REGULATIONS UNDER THE DEFENCE FORCES RETIREMENT BENEFITS ACT 1948-1969.*

WHEREAS by sub-section (1.) of section 88 of the Defence Forces Retirement Benefits Act 1948-1969 it is provided that the Governor-General may make regulations, not inconsistent with that Act, prescribing all matters which by that Act are required or permitted to be prescribed, or which are necessary or convenient to be prescribed for carrying out or giving effect to that Act:

AND WHEREAS by sub-section (2.) of that section it is provided that, where the pay of any class of members is increased or reduced, regulations for the purposes of the definition of “daily rate of pay” in sub-section (1.) of section 4 of that Act in relation to members included within that class made after the date on and from which the increase or reduction took effect may be expressed to have taken effect from and including that date:

AND WHEREAS the pay of members the descriptions applicable to whom are referred to in Part II. of the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations has been increased, in the case of members of the Naval Forces or the Military Forces, on and from the fourth day of July, 1969, and in the case of members of the Air Force, on and from the third day of July, 1969:

AND WHEREAS the pay of the following members has been increased on and from the nineteenth day of December, 1969, that is to say—

(a) those members the descriptions applicable to whom are referred to in the items in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations, other than items 1 and 2 in that Schedule; and

(b) those members who hold any of the ranks specified in the Fourth Schedule to those Regulations as so amended and are included in any of the groups specified in the Second Schedule or Third Schedule to those Regulations as so amended:

NOW THEREFORE I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Forces Retirement Benefits Act 1948-1969 for the purpose of the definition of “daily rate of pay” in subsection (1.) of section 4 of that Act.

Amendments of the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations*

Maximum daily rates of active pay of members.

1. Regulation 2 of the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations is repealed and the following regulation inserted in its stead:—

“2.—(1.) For the purpose of the definition of ‘daily rate of active pay’ in sub-section (1.) of section 4 of the Defence Forces Retirement Benefits Act 1948-1968—

(a) the maximum daily rate of active pay of an officer (including a chaplain) the description applicable to whom is referred to in the First Schedule to these Regulations is the amount specified in column 4 of that Schedule opposite to the description of the officer referred to in column 1, column 2 or column 3, as the case may be, of that Schedule;

(b) the maximum daily rate of active pay of a member, not being an officer, the description applicable to whom is referred to in Part VI. or Part VII. of the First Schedule to these Regulations is the amount specified in column 4 of that Part of that Schedule opposite to the description of the member referred to in column 1, column 2 or column 3, as the case may be, of that Part of that Schedule;

(c) the maximum daily rate of active pay of a male member, not being an officer—

(i) who, being a member of the Military Forces, holds a rank specified in the Second Schedule to these Regulations; or

(ii) who, not being a member of the Military Forces, holds a rank that corresponds with a rank in the Military Forces specified in the Second Schedule to these Regulations,

and who is included in a group specified in Part I., Part II., Part III. or Part IV. of that Schedule is the amount specified in that Part in relation to—

(iii) the rank in the Military Forces that he holds or the rank in the Military Forces that corresponds with the rank that he holds, as the case may be; and

(iv) the group in which he is included; and

(d) the maximum daily rate of active pay of a female member, not being an officer—

(i) who, being a member of the Military Forces, holds a rank specified in the Third Schedule to these Regulations; or

(ii) who, not being a member of the Military Forces, holds a rank that corresponds with a rank in the Military Forces specified in the Third Schedule to these Regulations,

and who is included in a group specified in Part I., Part II., Part III. or Part IV. of that Schedule is the amount specified in that Part in relation to—

(iii) the rank in the Military Forces that she holds or the rank in the Military Forces that corresponds with the rank that she holds, as the case may be; and

(iv) the group in which she is included.

“(2.) For the purpose of the last preceding sub-regulation—

(a)in the case of male members of the Naval Forces—the rank in the Naval Forces that corresponds with a rank in the Military Forces

specified in column 1 of Part I. of the Fourth Schedule to these Regulations is the rank specified in column 2 of that Part of that Schedule opposite to that rank in the Military Forces in column 1;

(b) in the case of male members of the Air Force—the rank in the Air Force that corresponds with a rank in the Military Forces specified in column 1 of Part I. of the Fourth Schedule to these Regulations is the rank specified in column 3 of that Part of that Schedule opposite to that rank in the Military Forces in column 1;

(c) in the case of female members of the Naval Forces—the rank in the Naval Forces that corresponds with a rank in the Military Forces specified in column 1 of Part II. of the Fourth Schedule to these Regulations is the rank specified in column 2 of that Part of that Schedule opposite to that rank in the Military Forces in column 1;

and

(d) in the case of female members of the Air Force—the rank in the Air Force that corresponds with a rank in the Military Forces specified in column 1 of Part II. of the Fourth Schedule to these Regulations is the rank specified in column 3 of that Part of that Schedule opposite to that rank in the Military Forces in column 1.

“(3.) In the Schedule to these Regulations—

(a) references to the Permanent Naval Forces shall be read as including references to the Naval Emergency Reserve Forces and the Citizen Naval Forces;

(b) references to the Permanent Military Forces shall be read as including references to the Citizen Military Forces; and

(c) references to the Permanent Air Force shall be read as including references to the Air Force Emergency Force and the Citizen Air Force.

“(4.) Where a member of the Naval Forces, Military Forces or Air Force is classified for the purposes of pay in a group identified by a particular number, the member shall, for the purposes of these Regulations, be deemed to be included in the group so numbered in the Second Schedule to these Regulations or the Third Schedule to these Regulations, as the case requires.”.

References to Artificer, Artisan or Mechanician.

2. Regulation 5 of the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations is repealed.

For the purpose of the definition of “daily rate of active pay” in sub-section (1.) of section 4 of the Defence Forces Retirement Benefits Act 1948-1968 or of that Act as in force at any time before the commencement of these Regulations, the maximum daily rate of active pay of a chaplain of the Defence Force the description applicable to whom is referred to in the Schedule to these Regulations in respect of service during the relevant period is the amount specified in column 4 of that Schedule opposite to the description of the chaplain referred to in column 1, column 2 or column 3, as the case may be, of that Schedule in lieu of the maximum daily rate of active pay specified, during the relevant period, opposite to the description of the officer in column 1, column 2 or column 3, as the case may be, of the Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations.

(2.) In the last preceding sub-regulation, “the relevant period” means—

(a) in the case of a chaplain of the Naval Forces or the Military Forces —the period from and including the fourth day of July, 1969, to and including the eighteenth day of December, 1969; and

(b) in the case of a chaplain of the Air Force—the period from and including the third day of July, 1969, to and including the eighteenth day of December, 1969.

(3.) This regulation has effect and shall be deemed to have taken effect—

(a) in the case of a chaplain of the Naval Forces or the Military Forces —from and including the fourth day of July, 1969; and

(b) in the case of a chaplain of the Air Force—from and including the third day of July, 1969.

Application.

5. Regulations 1, 2 and 3 of these Regulations have effect and shall be deemed to have taken effect from and including the nineteenth day of December, 1969, in relation to—

(a) members of the Naval Forces, the Military Forces and the Air Force the descriptions applicable to whom are referred to in the items in the First Schedule to the Defence Forces Retirement Benefits (Daily Rates of Pay) Regulations as amended by these Regulations, other than items 1 and 2 in that Schedule; and

(b) members of the Naval Forces, the Military Forces and the Air Force who hold any of the ranks specified in the Fourth Schedule to those Regulations as so amended and are included in any of the groups specified in the Second Schedule or Third Schedule to these Regulations as so amended.
