1. An extension of time is required to enable this application to proceed.  The long delay in bringing the application is not satisfactorily explained.  More importantly, no issue of principle having any prospect of success on appeal is raised by the application.  The application for special leave to appeal should be dismissed.  An extension of time would be futile.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
