1. The applicant requires an extension of time within which to seek special leave to appeal from the judgment of the Court of Appeal of the Supreme Court of South Australia (Livesey P, Lovell JA, Nicholson A-JA), which dismissed an appeal from the Supreme Court of South Australia (David J).

2. The proposed appeal does not have sufficient prospects of success to warrant a grant of special leave. It would therefore be futile to grant an extension of time.

3. Special leave to appeal is refused.
