STATUTORY RULES
REGULATIONS UNDER THE DEFENCE FORCES RETIREMENT BENEFITS ACT 1948-1971.*
ANDWHEREAS by sub-section (2.) of that section it is provided that where the pay of any class of members is increased or reduced, regulations for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of that Act in relation to members included within that class made after the date on and from which the increase or reduction took effect may be expressed to have taken effect from and including that date:
AND WHEREAS the pay of members the descriptions applicable to whom are referred to in the Third Schedule to these Regulations has been increased, in the case of members of the Naval Forces or the Air Force, on and from the seventeenth day of December, 1970, and, in the case of members of the Military Forces, on and from the eighteenth day of December, 1970:
AND WHEREAS the pay of certain female members was increased or further increased—
(
a ) in the case of the female members referred to in sub-regulation (4.) of regulation 13 of these Regulations—on and from the first day of October, 1969;(
b )in the case of the female members referred to in sub-regulation (4.) of regulation 14 of these Regulations—on and from the nineteenth day of December, 1969;(
c ) in the case of the female members referred to in sub-regulation (5.) of regulation 15 of these Regulations—on and from the first day of January, 1970;(
d )in the case of the female members of the Naval Forces or Military Forces referred to in sub-regulation (5.) of regulation 16 of these Regulations—on and from the eleventh day of September, 1970; and(
e )in the case of the female members of the Air Force referred to in sub-regulation (5.) of regulation 16 of these Regulations—on and from the tenth day of September, 1970:
AND WHEREAS the pay of certain apprentice tradesmen in the Military Forces referred to in regulation 17 of these Regulations was increased on and from the eighth day of December, 1970:
AND WHEREAS the pay of members, other than members referred to in sub-regulation (2.) of regulation 11 of these Regulations, was increased or further increased on and from the first day of January, 1971:
NOW THEREFORE I, THE GOVERNOR-GENERAL in and over the Commonwealth of

DEFENCE FORCES RETIREMENT BENEFITS (DAILY RATES OF PAY) REGULATIONS
Part I.—General.
1. These Regulations may be cited as the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations.
2. The Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations, comprising the Statutory Rules specified in the First Schedule to these Regulations, are repealed.
3. These Regulations are divided into Parts, as follows:—Part I.—General (Regulations 1-9).
Part II.—Transitional (Regulations 10-17).
4. —(1.) In these Regulations, “the Act” means theDefence Forces Retirement Benefits Act 1948-1971.(2.) In a Schedule to these Regulations—
(
a ) references to the Permanent Naval Forces shall be read as including references to the Naval Emergency Reserve Forces and the Citizen Naval Forces;(
b )references to the Permanent Military Forces shall be read as including references to the Citizen Military Forces; and(
c ) references to the Permanent Air Force shall be read as including references to the Air Force Emergency Force and the Citizen Air Force.(3.) A reference in these Regulations to the group in which a member is classified shall be read as a reference to the group in which he is classified for the purpose of being paid active pay.
(4.) For the purpose of these Regulations, a member of the Naval Forces shall be deemed to have on any day the same pay seniority as he has on that day for the purposes of the Naval Financial Regulations.
5. —(1.) For the purpose of the definition of “daily rate of pay” in subsection (1.) of section 4 of the Act—(
a ) the maximum daily rate of active pay of an officer (including a chaplain) the description applicable to whom is referred to in Part I., Part II. or Part III. of the Second Schedule to these Regulations is the rate specified in column 4 of that Schedule opposite to the description of the officer referred to in column 1, column 2 or column 3, as the case may be, of that Schedule; and(
b )the maximum daily rate of active pay of a male member, not being an officer, the description applicable to whom is referred to in Part IV. of the Second Schedule to these Regulations is the rate specified in column 4 of that Schedule opposite to the description of the member referred to in column 1, column 2 or column 3, as the case may be, of that Schedule.(2.) Subject to the last preceding sub-regulation, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act, the maximum daily rate of active pay of a member is the rate per day ascertained by adding a rate of One dollar forty-two cents per day to the prescribed daily rate in respect of the member.
6. —(1.)In this regulation—“seaman” means a male member of the Naval Forces, other than a male officer;
“servicewoman” means a member of the Women’s Service holding the rating of Chief Petty Officer Wran or a lower rating;
“the Women’s Service” means the Royal Australian Naval Nursing Service or the Women’s Royal Australian Naval Service.
(2.) In this regulation, a reference to the Naval Financial Regulations shall be read as a reference to those Regulations as in force on the date of commencement of these Regulations.
(3.) For the purpose of sub-regulation (2.) of the last preceding regulation, the prescribed daily rate in respect of a male officer is—
(
a ) in the case of a male officer in receipt of pay in accordance with sub-regulation (1a.) of regulation 9 of the Naval Financial Regulations—a rate per day equal to the rate per day at which active pay is payable under that sub-regulation to a Lieutenant (S.D.) who has not less than 10 years’ pay seniority in that rank;(
b ) in the case of a male officer in receipt of active pay in accordance with sub-regulation (2.) of regulation 10 of the Naval Financial Regulations—the rate per day specified in that sub-regulation; or(
c ) in the case of any other male officer—the rate per day specified in Division 2 of the Third Schedule, or in the Fourth Schedule, to the Naval Financial Regulations, whichever is applicable to the officer, in relation to the rank that he holds.(4.) For the purpose of sub-regulation (2.) of the last preceding regulation, the prescribed daily rate in respect of a female officer is the rate per day specified in Table 1 of the Fifteenth Schedule to the Naval Financial Regulations in relation to the rank that she holds.
(5.) For the purpose of sub-regulation (2.) of the last preceding regulation, the prescribed daily rate in respect of a seaman is a rate per day equal to the sum of—
(
a ) in the case of a seaman who holds the rating of Recruit—the rate per day specified in the Fifth Schedule to the Naval Financial Regulations in relation to a seaman holding the rating of Able Seaman and classified in Group 1 and the rate of Forty cents per day;(
b )in the case of a seaman who holds the rating of Ordinary Seaman or Able Seaman, Second Class—(i) if he has less than six months’ pay seniority—the rate per day specified in the Fifth Schedule to the Naval Financial Regulations in relation to a seaman holding the rating of Able Seaman and classified in Group 1 and the rate of Forty cents per day; or
(ii) in any other case—the rate per day specified in the Fifth Schedule to the Naval Financial Regulations in relation to a seaman holding the rating of Able Seaman and classified in Group 5 and the rate of Forty cents per day;
(
c ) in the case of a seaman who holds the rating of Chief Petty Officer and is not eligible to be paid at the rate of active pay higher than that payable to a Chief Petty Officer having less than four years’ pay seniority—the rate per day specified in the Fifth Schedule to the Naval Financial Regulations in relation to a seaman who holds the rating of Chief Petty Officer, has not less than two but less than four years’ pay seniority and is classified in the group in which he is classified and the rate of Forty cents per day; or(
d ) in the case of any other seaman—the rate per day specified in the Fifth Schedule or the Seventh Schedule to the Naval Financial Regulations, whichever is applicable to the seaman, in relation to the rating that he holds and the group in which he is classified and the rate of Forty cents per day.(6.) For the purpose of sub-regulation (2.) of the last preceding regulation, the prescribed daily rate in respect of a servicewoman is—
(
a )in the case of a servicewoman who holds the rating of Recruit—the rate per day specified in Table 2 in the Fifteenth Schedule to the Naval Financial Regulations in relation to a servicewoman who holds the rating of Wran and is classified in Group 1;(
b ) in the case of a servicewoman in receipt of active pay in accordance with sub-regulation (4.) of regulation 253 of the Naval Financial Regulations—the rate per day specified in Table 2 in the Fifteenth Schedule to the Naval Financial Regulations in relation to a service-woman who holds the rating of Leading Wran and is classified in Group 1; or(
c ) in the case of any other servicewoman—the rate per day specified in Table 2 in the Fifteenth Schedule to the Naval Financial Regulations in relation to the rating that she holds and the group in which she is classified.
7. —(I.) In this regulation—“servicewoman” means a female member of the Military Forces, other than a female officer;
“soldier” means a male member of the Military Forces, other than a male officer.
(2.) In this regulation, a reference to the Military Financial Regulations shall be read as a reference to those regulations as in force on the date of commencement of these Regulations.
(3.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in respect of a male officer is—
(
a )in the case of a male officer in receipt of pay in accordance with sub-regulation (3.) or (4.) of regulation 12 of the Military Financial Regulations—the rate per day specified in that sub-regulation; or(
b ) in the case of any other male officer—the rate per day specified in the table in sub-regulation (1.) or (2.) of regulation 12 of the Military Financial Regulations, whichever is applicable to the officer, in relation to the rank that he holds.(4.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in respect of a female officer is—
(
a )in the case of a female officer who is a medical officer or a dental officer—the rate per day specified in the table in sub-regulation (2.) of regulation 12d of the Military Financial Regulations in relation to the rank that she holds; or(
b ) in the case of any other female officer—the rate per day specified in the table in sub-regulation (1.) of regulation 12d of the Military Financial Regulations in relation to the rank that she holds.(5.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in respect of a soldier is a rate per day equal to the sum of—
(
a )in the case of a soldier who is a student at the Officer Cadet School or an Officer Training Unit—the rate per day specified in the Second Schedule to the Military Financial Regulations in relation to a soldier holding the rank of corporal and classified in Group 1 and the rate of Forty cents per day; or(
b ) in the case of any other soldier—the rate per day specified in the Second Schedule to the Military Financial Regulations in relation to the rank that he holds and the group in which he is classified and the rate of Forty cents per day.(6.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in respect of a servicewoman is—
(
a ) in the case of a servicewoman who is a student at an Officer Cadet Course at the Women’s Royal Australian Army Corps School—the rate specified in Part I, of the Third Schedule to the Military Financial Regulations in relation to a servicewoman holding the rank of corporal and classified in Group 1;(
b )in the case of a servicewoman in receipt of pay in accordance with sub-regulation (1a.) or (1c.) of regulation 12e of the Military Financial Regulations—the rate per day specified in the table in that sub-regulation in relation to the rank that she holds; or(
c ) in the case of any other servicewoman—the rate per day specified in the Third Schedule to the Military Financial Regulations in relation to the rank that she holds and the group in which she is classified.
8. —(1.) In this regulation—“airman” means a male member of the Air Force, other than a male officer;
“airwoman” means a female member of the Air Force, other than a female officer.
(2.) In this regulation, a reference to the Air Force Regulations shall be read as a reference to those Regulations as in force on the date of commencement of these Regulations.
(3.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in respect of a male officer is—
(
a )in the case of an officer in receipt of active pay in accordance with sub-regulation (4.) of regulation 543 of the Air Force Regulations— the rate per day specified in that sub-regulation; or(
b ) in the case of any other male officer—the rate per day specified in the table in sub-regulation (1.) or (7.) of regulation 543 of the Air Force Regulations, whichever is applicable to the officer, in relation to the rank that he holds.(4.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in respect of a female officer is—
(
a )in the case of a female officer who is a qualified medical or dental practitioner—the rate per day specified in the table in sub-regulation (10.) of regulation 543 of the Air Force Regulations in relation to the rank that she holds; or(
b ) in the case of any other female officer—the rate per day specified in sub-regulation (9.) of regulation 543 of the Air Force Regulations in relation to the rank that she holds.(5.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in respect of an airman is a rate per day equal to the sum of—
(
a ) in the case of an airman who holds the rank of Aircraftman (Recruit) or the rank of Trainee Aircrew—the rate per day specified in Part I. of the Fifth Schedule to the Air Force Regulations in relation to an airman holding the rank of Aircraftman and classified in Group 1 and the rate of Forty cents per day; or(
b ) in the case of any other airman—the rate per day specified in the Fifth Schedule to the Air Force Regulations in relation to the rank that he holds and the group in which he is classified and the rate of Forty cents per day.(6.) For the purpose of sub-regulation (2.) of regulation 5 of these Regulations, the prescribed daily rate in. respect of an airwoman is—
(
a ) in the case of an airwoman holding the rank of Aircraftwoman (Recruit)—the rate per day specified in Part I. of the Sixth Schedule to the Air Force Regulations in relation to an airwoman holding the rank of Aircraftwoman and classified in Group 1;(
b )in the case of an airwoman in receipt of active pay in accordance with sub-regulation (2b.) or (2c.) of regulation 549 of the Air Force Regulations—the rate per day specified in the table in that sub-regulation in relation to the rank that she holds; or(
c ) in the case of any other airwoman—the rate per day specified in the Sixth Schedule to the Air Force Regulations in relation to the rank that she holds and the group in which she is classified.
9. —(1.) A reference in the last three preceding regulations to the rate per day specified in—(
a )a table in a sub-regulation;(
b ) a table in a Schedule; or(
c ) a Schedule,in relation to a particular rank or to a particular rank and classification, shall, in a case where two or more rates per day are specified in the table or Schedule in relation to that rank or to that rank and classification, be read as a reference to the maximum rate per day so specified in relation to that rank or to that rank and classification.
(2.) In the application of sub-regulation (1.) of this regulation to members of the Naval Forces, a reference to a rank, or to a rank and classification, shall be read as including a reference to a rating, or to a rating and classification, as the case may be.
Part II.—Transitional.
10. In this Part, unless the contrary intention appears, “the prescribed regulations” means—(
a ) in the application of this Part to members of the Naval Forces— Statutory Rules 1971, No. 46;(
b )in the application of this Part to members of the Military Forces— Statutory Rules 1971, No. 45; and(
c ) in the application of this Part to members of the Air Force—Statutory Rules 1971, No. 50.
11. —(1.) Subject to the next succeeding sub-regulation, the regulations contained in Part I. of these Regulations have effect, and shall be deemed to have taken effect, in relation to members of the Naval Forces, the Military Forces and the Air Force, from and including the first day of January, 1971.(2.) The last preceding sub-regulation does not apply to or in relation to a member of the Defence Force the description applicable to whom is referred to in item 1, 2, 18, 19, 20 or 21 in the Second Schedule to these Regulations.
12. —(1.) For the purpose of the definition of “daily rate of pay” in subsection (1.) of section 4 of the Act, the maximum daily rate of active pay of a member, the description applicable to whom is referred to in Part I., Part II., Part III. or Part IV. of the Third Schedule to these Regulations is, in respect of service during the relevant period, the rate specified in column 4 of that Schedule opposite to the description of the officer referred to in column 1, column 2 or column 3, as the case may be, of that Schedule.(2.) In the last preceding sub-regulation, “the relevant period” is—
(
a )in relation to service of a member of the Naval Forces or the Air Force—the period from and including the seventeenth day of December, 1970, to and including the thirty-first day of December, 1970; and(
b )in relation to service of a member of the Military Forces—the period from and including the eighteenth day of December, 1970, to and including the thirty-first day of December, 1970.(3.) The last two preceding sub-regulations have effect, and shall be deemed to have taken effect—
(
a ) in relation to members of the Naval Forces or the Air Force the descriptions applicable to whom are referred to in Part I., Part II., Part III. or Part IV. of the Third Schedule to these Regulations— from and including the seventeenth day of December, 1970; and(
b )in relation to members of the Military Forces the descriptions applicable to whom are so referred to—from and including the eighteenth day of December, 1970.
13. —(1.) Subject to sub-regulation (3.) of this regulation, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act, the maximum daily rate of active pay of a female member, not being an officer, in respect of service during the period from and including the first day of October, 1969, to and including the eighteenth day of December, 1969, is the rate ascertained by adding the rate of One dollar twenty-seven cents per day to the rate specified, in relation to the rank that she held and the group in which she was classified—(
a ) in the case of a member of the Naval Forces—in the Fifth Schedule to Statutory Rules 1971, No. 46;(
b ) in the case of a member of the Military Forces—in the Seventh Schedule to Statutory Rules 1971, No. 45; or(
c ) in the case of a member of the Air Force—in the Fourth Schedule to Statutory Rules 1971, No. 50.(2.) In the application of the last preceding sub-regulation in relation to members—
(
a ) a member of the Naval Forces who held the rank of Recruit shall be deemed to have held the rank of Wran and to have been classified in Group 1;(
b )a member of the Naval Forces undergoing training under the Women’s Royal Australian Naval Forces Officer Training Scheme shall be deemed to have held the rank of Leading Wran and to have been classified in Group 1;(
c ) a member of the Military Forces who was a student at an Officer Cadet Course at the Women’s Royal Australian Army Corps School shall be deemed to have held the rank of Corporal and to have been classified in Group 1; and(
d )a member of the Air Force who held the rank of Aircraftwoman (Recruit) shall be deemed to have held the rank of Aircraftwoman and to-have been classified in Group 1.(3.) Sub-regulation (1.) of this regulation does not apply to—
(
a ) a member of the Military Forces who was serving in a position of Switchboard Operator or Accounting Machine Operator;(
b )a member of the Air Force who was mustered as a Telephone Operator or an Accounting Machine Operator; or(
c ) any other female member, not being an officer, whose maximum daily rate of active pay, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act in respect of the period specified in sub-regulation (1.) of this regulation, was, under the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as in force during that period, higher than her maximum daily rate of active pay under sub-regulation (1.) of this regulation.(4.) The preceding sub-regulations of this regulation have effect, and shall be deemed to have taken effect, in relation to those female members, not being officers, of the Naval Forces, the Military Forces and the Air Force, whose pay in respect of service during the period referred to in sub-regulation (1.) of this regulation was increased by the prescribed regulations, from and including the first day of October, 1969.
14. —(1.) Subject to sub-regulation (3.) of this regulation, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act, the maximum daily rate of active pay of a female member, not being an officer, in respect of service during the period from and including the nineteenth day of December, 1969, to and including the thirty-first day of December, 1969, is the rate ascertained by adding the rate of One dollar thirty-two cents per day to the rate specified, in relation to the rank that she held and the group in which she was classified—(
a ) in the case of a member of the Naval Forces—in the Sixth Schedule to Statutory Rules 1971, No. 46;(
b ) in the case of a member of the Military Forces—in the Eighth Schedule to Statutory Rules 1971, No. 45; or(
c ) in the case of a member of the Air Force—in the Fifth Schedule to Statutory Rules 1971, No. 50.(2.) In the application of the last preceding sub-regulation in relation to members—
(
a ) a member of the Naval Forces who held the rank of Recruit shall be deemed to have held the rank of Wran and to have been classified in Group 1;(
b )a member of the Naval Forces undergoing training under the Women’s Royal Australian Naval Forces Officer Training Scheme shall be deemed to have held the rank of Leading Wran and to have been classified in Group 1;(
c ) a member of the Military Forces who was a student at an Officer Cadet Course at the Women’s Royal Australian Army Corps School shall be deemed to have held the rank of Corporal and to have been classified in Group 1; and(
d ) a member of the Air Force who held the rank of Aircraftwoman (Recruit) shall be deemed to have held the rank of Aircraftwoman and to have been classified in Group 1.(3.) Sub-regulation (1.) of this regulation does not apply to—
(
a )a member of the Military Forces who was serving in a position of Switchboard Operator or Accounting Machine Operator;(
b )a member of the Air Force who was mustered as a Telephone Operator or an Accounting Machine Operator; or(
c ) any other female member, not being an officer, whose maximum daily rate of active pay, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act in respect of the period specified in sub-regulation (1.) of this regulation, was, under the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as in force during that period, higher than her maximum daily rate of active pay under sub-regulation (1.) of the regulation.(4.) The preceding sub-regulations of this regulation have effect, and shall be deemed to have taken effect, in relation to those female members, not being officers, of the Naval Forces, the Military Forces and the Air Force whose pay in respect of service during the period referred to in sub-regulation (1.) of this regulation was increased by the prescribed regulations, from and including the nineteenth day of December, 1969.
15. —(1.) In this regulation, “the relevant period” means—(
a )in the application of this regulation to female members of the Naval Forces or Military Forces—the period from and including the first day of January, 1970, to and including the tenth day of September, 1970; and(
b )in the application of this regulation to female members of the Air Force—the period from and including the first day of January, 1970, to and including the ninth day of September, 1970.(2.) Subject to sub-regulation (4.) of this regulation, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act, the maximum daily rate of active pay of a female member, not being an officer, in respect of service during the relevant period is the rate ascertained by adding the rate of One dollar thirty-two cents per day to the rate specified, in relation to the rank that she held and the group in which she was included—
(
a ) in the case of a member of the Naval Forces—in the Seventh Schedule to Statutory Rules 1971, No. 46;(
b )in the case of a member of the Military Forces—in the Ninth Schedule to Statutory Rules 1971, No. 45; or(
c ) in the case of a member of the Air Force—in the Sixth Schedule to Statutory Rules 1971, No. 50.(3.) In the application of the last preceding sub-regulation in relation to members—
(
a ) a member of the Naval Forces who held the rank of Recruit shall be deemed to have held the rank of Wran and to have been classified in Group 1;(
b )a member of the Naval Forces undergoing training under the Women’s Royal Australian Naval Forces Officer Training Scheme shall be deemed to have held the rank of Leading Wran and to have been classified in Group 1;(
c ) a member of the Military Forces who was a student at an Officer Cadet Course at the Women’s Royal Australian Army Corps School shall be deemed to have held the rank of Corporal and to have been classified in Group 1; and(
d )a member of the Air Force who held the rank of Aircraftwoman (Recruit) shall be deemed to have held the rank of Aircraftwoman and to have been classified in Group 1.(4.) Sub-regulation (2.) of this regulation does not apply to—
(
a )a member of the Military Forces who was serving in a position of Switchboard Operator or Accounting Machine Operator;(
b )a member of the Air Force who was mustered as a Telephone Operator or an Accounting Machine Operator; or(
c ) any other female member, not being an officer, whose maximum daily rate of active pay, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act in respect of the relevant period, was, under the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as in force during that period, higher than her maximum daily rate of active pay under sub-regulation (2.) of this regulation.(5.) The preceding sub-regulations of this regulation have effect, and shall be deemed to have taken effect, in relation to those female members, not being officers, of the Naval Forces, the Military Forces and the Air Force whose pay in respect of service during the relevant period was increased by the prescribed regulations, from and including the first day of January, 1970.
16. —(1.) In this regulation, “the relevant period” means—(
a ) in the application of this regulation to female members of the Naval Forces or Military Forces—the period from and including the eleventh day of September, 1970, to and including the thirty-first day of December, 1970; and(
b )in the application of this regulation to female members of the Air Force—the period from and including the tenth day of September, 1970, to and including the thirty-first day of December, 1970.(2.) Subject to sub-regulation (4.) of this regulation, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act, the maximum daily rate of active pay of a female member, not being an officer, in respect of service during the relevant period, is the rate ascertained by adding the rate of One dollar thirty-two cents per day to the rate specified, in relation to the rank that she held and the group in which she was included—
(
a ) in the case of a member of the Naval Forces—in the Eighth Schedule to Statutory Rules 1971, No. 46;(
b ) in the case of a member of the Military Forces—in the Tenth Schedule to Statutory Rules 1971, No. 45; or(
c ) in the case of a member of the Air Force—in the Seventh Schedule to Statutory Rules 1971, No. 50.(3.) In the application of the last preceding sub-regulation in relation to members—
(
a ) a member of the Naval Forces who held the rank of Recruit shall be deemed to have held the rank of Wran and to have been classified in Group 1;(
b )a member of the Naval Forces undergoing training under the Women’s Royal Australian Naval Forces Officer Training Scheme shall be deemed to have held the rank of Leading Wran and to have been classified in Group 1;(
c )a member of the Military Forces who was a student at an Officer Cadet Course at the Women’s Royal Australian Army Corps School shall be deemed to have held the rank of Corporal and to have been classified in Group 1; and(
d )a member of the Air Force who held the rank of Aircraftwoman (Recruit) shall be deemed to have held the rank of Aircraftwoman and to have been classified in Group 1.(4.) Sub-regulation (2.) of this regulation does not apply to—
(
a ) a member of the Military Forces who was serving in a position of Switchboard Operator or Accounting Machine Operator;(
b )a member of the Air Force who was mustered as a Telephone Operator or an Accounting Machine Operator; or(
c ) any other female member, not being an officer, whose maximum daily rate of active pay, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act in respect of the relevant period was, under the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as in force during that period, higher than her maximum daily rate of active pay under sub-regulation (2.) of this regulation.(5.) The preceding sub-regulations of this regulation have effect, and shall be deemed to have taken effect—
(
a )in relation to those female members, not being officers, of the Naval Forces or Military Forces whose pay in respect of service during the relevant period was increased by any of the prescribed regulations—from and including the eleventh day of September, 1970; and(
b ) in relation to those female members, not being officers, of the Air Force whose pay in respect of service during the relevant period was increased by Statutory Rules 1971, No. 50—from and including the tenth day of September, 1970.
17. —(1.) For the purpose of the definition of “daily rate of pay” in sub-regulation (5.) of regulation 4 of the Act, the maximum daily rate of active pay of an apprentice tradesman in the Military Forces in respect of service in the fourth year of his apprentice training during the period from and including the eighth day of December, 1970, to and including the thirty-first day of December, 1970, is Seven dollars twenty-two cents per day.(2.) The last preceding sub-regulation has effect, and shall be deemed to have taken effect, in relation to an apprentice tradesman in the Military Forces from and including the eighth day of December, 1970.
