I, DAVID JOHN HURLEY, Chief of the Defence Force, acting under subsection 93B (1) of the Defence Act 1903 (the Act), determine that a substance or a class of substances in Schedule 1 is a prohibited substance for Part VIIIA of the Act.

  1. Name of Determination

This Determination is the Defence (Prohibited Substances) Determination 2012.

  1. Commencement

This Determination commences on the day after it is registered.

  1. Revocation of Determination of Prohibited Substances (May 2005)

The Determination of Prohibited Substances (May 2005) is revoked.

  1. Definitions

In this Determination:

2012 Prohibited List means the 2012 version of the list of prohibited substances made and published under Article 4.1 of the World Anti-Doping Code by the World Anti-Doping Agency.

Poisons Standard means the Poisons Standard prepared under paragraph 52D (2) (b) of the Therapeutic Goods Act 1989 as in force from time to time.

Schedule 1        Substances or classes of substances

1.       A substance mentioned in item S1, S2, S3 or S5 of the 2012 Prohibited List.

2.       A substance mentioned in Schedule 9 to the Poisons Standard.

3.       A benzodiazepine, including temazepam (Normison), diazepam (Valium), flunitrazepam (Rohypnol) and oxazepam (Serepax)
