1 Name
This instrument is the Defence (Individual benefits) Determination 2023 (No. 3).
2 Commencement
This instrument commences on the day after registration.
3 Authority
This instrument is made under section 58B of the Defence Act 1903.
4 Definition
Defence Determination means the Defence Determination 2016/19, Conditions of service, as in force from time to time.
5 Initial leave
1.This section applies to the member holding employee identification number 8197872.
2.The member is eligible for the equivalent of 10 weeks leave at full‑pay.
3.The following conditions apply to the leave.
a. The leave must be taken before 21 June 2023.
b. The leave must be taken in a single continuous period.
c. If the period in which the leave is taken includes a day that is a public holiday that applies to the member, that day is counted as a day of leave taken under this Determination.
d. The leave may be taken in a combination of full‑pay or half‑pay that is not more than the equivalent amount of full-time leave.
4.If the member is on another type of leave provided under the Defence Determination, that leave ceases on the day before the commencement of this Determination.
6 Additional Leave
1.This section applies to a member holding one of the following employee identification numbers.
a. 8197872.
b. 8202402.
2.The member is eligible for the equivalent of 20 working days of leave.
3.The following conditions apply to the leave.
a. The leave must be taken before 18 June 2024.
b. The leave may be taken at full‑pay or half‑pay.
c. The minimum period of leave that may be taken at a time is 1 day.
d. Leave under this section may not be taken on a day when a member is on a period of initial leave provided under section 5.
7 How leave is reduced
For each day of a leave type taken by a member, the amount of leave attributed to the member for the leave type is reduced by the following.
a. For each day of leave taken at full‑pay — 1 day.
b. For each day of leave taken at half‑pay — 0.5 days.
8 Effect on other benefits
1.The leave provided under this Determination counts as effective service for benefits provided under any of the following.
a. Defence Determination.
b. A determination made under section 58H of the Defence Act 1903, as in force from time to time.
2.The members are not eligible for the following in relation to the same child.
a. Paid parental leave under Chapter 5 Part 7 Division 2 of the Defence Determination.
b. Special paid parental leave under Chapter 5 Part 7 Division 3 of the Defence Determination.
9 Applying for leave
The leave under sections 5 and 6 of this Determination must be applied for using form AF088 – Application for leave.
10 Repeal
This Determination repeals on 19 June 2024.
