STATUTORY RULES.
REGULATIONS UNDER THE DEFENCE FORCES
RETIREMENT BENEFITS ACT 1948-1950.*
I, THE ADMINISTRATOR of the Government of
the Commonwealth of Australia, acting with the advice of the Federal Executive
Council, hereby make the following Regulations under the

AMENDMENTS OF THE DEFENCE FORCES RETIREMENT BENEFITS REGULATIONS.
1. Regulation 10 of the Defence Forces Retirement Benefits Regulations is amended by inserting after the words—

2. After Regulation 19 of the Defence Forces Retirement Benefits Regulations, the following regulations are inserted:—
“20.—(1.) The provisions of the Act shall apply to, and in respect of, any person who—
(
a )was a member of the Permanent Military Forces prior to the third day of September, 1939;

(
b )was discharged from those forces and, without a break in the continuity of his service, enlisted as a member in, or was appointed an officer of, a military force, raised for service in the war which commenced on that date;(
c ) served continuously in a military force of the kind specified in paragraph (b ) of this sub-regulation or in a military force raised for a specified period up to the date on which he retires or is discharged from the last-mentioned force or is enlisted in, or appointed an officer of, the Australian Regular Army; and(
d )was, immediately prior to the commencement of the Act, a contributor under theSuperannuation Act 1922-1947.“(2.) The continuous full-time service of a person to whom sub-regulation (1.) of this regulation applies in the Permanent Military Forces and in the military forces specified in that sub-regulation shall be deemed to be service for pension for the purposes of the Act.
“21. For the purposes of the definition of ‘retiring age for the rank held’ in the Act, the age for compulsory retirement of—
(
a ) a member of the Printing and Stationery Service of the Permanent Military Forces is the age specified in the following table opposite to the rank held by the member: -

“22. The pension or benefit payable to, or in respect of, an officer of the Printing and Stationery Services of the Permanent Military Forces on retirement on or after attaining the retiring age for the rank held shall, for the purposes of section 49 of the Act, be as provided by the Act.
“23.—( 1.) Subject, to the next succeeding sub-regulation, the daily pay of a member for the purposes of paragraph (
a )of sub-section (2.) of section 28 of the Act, shall be the rate of pay specified in the Third Schedule to these Regulations in relation to the rank, branch, group and period of service of the member.“(2.) Where a member is promoted to a higher rank and his daily rate of pay under the last preceding sub-regulation is, after promotion, loss than his daily rate of pay under that sub-regulation immediately prior to his promotion, the daily rate of pay of that member for the purposes of paragraph (
a )of sub-section (2.) of section 28 of the Act, shall be not less than his daily rate of pay under that sub-regulation immediately prior to his promotion.“(3.) For the purposes of this regulation, a member shall be deemed to have completed a period of service in rank specified in the Third Schedule to these Regulations if he is entitled to pay at the rate applicable, under the Service Regulations, to a person who has completed. that period of service in that rank.".
3. The Second Schedule of the Defence Forces Retirement Benefits Regulations is repealed and the following Schedule inserted in its stead:—
