1 Name
This instrument is the Defence (Individual benefits) Determination 2022 (No. 2).
2 Commencement
1. Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority
This instrument is made under section 58B of the Defence Act 1903.
4 Application
This Determination applies to a member holding one of the following employee identification numbers.
a.8219114.
b.8573635.
5 Purpose
The purpose of this Determination is to provide a member on a long-term overseas posting additional accommodation in Australia for their dependants before and after the birth of their children.
6 Definitions
In this Determination, the following apply.
Decision maker means Director Personnel Policy – Army.
Dependant has the same meaning given by section 12.3.5 of the Defence Determination.
Defence Determination means the Defence Determination 2016/19, Condition of service, as in force from time to time.
Partner has the same meaning given by section 1.3.88 of the Defence Determination.
7 Accommodation benefit
1.Subject to subsection 2, the member is eligible for accommodation in Australia for their dependants commencing on one of the following.
a.If the member or their partner has not been provided accommodation under section 15.5.20 of the Defence Determination — the day the member’s dependant returns to Australia for the purpose of giving birth.
b.If the member has been provided accommodation under section 15.5.20 of the Defence Determination — the day after the benefit under section 15.5.20 ends.
2.The maximum duration of the benefit under subsection 1 is the greater of the following.
a.Seventy-seven days less the number of days of accommodation provided to the member or their partner under section 15.5.20 in connection with giving birth.
b.The number of days from the commencement day under subsection 1 and a day specified by the decision maker.
3.The maximum daily rate for the accommodation is double the rate specified in Column C of the table in Annex 9.5.A Part 1 of the Defence Determination that corresponds with the location of the accommodation.
8 Ceasing to occupy paid accommodation
If the member’s dependant ceases to occupy paid accommodation before the end of the maximum duration of the benefit under subsection 7.2, the member ceases to be eligible under this Determination from the day the accommodation is no longer occupied by the dependant.
9 Provision of benefit
A benefit under this Determination may be provided directly to the member or by way of reimbursement.
10 Other travel benefits
To avoid doubt, there is no entitlement to meals or incidentals under this Determination.
11 Repeals
This Determination repeals on 31 December 2022.
