When the lease of an Agricultural Farm has been extended under the last preceding subsection, and the selector obtains a certificate under section one hundred of this Act, the payment to be made by him under Schedule IV. of this Act shall be adjusted by the Minister in con- formity with the extended term of the lease. 14. I3 E it enacted by the King's Most Excellent Majesty, _ by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as folto \Vs : - 1. (1.) This Act may be cited as "The DentalAct Short title Amendment Act of 1916," and shall be read as one with :~!truction. "The Dental Act of 1902," * hereinafter called the Principal Act. * 2 Edw. Notwithstanding anything in this Act contained, all registrations duly effected and any other matter or thing duly done under or in accordance with the Principal Act, and in force and operative at the passing of this Act, shall be deemed to be I;tnd to have been duly effected or done. Amendment 2. In section two of the Principal Act the definition of s. 2. of "Dentistry" and the proviso thereto are repealed, and the following definitions are inserted in lieu thereof :- Operative assistant. " Operative Assistant"-A person who practises in dentistry as an assistant to a dentist; Dentistry. "Dentistry"-The performance for fee, salary, or other reward, or for expectation of fee, salary, or other reward, of any operation upon the natural teeth and their associate parts of a human subject, or the construction or adjustment of artificial teeth for a human subject: the term does not include the mechanical construction by an arti.san of artificial dentures or other devices for regis- tered dentiits. Amendment 3. Th~ following subsection is added to section five of s. 5. of the Principal Act:- (8.) Each member of the Board shall be allowed expenses for each meeting of the Board which he attends, provided that the expenses so paid to any member shall not exceed twenty-one shillings for each such meeting or fifteen guineas in the aggregate during any year. Amendment 4. The three provisoes in section eight of the Prin- of s. 8. cipal Act are repealed. 5. After section eight of the Principal Act, the following sections are inserted :- Unre~ i~ tered [8A.] (1.) Any person, who, for a period of three IpnradcetIntItI. osntreyr.s years prior to the first day of August , one thousa _ nd nine hundred .and sixteen, has practised dentistry in Queens- land on his own account without being registered as a dentist, may for three years after such date continue to so practise. On registration of his name in accordance with subsection three hereof, such person shall continue to have the same rights and privileges which he possessed immediately before the first day of August, one thousand ninehundred and sixteen; but so far only as the practice of dentistry is concerned, moreover, he shall not take or use or have attached to or exhibited at his place of business

Dental Act Amendment Act. or any premises the word "dentist," or "dental prac- titioner," or "dental surgeon," or "surgeon dentist," or any other word or sign implying or tending to the belief that he is registered as a dentist. If before the expiration of such three years he passes the final qualifying examina- tion of the Board (but in the practical subjects and tests , only), he shall be entitled to be registered as a dentist under this Act. (2.) Any person who has served as a pupil or appren- O~ rative. tice for a period of not less than three years with a dentist d:: ~ ;~ In registered in Queensland or in anyotber State of the Com- monwealth, and who was on the first day of August, one thousand nine hundred and sixteen, bonafide engaged as an operative assistant to .a registered dentist in practice in. Queensland, may for three years after the said date work Iol' any such dentist in such employment; and if he- (a) Furnishes satisfactory evidence to the Board of having during such last-mentioned three years continuously pursued a course of study and training in surgical and mechanical dentistry for at least twelve moilths; and (b) Before the expiration of such threeyears, passes the final qualifying examination of the Board; he shall be entitled to be registered as a dentist under this Act: .Provided that during the said last-mentioned three years- (i.) His employer shall not, under penalty of twenty pounds for each offence, permit or suffer such assistant to act as manager of any branch practice or to practise dentistry at any place of business of such employer or elsewhere, unless a registered dentist is actuaHy and bona fide in charge of the premises where such prac~ ice is conducted; and (ii.) Such assistant shall not act as such manager or practise dentistry contrary to the preceding paragraph hereof under penalty of forfeiture of his rights under this subsection. (3.) A person shall not come within the provisions of this section unless, before the first day of February, one thousand nine hundred and seventeen, he registers his name....with the Board, and satisfies the Board that he

No. 23, has practised or has served and studied, as the case may be, in the required manner and for the required period~ and that he is of good character. (4.) All absences on military service by British subjects shall be accounted as part of the period of dental practice mentioned in this section, and shall be excluded from the period prescribed for the passing of any examination. Reciprocity. [ BB. ] Notwithstanding anything in this Act, the Board shall register any person who proves to the Board that he is registered as a dentist in any State of the Commonwealth of Australia: Provided that under the laws or regulations in that behalf in force in the "State where he is so registered the right to registration as a dentist is granted to persons who are registered as dentists under this Act by virtue of their being so registered and without further examination. Repeal of •. 10. 6. Section ten of the Principal Act is repealed. . Amendment 7. The following subsection is added to section of 8. 12. twelve of the Pri.ncipal Act : - (5.) A written certificate purporting to be signed by the registrar, and stating that, at a date named therein~ a person was or was not registered, shall be received as prima facie evidence of the truth of such statement. 8. After section twelve of the Principal Act, the following section is inserted :- Annual fee. [12A.] During the month of January, one thousand nine hundred and seventeen, and thereafter in the month of January of every year, every registered dentist shall pay to the Board an annual license fee of one. guinea~ and on failing to make such payment shall cease to be a registered dentist; but the Board may at any time restore to the register the name of any dentist failing to make such payment on receiving all arrears and on payment of such fines as may be prescribed by the bY'"laws.. Dental Act Amendment Act. by such person, state in writing the reason for such lefusal or erasure, and such person may appeal from such refusal or erasure to the Supreme Court, and such appeal shall be in the nature of a rehearing. 11. Section twenty of the Principal Act is repealed, Amendment and the following section is inserted in lieu thereof : - of s. 20. [20.] (1.) No person other than a medical practitioner Unregistered or other than a person registered under this Act, and no persons not company or aSSOC.lat'IOn 0 ther than an aSSOC.latI'On co~ - t t o itl a e s o su f me ,sisting wholly of registered dentists, shall practise dentist, &0• .dentistry or take or use or by inference adopt the name, title, word, letters, addition, or description of dentist, or dental practitioner, or dental surgeon, or surgeon dentist, .or use or have attached to or exhibited at his or its place . .of business or residence any name, title, word, letters, addition, or description implying or tending to the belief that he or such company or association is registered under this Act, or is entitled to practise dentistry, or is carry- ing on the practice of dentistry: Provided that this section shall not prohibit from practising dentistry a person whose name has been registered under subsection one of section SA of this Act. (2.) No dentist shall practise dentistry except in his .own name. . (3.) No dentist shall in any advertisement, poster, or other public notice hold out any unregistered person as being or u.se words implying that such unregistered person is his partner, assistant, or associate, or shall cause, :suffer, or permit any unregistered person to perform any dental operation which has been entrusted to or is in .charge of such dentist: Provided that a pupil or apprentice in dentistry having such experience as is approved by the Board, by the by-laws or otherwise, or an operative assistant who has registered his name with the Board as herein- before provided, shall not be prevented from acting as surgical or operative assistant under the immediate direction of the registered dentist with whom he is studying or serving his apprenticeship or whom he is assisting. (4. ) No person, whether registered as a dentist or not, shall take or use or have attached to or exhibited at his residence or at any place of business (either alone .or in combination with any other word or words or

No. 12) letters) the words "dental company," or "dental insti- tute," or "dental hospital," or " dental college," or "college or school of dentistry," or any similar words. This subsection shall not limit the use of any dental title necessarily assumed by any public institution recognised by the Board for the purposes of dental education. (5.) Any person, company, or association guilty of a contravention of this section shall be liable to a penalty not exceeding twenty pounds, and to a further penalty not ~ xceeding five pounds for every day during which such contravention is continued after conviction. (6.) This section shall not prohibit any person from extracting teeth at any place more than five miles from the place of business of the nearest practising dentist. Amendment 12.
