DEFENCE FORCES RETIREMENT BENEFITS (DAILY RATES OF PAY) REGULATIONS.

Statutory Rules 1963, No. 37. (a)

Citation.

1. These Regulations may be cited as the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations.

(a) Made under the Defence Forces Retirement Benefits Act 1948-1962 on 11th May, 1963; notified in the Commonwealth Gazette on 17th May, 1963.

The form of introductory words used to make the Statutory Rule was as follows:—

“Whereas, by sub-section (1.) of section eighty-eight of the Defence Forces Retirement Benefits Act 1948-1962, it is provided that the Governor-General may make regulations, not inconsistent with that Act, prescribing all matters which by that Act are required or permitted to be prescribed, or which are necessary or convenient to be prescribed for carrying out or giving effect to that Act:

“And whereas, by sub-section (2.) of section twelve of the Defence Forces Retirement Benefits Act 1962, it is provided that regulations under the Defence Forces Retirement Benefits Act 1948-1962 for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section four of that Act made within the period of six months immediately following the date fixed under sub-section (1.) of section two of the Defence Forces Retirement Benefits Act 1962 shall, unless otherwise provided by the regulations, have effect and be deemed to have had effect from and including that date:

“And whereas the date fixed under sub-section (1.) of section two of the Defence Forces Retirement Benefits Act 1962 was the thirtieth day of November, 1962:

“Now therefore I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Forces Retirement Benefits Act 1948-1962 for the purpose of the definition of daily rate of pay “in sub-section (1.) of section four of that Act.”.

Maximum daily rates of active pay of members.

2. For the purpose of the definition of “daily rate of pay” in subsection (1.) of section 4 of the Defence Forces Retirement Benefits Act 1948-1962, the maximum daily rate of active pay of a member is, subject to the next succeeding regulation, the amount specified in column 4 of the Schedule to these Regulations opposite to the rank and description of the member set out in column 1, column 2 or column 3, as the case may be, of that Schedule.

Maximum daily rates of active pay of certain members

3. Where—

(a) the rank and description applicable to a member is the rank and description of—

(i) Midshipman (Supplementary List), or Cadet Midshipman, in the Permanent Naval Forces;

(ii) Cadet (Officer Cadet School) in the Permanent Military Forces; or

(iii) Aircrew Trainee in the Permanent Air Force;

(b) immediately before that rank and description commenced to be applicable to the member, another rank and description set out in column 1, column 2 or column 3 of the Schedule to these Regulations was applicable to him; and

(c) the amount specified in column 4 of that Schedule opposite to that other rank and description is greater than the amount specified in that column opposite to the first-mentioned rank and description,

the maximum daily rate of active pay of the member is that greater amount.
