1 Name
This instrument is the Defence (Individual benefits) Determination 2022 (No. 4).
2 Commencement
This instrument commences on the day after registration.
3 Authority
This instrument is made under section 58B of the Defence Act 1903.
4 Leave
1.This section applies to a member holding any of the following employee identification numbers.
a. 8515631.
b. 8519719.
2.The member is eligible for the equivalent of 20 days of leave at full pay.
3.The following conditions apply to the leave.
a. The leave must be taken within 66 weeks of a child joining the member’s family on a permanent basis.
b. The leave may be taken at full pay or half pay.
c. The minimum period of leave that may be taken at a time is 1 day.
d. The leave under subsection 2 is reduced by the following for each day the member would otherwise be required for duty.
i.For each day of leave taken at full pay — 1 day.
ii.For each day of leave taken at half pay — 0.5 day.
5 Additional leave
1.This section applies to the member holding employee identification number 8515631.
2.The member is eligible for the equivalent of 10 weeks leave at full pay.
Note: The leave in this section is in addition to the leave in section 4.
3.The following conditions apply to the leave.
a. The leave must be commence by 27 May 2022.
b. The leave must be taken in a single continuous period.
c. The leave may be taken in any combination of full pay or half pay that is not more than the equivalent amount of full-time leave.
6 Effect on other benefits
1.The leave provided under this Determination counts as effective service for benefits provided under any of the following.
a. Defence Determination, Conditions of service 2016/19, as in force from time to time.
b. A determination made under Section 58H of the Defence Act 1903, as in force from time to time.
2.A member eligible for a benefit under this Determination is not eligible for the following under Chapter 5 Part 7 of the Defence Determination, Conditions of service 2016/19, as in force from time to time in relation to the same child.
a.Paid parental leave under Division 2.
b.Special paid parental leave under Division 3.
7 Applying for leave
Leave under this Determination must be applied for using form AF088 – Application for leave.
8 Repeals
This Determination repeals on 30 June 2023.
