Application for variation of the Delta Electricity Employees’ Enterprise Agreement 2011.

A. An application has been made for approval of a variation of the Delta Electricity Employees’ Enterprise Agreement 2011 (the agreement) [AE885572]. The application was made pursuant to s.210 of the Fair Work Act 2009 (the Act) by Delta Electricity (the Employer).

1. I am satisfied that each of the requirements of s.211 as are relevant to this application for approval have been met.

2. The agreement shall be varied as follows:

    a) By deleting Clause 2.6 Duration and inserting the following:

      2.6 This Enterprise Agreement will be effective from the first pay period on or after 11 March 2011. It will remain in force until 11 March 2015.

    b) By deleting Clause 4.2 Wage Rates and inserting the following:

      4.2 The ordinary weekly wages and the operative date for the classifications covered by this Enterprise Agreement based on a 35-hour week are:

      These rates include provision for incorporation of the annual leave special payment into base rates of pay.

    c) Inserting a new clause 17.7 Cashing out of Annual Leave:

      17.7 Employees may elect in writing to cash out part of their annual leave as a result of transferring ownership and/or employment under the Electricity Generation Assets (Authorised Transactions) Act 2012 or as amended subject to the following:

        (a) Paid annual leave must not be cashed out if the cashing out would result in the employee's remaining accrued entitlement to paid annual leave being less than 4 weeks;

        (b) The employee must be paid at least the full amount that would have been payable to the employee had the employee taken the leave that the employee has forgone.

    d) By deleting Appendix 1and inserting the following:
