REGULATIONS UNDER THE DEFENCE FORCES RETIREMENT BENEFITS ACT 1948–1970.*

WHEREAS by sub-section (1.) of section 88 of the Defence Forces Retirement Benefits Act 1948–1970 it is provided that the Governor-General may make Regulations, not inconsistent with that Act, prescribing all matters which by that Act are required or permitted to be prescribed, or which are necessary or convenient to be prescribed for carrying out or giving effect to that Act:

AND WHEREAS by sub-section (2.) of that section it is provided that where the pay of any class of members is increased or reduced, regulations for the purposes of the definition of “daily rate of pay” in sub-section (1.) of section 4 of that Act in relation to members included within that class made after the date on and from which the increase or reduction took, effect may be expressed to have taken effect from and including that date:

AND WHEREAS the pay of members the descriptions applicable to whom are referred to in the items in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations, other than items 1, 2, 3, 4, 18 to 33 (inclusive), 46, 48 and 49, has been increased, in the case of members of the Naval Forces or the Military Forces, on and from the eleventh day of September, 1970, and, in the case of members of the Air Force, on and from the tenth day of September, 1970:

AND WHEREAS the pay of members the descriptions applicable to whom are referred to in items 30 and 31 in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations—

(a) were increased on the eighteenth day of December, 1969; and

(b) were again increased on and from the nineteenth day of December, 1969:

AND WHEREAS the pay of members the descriptions applicable to whom are referred to in items 32 and 33 in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations—

(a)were increased on the eighteenth day of December, 1969;

(b) were again increased on and from the nineteenth day of December, 1969; and

(c) were further increased, in the case of members of the Naval Forces or the Military Forces, on and from the eleventh day of September, 1970, and, in the case of members of the Air Force, on and from the tenth day of September, 1970:

NOW THEREFORE I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Forces Retirement Benefits Act 1948–1970 for the purpose of the definition of “daily rates of pay” in subsection (1.) of section 4 of that Act.

Amendments of the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations*

Maximum daily rates of active pay of members.

1. Regulation 2 of the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations is amended by omitting from sub-regulation (1.) the word “active” (first occurring).

Transitional.

4.—(1.) In this regulation—

“the Act” means the Defence Forces Retirement Benefits Act 1948–1970;

“the Regulations” means the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as in force on the eighteenth day of December, 1969, or on any subsequent day.

(2.) Notwithstanding regulation 2 of the Regulations, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act, the maximum daily rate of active pay of a male medical or dental officer in respect of the eighteenth day of December, 1969, is—

(a) if he held the rank of Surgeon Captain, Colonel or Group Captain on that day—Thirty-five dollars forty-four cents;

(b) if he held the rank of Surgeon Commander, Lieutenant-Colonel or Wing Commander on that day—Thirty-two dollars seventy-seven cents;

(c) if he held the rank of Surgeon Lieutenant-Commander, Major or Squadron Leader on that day—Twenty-seven dollars nineteen cents; or

(d) if he held the rank of Surgeon Lieutenant, Captain or Flight Lieutenant on that day—Twenty-three dollars two cents.

(3.) Notwithstanding regulation 2 of the Regulations, for the purpose of the definition of “daily rate of pay” in sub-section (1.) of section 4 of the Act, the maximum daily rate of active pay of a male medical or dental officer in respect of a day in the prescribed period is—

(a) if he held the rank of Surgeon Lieutenant-Commander, Major or Squadron Leader on that day—Twenty-seven dollars ninety-nine cents; or

(b) if he held the rank of Surgeon Lieutenant, Captain or Flight Lieutenant on that day—Twenty-three dollars seventy cents.

(4.) For the purpose of the last preceding sub-regulation, the prescribed period is—

(a) in relation to a member of the Naval Forces or the Military Forces —the period from and including the nineteenth day of December, 1969, to and including the tenth day of September, 1970; and

(b) in relation to members of the Air Force—the period from and including the nineteenth day of December, 1969 to and including the ninth day of September, 1970.

Application.

5.—(1.) Regulations 2 and 3 of these Regulations have effect and shall be deemed to have taken effect—

(a) in relation to members of the Naval Forces or the Military Forces, other than members the descriptions applicable to whom arc referred to in items 28, 29, 30, 31, 46, 48 and 49 in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations—from and including the eleventh day of September, 1970;

(b) in relation to members of the Air Force, other than members the descriptions applicable to whom are referred to in the items in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations specified in the last preceding paragraph—from and including the tenth day of September, 1970; and

(c) in relation to members of the Naval Forces, the Military Forces and the Air Force the descriptions applicable to whom are referred to in items 30 and 31 in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations—from and including the nineteenth day of December, 1969.

(2.) Sub-regulations (1.) and (2.) of regulation 4 of these Regulations have effect and shall be deemed to have taken effect in relation to members of the Naval Forces, the Military Forces and the Air Force the descriptions applicable to whom are referred to in items 30, 31, 32 and 33 in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations from and including the eighteenth day of December, 1969.

(3.) Sub-regulations (3.) and (4.) of regulation 4 of these Regulations have effect and shall be deemed to have taken effect in relation to members of the Naval Forces, the Military Forces and the Air Force the descriptions applicable to whom are referred to in items 32 and 33 in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations from and including the nineteenth day of December, 1969.
