1  Name

This instrument is the Defence (Townsville removal) Determination 2019 (No. 1).

2  Commencement

This instrument commences on the day after registration.

3  Cessation

This instrument ceases on 31 August 2020.

4  Authority

This instrument is made under section 58B of the Defence Act 1903.

5  Purpose

The purpose of this Determination is to provide removal benefits to members of the ADF and their dependants who were relocated under the Townsville Determination.

6  Definitions

Defence Determination means Defence Determination 2016/19, Conditions of service, as in force from time to time.

Decision Maker means:

a.         In relation to a member of the Navy and their dependants, the Director Navy People Policy and Governance, the Director Navy Employment Conditions, and the Commanding Officer HMAS Cairns.

b.         In relation to a member of the Army and their dependants, the Director Personnel Policy – Army, the Staff Officer Grade 1 Financial Personnel Policy, the Officer Commanding Army Personnel Administration Centre North Queensland, and the Second in Charge Army Personnel Administration Centre North Queensland.

c.         In relation to a member of the Air Force and their dependants, the Senior ADF Officer, RAAF Base Townsville, the Executive Officer/Air Base Executive Officer 27 Squadron, and Administration Officer 27 Squadron.

Furniture and effects has the same meaning given in Chapter 6 of the Defence Determination.

Member has the same meaning as the Defence Act 1903. 

Service Residence has the same meaning given in Chapter 1 Part 3 Division 1 of the Defence Determination.

Townsville Determination means Defence (State of Emergency – Townsville floods) Determination 2019 (No. 1).

7  Application

This Determination applies to a member and their dependants, if any, who were relocated to alternative accommodation in Townsville under the Townsville Determination.

8  Removal

1.    A member is eligible for a removal to any of the following in Townsville if the decision maker is satisfied it is reasonable in the circumstances.

a.A Service residence.

b.Rental accommodation for which they will be eligible for rent allowance.

c.Their own home.

2.    Removal under this section means removal of furniture and effects.

9  Temporary Accommodation

1.    A member is eligible for temporary accommodation in Townsville if the decision maker is satisfied a removal under subsection 8.1 cannot be completed on the same day.

2.    A member or their dependants may occupy temporary accommodation provided under subsection 1 until the day they are able to occupy a residence under section 8.

10  Temporary boarding of animals

1.A member is eligible for reimbursement of costs associated with the temporary boarding of household pets in Townsville during a removal provided under subsection 8.1 if the decision-maker is satisfied it is reasonable in the circumstances.

2.A member ceases to be eligible for the reimbursement of boarding costs under subsection 1 when the member or their dependants are able to occupy a residence under section 8.
