made in the Principal Act :- ments of the Principal Act. Amendment (i.) In section seven the words "examiners and of s. 7. other" are repealed; also the last paragraph, beginning with the word "Nothing" and ending with the word "prescribed," is repealed. Amendments (ii.) Section eight of the Principal Act is amended, of s. 8. as follows:- (a) Paragraph (iv.) of the said section is repealed. (b) The word" or" is added to paragraph (vi.) of the said section.
MEDICAL. 15559 1935. Dental Acts Amendment Act. (c) The following new paragraphs are added to the said section, namely:- " (vii.) Has had conferred upon him pursuant to sections three and four of *" The Dental Acts Amendment Act of 1935" by the Senate of the University of Queensland the Degree of Bachelor of Dental Science; or (viii.) Has complied with the conditions of and has obtained the necessary certificate of pass or diploma or degree as prescribed in section five of *" The Dental Acts Amendment Act of 1935" ;. or (ix.) Has received from the Senate of the Univer- sity of Queensland, pursuant to section seven of *" The Dental Acts Amendment Act of 1935," a diploma in Dental Science; (x.) Has received from the Board a certificate of having passed an examination pursuant to section eight of *" The Dental Acts Amendment Act of 1935." The operation of paragraphs (viii.) and (ix. ) shall have effect on the passing of *" The Dental Acts Amendment Act of 1935."" (iii.) Section eleven of the Principal Act is repealed. Repeal of s.11. (iv.) Section twenty-six of the Principal Act is Amendments amended, as follows:- of s. 26. (a) Paragraphs (vii.), (viii.), and (ix.) of subsection one of the said section are repealed. (b) The word " ~xamination," occurring in paragraph .(xi.) of the said subsection one of the said section, is repealed. * 26 Geo. V. No. 30 (this Act).
