1  Name

This instrument is the Defence (Individual benefits) Determination 2021 (No. 3).

2  Commencement

This instrument commences the day after registration.

3  Authority

This instrument is made under section 58B of the Defence Act 1903.

4  Definitions

In this Determination, the following apply:

Baggage benefits means benefits provided under Chapter 14 Part 4 Division 2 of the Defence Determination that the member and their dependants would have been eligible for had they received a travel benefit under Chapter 14 Part 4 Division 1 of that determination.

Dependant has the same meaning given in the Defence Determination.

Defence Determination means the Defence Determination 2016/19, Conditions of service, as in force from time to time.

Travel costs means benefits under section 14.4.6 of the Defence Determination that would have been payable had the member and their dependants received a travel benefit under Chapter 14 Part 4 Division 1 of that determination.

4  Application

This Determination applies to the member holding the employee identification number: 8230382.

5  Flights

The member is eligible for business class flights for themself and 3 dependants to travel from Canberra, Australia to the member’s next posting location.

Note: The member does not need to travel at the same time as their dependants.

6  Travel costs and baggage benefits

The member is eligible for all of the following for each person who is eligible for a flight under section 5 of this Determination.

a.    Travel costs.

b.   Baggage benefits.

7  Effect of cancellation of the posting

If the member’s next posting is cancelled on request of the member before the posting commences, the member must repay all benefits received under this Determination.

8  Effect on other benefits

The member is not eligible for benefits under Chapter 14 Part 4 of the Defence Determination that are for the purpose of travel on commencement of the member’s posting for their dependants.
