1  Name

This instrument is Defence (Individual Housing Assistance) Determination 2018.

2  Commencement

This instrument commences on 22 June 2018.

3  Authority

This instrument is made under section 58B of the Defence Act 1903.

4  Purpose

The purpose of this Determination is to provide housing, removal and related travel assistance to the dependants of a member.

5  Definitions

Member has the same meaning as the Defence Act 1903.

Dependant has the same meaning as section 1.3.83 of Defence Determination 2016/19, Conditions of service, as in force at the commencement of this Determination. 

6  Application

1.          This Determination applies to a person who met both of the following criteria immediately before the commencement of this Determination:

a.    The person is a family member of the member who held the employee identification number of 8543805; and

b.   The person was recognised as a dependant of the member specified in paragraph a.

2.         If there is more than one person to whom this Determination applies, benefits provided for under this determination are provided jointly, unless otherwise stated.

7  Housing benefit

The person is eligible to occupy the service residence that they occupied immediately prior to the commencement of this Determination in accordance with section 7.6.28 of Defence Determination 2016/19, Conditions of service, as in force at the commencement of this Determination, until the earlier of the following days:

a.The day the person vacates the service residence; or

b.31 January 2019.

8  Removal benefit

1.The person is eligible for the removal benefits provided by Defence Determination 2016/19, Conditions of Service, as in force from time to time, as specified in subsection 6.5.78.2 of that Determination.

2.For the purpose of section 1, the following rules apply:

a.The removal is between the following two locations:

i.From the location that the person occupied the service residence in accordance with section 7; and

ii.To another location in Australia specified by the person.

Note:  To avoid doubt, the removal can only be to one specified location.

b.The removal may occur on a day specified by the person, provided reasonable notice is provided, but no later than 31 January 2019.

9  Travel for removal purposes benefit

Each person to whom this Determination applies is eligible for travel and travel related benefits provided in the following sections of Defence Determination 2016/19, Conditions of Service, as in force from time to time, as though they were a non-Service spouse or partner and their dependants.

a.Section 9.3.18 Travel at Commonwealth expense.

b.Section 9.3.19 Accommodation during travel.

c.Section 9.3.20 Meals during travel.

d.Section 9.3.21 Travel by private vehicle.

e.Section 9.3.22 Baggage.

10  End of benefit

Benefits provided under this Determination cease on 31 January 2019.
