Defence Forces Retirement Benefits

Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Defence Forces Retirement Benefits Act 1948.

1.   Amendment

1.1   The Defence Forces Retirement Benefits Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48]

2.   Regulation 2 (Interpretation)

2.1   Omit the regulation, substitute:

Interpretation

 “2.   In these Regulations, unless the contrary intention appears:

‘Act’ means the Defence Forces Retirement Benefits Act 1948.”.

3.   Regulation 3 (Commencement of contributions)

3.1   Omit the regulation.

4.   Regulation 4 (Fractions of a cent)

4.1   Omit the regulation.

5.   Regulation 5 (Payment of pensions, lump sum payments and refunds of contributions)

5.1   Omit the regulation, substitute:

Payment of pensions and lump sum payments

“5.

Pensions and lump sum payments granted under the Act must be authorised for payment in accordance with the Finance Regulations.”.

6.   Regulation 6 (Payments by Australia to the Fund)

6.1   Omit the regulation.

7.   Regulation 7 (Evidence as to pensioners)

7.1   Paragraph 7 (a):

Omit “alive;”, substitute “alive; and”.

7.2   Paragraph 7 (b):

Omit the paragraph.

8.   Regulation 8 (Prescribed rate of interest for purposes of section 17 (5) of the Act)

8.1   Omit the regulation.

9.   Regulation 8a (Prescribed rate of interest for purposes of sections 32 (2), 33 and 50 (1) of the Act)

9.1   Omit the regulation.

10.   Regulation 8b (Prescribed rate of interest for purposes of section 75 (2) and (3) of the Act)

10.1   Omit the regulation.

11.   Regulation 9 (Periods for elections)

11.1   Omit the regulation.

12.   Regulation 10 (Prescribed authorities of Australia)

12.1   Omit the regulation.

13.   Regulation 10a (Prescribed corps and services)

13.1   Omit the regulation.

14.   Regulation 11 (Incapacity due to wilful action)
