REGULATIONS UNDER THE DEFENCE ACT 1903-1970, THE NAVAL DEFENCE ACT 1910-1971 AND THE AIR FORCE ACT 1923-1965.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Act 1903-1970, the Naval Defence Act 1910-1971 and the Air Force Act 1923-1965.*

DEFENCE FORCE (SALARIES) REGULATIONS

Part I—Preliminary

Citations.

1. These Regulations may be cited as the Defence Force (Salaries) Regulations.

Commencement.

2. (1) These Regulations in their application, to and in relation to members of the Air Force shall be deemed to have come into operation on 8th February, 1973.

(2) These Regulations in their application to and in relation to members of the Naval Forces and members of the Military Forces shall be deemed to have come into operation on 9th February, 1973.

Parts.

3. These Regulations are divided into Parts, as follows:—

Part I—Preliminary (Regulations 1-4).

Part II—Salaries and Allowances Payable to Members of the Defence Force on continuous Full-time Service (Regulations 5-22).

Part III—Modifications of the Naval Financial Regulations in their application to Members to whom Part II Applies (Regulations 23-26).

Part IV—Modifications of the Military Financial Regulations in their application to Members to whom Part II Applies (Regulations 27-29).

Part V—Modifications of the Air Force Regulations in their application to Members to whom Part II Applies (Regulations 30-33).

Interpretation.

4. (1) In these Regulations, unless the contrary appears—

“ category M member ” means a male member who maintains a home for his dependants in which he normally resides with one or more of his dependants;

“ category MS member ” means a male member who maintains a home for his dependants and is prevented by the exigencies of the service from residing in that home;

“ category O member ” means a member other than a category M member or a category MS member;

“ child ”, in relation to a member, means a child (whether born in or outside wedlock), a step-child or a legally adopted child of—

(a) the member;

(b) the wife or the de facto wife of the member; or

(c) a female who was formerly the wife or the de facto wife of the member,

who—

(d) is less than twenty-one years of age and is wholly or substantially dependent on the member; or

(e) is twenty-one years of age or over and is, through illness or infirmity, wholly or substantially dependent upon the member;

de facto wife ”, in relation to a member, means a female who, although not legally married to him, lives with him on a permanent and bona fide domestic basis as his wife;

“ dental officer ” means an officer who is a qualified dental practitioner and is serving in—

(a) the Dental Branch of the Naval Forces;

(b) the Royal Australian Army Dental Corps; or

(c) the Medical Branch of the Air Force;

“ dependant ”, in relation to a member, means the wife, the de facto wife or a child of the member;

“ male nurse ” means a male officer of—

(a) the Royal Australian Army Nursing Corps; or

(b) the Medical Branch of the Air Force,

who is a qualified nurse;

“ medical officer ” means an officer who is a qualified medical practitioner and is serving in—

(a) the Medical Branch of the Naval Forces;

(b) the Royal Australian Army Medical Corps; or

(c) the Medical Branch of the Air Force;

“ member ” means a member of the Permanent Naval Forces, of the Permanent Military Forces or of the Permanent Air Force ant includes any member of the Defence Force rendering continuous full-time service, but does not include an officer who holds a rank higher than a rank specified in Schedule 1 or a person who is a member within the meaning of the Naval Forces (Papua New Guinea Division) Regulations or the Military Financial (Pacific Islanders) Regulations;

“ rate ” means rate per year;

“ sea-going ship ” means a ship in commission in the service of the Naval Forces, or a ship of another part of the Defence Force declare by the Service Board to be a sea-going ship for the purposes of these Regulations;

 

“ Service Board ” means—

(a) in relation to the Naval Forces—the Naval Board;

(b) in relation, to the Military Forces-—the Military Board; and

(c) in relation to the Air Force—the Air Board;

“ the Service Financial Regulations ” means—

(a) in relation to a member of the Naval Forces—the Naval Financial Regulations;

(b) in relation to a member of the Military Forces—the Military Financial Regulations; or

(c) in relation to a member of the Air Force—the Air Force Regulations;

“ the prescribed day ” means—

(a) in relation to a member of the Air Force—8th February, 1973; or

(b) in relation to a member of the Naval Forces or of the Military Forces-—-9th February, 1973;

“ the prescribed period ” means—

(a) in relation to members of the Air Force—the period that commenced on 8th February, 1973, and ended on 30th May, 1973; and

(b) in relation to members of the Naval Forces and the Military Forces—the period that commenced on 9th February, 1973, and ended on 31st May, 1973.

(2) In these Regulations, a reference to a member who maintains a home for his dependants shall be read as a reference to a member who provides living and sleeping accommodation for all or any of the following, namely, his wife, de facto wife, child or children, and “ home ” has a corresponding meaning,

(3) Subject to sub-regulations (1) and (2), expressions used in these Regulations have the same respective meanings .as those expressions have in the Service Financial Regulations.

Part II—Salaries and Allowances Payable to Members of the Defence Force on Continuous Full-time Service

Salaries and allowances of members.

5. Members of the Permanent Naval Forces, of the Permanent Military Forces, of the Permanent Air Force and other members of the Defence Force rendering continuous full-time service shall be paid salaries and allowances in accordance with the annual rates fixed by this Part according to their respective ranks and the respective classes into which they are divided.

Classes of members.

6. For the purposes of this Part—

(a) the members who hold the ranks specified in Schedule 1 constitute a class of members; and

(b) the respective members who have the description specified in the heading to a Schedule, other than Schedule 1, each constitute a class of members.

Annual rate of salary payable to officers.

7. The rate of salary payable to a member who is an officer is—

(a) if, in the Schedule appropriate to the class of members in which the officer is included, the reference to the rank held by the member is not followed by a reference to under 1 year or by a reference to a number of years—the rate specified in Column 4 of that Schedule opposite to the description of the rank held by the officer; and

 

(b) in any other case—the rate specified in Column 4 of the Schedule appropriate to the class of members in which the officer is included in relation to the rank held by the officer opposite to the number of years equal to the number of years of service that the officer has completed in the rank.

General rates of salaries payable tomembers other than officers and trainees.

8.(1) The rate of salary payable to a member who is included in the class of members the description of which is specified in the heading to Schedule 7 or 8 is—

(a) in the case of a member who holds a rank, specified in Part I of Schedule 7 or Part I of Schedule 8—the rate specified in relation to the rank held by the member and the pay level appropriate, under the Service Financial Regulations, to the member;

(b) in the case of a member who holds a rank specified in Part II of Schedule 7 or in Part II of Schedule 8—the rate specified in whichever of those Parts is applicable to the rank held by the member opposite to the number of years that is equal, to the number of years of service that the member has completed, or is deemed to have completed, in that rank; and

(c) in the case of a member who holds a rank specified in. Part III of Schedule 7 or Part III of Schedule 8—the rate specified in whichever of those Parts is applicable to the rank held by the member opposite to the number of years that is equal to the number of years of service that the member has completed, or is deemed to have completed, in that rank.

(2) For the purposes of Part II of Schedule 7 and of Part II of Schedule 8, a member shall, on promotion to a rank specified in that Part, be deemed to have completed the number of years service in that rank that is specified in Part IV of that Schedule opposite to the pay level appropriate, under the Service Financial Regulations, to the member.

(3) For the purposes of Part III of Schedule 7 or Part III of Schedule 8—

(a) a male member who, immediately before promotion to the rank of Artificer 1st Class, Mechanician 1st Class or Naval Shipwright 1st Class, to the rank of Staff Sergeant or to the rank of Flight Sergeant, was in receipt of salary at the rate payable to a male member holding the rank of Petty Officer in the Naval Forces or of Sergeant in the Military Forces or the Air Force who has completed six years’ service in the rank; or

(b) a female member who, immediately before promotion to the rank of Chief Petty Officer, Staff Sergeant or Flight Sergeant was in receipt of salary at the rate payable to a female member holding the rank of Petty Officer in the Naval Forces or Sergeant in the Military Forces or the Air Force who has completed six years’ service in the rank,

shall be deemed on promotion to have completed one year’s service in the rank to which the member is promoted.

Rate of salaries of members undergoing training.

9. (1) Subject to sub-regulations (2) and (3), the rate of salary payable to a member undergoing training in a capacity specified in Schedule 9 is the rate specified in that Schedule for the capacity in which he is being trained and, where appropriate, the year of the course of training that he is undergoing,

(2) Where the rate of salary payable to a member undergoing training in a capacity specified in items 5 and 8 in Schedule 9, being a member who is not in receipt of service allowance and not being an Air Cadet at the Air Force Academy, is less than the rate of salary payable to the member immediately before commencing training in that capacity or, if immediately before commencing training in that capacity, the member was paid service allowance, is less than

 

the rate equal to the sum of the rate of salary and the rate of service allowance payable to the member immediately before commencing training in that capacity, the member shall be paid salary at that higher rate.

(3) Where the rate of salary payable to a member undergoing training in a capacity specified in item 9 or 10 in Schedule 9, being a member who is not in receipt of service allowance, is less than the rate payable to a member holding the rank that the first-mentioned member held, immediately before commencing training in that capacity, and having completed, or being deemed to have completed, the same period of service as the first-mentioned member or, if immediately before commencing training, the member was paid service allowance, the rate equal to the sum of the salary and service allowance payable from time to time to the second-mentioned member, the first-mentioned member shall be paid salary at that higher rate.

Service allowance.

10. (1) Subject to sub-regulation (2), an allowance, called “ service allowance ”, is payable to a member in respect of his service, at the rate of $750.00.

(2) Service allowance is not payable to a member who—

(a) holds a rank specified in Schedule 1 or a higher rank;

(b) being a medical officer or dental officer, holds the rank of Commander or a higher rank, the rank of Lieutenant Colonel or a higher rank or the rank of Wing Commander or a higher rank;

(c) is a member referred to in item 5, 6, 7, 8, 9, 10 or 11 of Schedule 9;

(d) is a Junior Recruit who has not been posted from the junior recruit training establishment; or

(e) is a member referred to in item 3 of Schedule 9 who has not been posted from the junior training establishment or, in the case of a Junior Musician in the Naval Forces, has not commenced the course of training for Musician.

Living out allowance.

11. (1) Subject to this regulation, a category O member who is—

(a) required due to the lack of service accommodation for the member: or

(b) permitted by his commanding officer for compelling compassionate or personal reasons,

to reside in accommodation, other than service accommodation, shall be paid an allowance, called “ living out allowance ”.

(2) Where the sum of—

(a) the cost of reasonable accommodation and meals for a week or the amount paid by the member for accommodation and meals for a week, whichever is the less; and

(b) where laundry facilities are not available to the member at a service establishment or at his accommodation unless an additional amount is paid by the member in respect of those facilities, the reasonable cost of laundry charges,

exceeds the amount payable under regulation 19 by the member as rations and quarters charge payable by him if he were liable to pay that charge, living out allowance at a rate per week equal to the amount of the excess is payable to the member, but, if that sum does not exceed that amount, living out allowance is not payable to the member.

(3) Living out allowance ceases to be payable to a member who was required to live out due to the lack of service accommodation on and from the date on which service accommodation becomes available for the member.

(4) Living out allowance ceases to be payable to a member who was permitted by his commanding officer to live out for the reasons referred to' in paragraph 11 (1) (b) when those reasons have ceased to exist.

 

(5) Living out allowance is not payable to a member for any period in respect of which he is entitled to be paid travelling allowance under the Service Financial Regulations.

(6) Living out allowance is not payable to a member unless the member produces receipts for payments made by him in respect of which, the allowances is claimed.

(7) Living out allowance ceases to be payable under the preceding provisions of this regulation to a member who—

(a) is admitted to hospital;

(b) lives in temporarily for service reasons;

(c) proceeds to another station on temporary duty and either lives in or out at his temporary station; or

(d) proceeds on leave of absence with pay (including furlough or leave of absence for long service).

(8) Where a member referred to in sub-regulation (7) is required to pay for the reservation, of his lodgings and would, but for a circumstance specified in that sub-regulation, have continued to be paid living out allowance, the member is, subject to sub-regulations (9), (10), (11) and (12), entiled to be paid an allowance at a rate per week not exceeding the costs referred to in paragraph 2 (a).

(9) The allowance payable under sub-regulation (8) shall not, in the case of a member who proceeds on furlough or leave of absence for long service, be paid for a period exceeding one month.

(10) The allowance referred to in sub-regulation (8) is not payable to a member unless the member produces receipts evidencing payment for the reservation of his lodgings.

(11) Living out allowance or the allowance under sub-regulation (8) is not payable to a member who is the wife or the de facto wife of a member or of a person who is not a member unless she is, by reason of the exigencies of the service, required to live, otherwise than in service accommodation, elsewhere than in the locality in which she and the member or person normally reside.

(12) The allowance under sub-regulation (8) is not payable to a member who proceeds on leave while posted for service aboard a sea-going ship under re-fit.

Separation allowance.

12. (1) Subject to this regulation, a category M member or a category MS member—

(a) who is required to live away from his home by reason of the exigencies of the service; or

(b) lives away from home and is a member to whom sub-regulation (5) applies,

for a continuous period exceeding fourteen days shall be paid an allowance, called “ separation allowance ”, at the rate of $1.00 per day for each day after the expiration of the period of fourteen days of that continuous period.

(2) The allowance payable under this regulation shall continue to be payable notwithstanding that the member lives at his home or at the place where his home is situated on a public holiday, on any day on which the member is granted stand-down leave or short leave or on any other day included in a period that does not exceed 48 hours.

(3) An allowance is not payable under this regulation in respect of any period during which a member is entitled to be paid any travelling allowance or special oversea living allowance in accordance with the Service Financial Regulations,

 

and any period in respect of which the member is entitled to be paid either of those allowances shall be disregarded for the purpose of determining whether or not the member has lived away from his home for a continuous period.

(4) An allowance is not payable under this regulation to a member who is entitled to payment of submarine allowance at the rate specified in paragraph 15 (2) (b) or to sea-going allowance.

(5) A member is a member to whom, this sub-regulation applies if—

(a) the member is not entitled to have his family removed at the expense of the Commonwealth to the place at which he is required to live; or

(b) the member is entitled to have his family removed at the expense of the Commonwealth to the place at which, he is required to live, but the member has not removed his family to that place by reason that—

(i) he has been, unable to obtain suitable accommodation for his family at the place at which he is required to live;

(ii) he is unable to remove his family to that place by reason of illness or infirmity of a dependant;

(iii) a removal of his family to that place would result in interference to the continuity of the secondary or tertiary education of a child; or

(iv) it is necessary for the member to continue to maintain his home at his former place of residence in the interests of a child who is serving an apprenticeship or is a handicapped child attending a school for handicapped children or a rehabilitation centre.

Sea-going allowance.

13. (1) In this regulation, “ member ” means a member who is posted to a sea-going ship.

(2) Subject to sub-regulation (4), an allowance, called “ sea-going allowance ”, is payable to a member.

(3) The rate at which sea-going allowance is payable to a member is—

(a) in the case of a category M member or a category MS member— $675.00; and

(b) in any other case—$548.00.

(4) A member is not eligible to be paid sea-going allowance under this regulation in respect of any period during which he is in receipt of submarine allowance under regulation 15.

Uniform maintenance allowance.

14. (1) Subject to sub-regulation (3), an allowance, called “ uniform maintenance allowance ”, is payable to a member.

(2) The rate at which uniform maintenance allowance is payable is—

(a) in the case of an officer—$175.00;

(b) in 6he case of a member holding a rank specified in Part I of Schedule 7, or Part I of Schedule 8, or who is a member referred to in. regulation 9, other than a member referred to in paragraph (e)— $105.00;

(c) in the case of a member of the Naval Forces who holds the rank of Midshipman or is a subordinate officer holding a higher rank, who is required to become, and becomes, a member of a wardroom mess on a permanent basis—$175.00;

(d) in the case of a member holding a rank specified in Part II or Part III of Schedule 7, or Part II or Part III of Schedule 8, other than a member referred to in paragraph (e)—$125.00; and

 

(e) in the case of a member referred to in regulation 9 who, immediately before he became such a member, was a member holding a rank specified in Schedule 7 or Schedule 8—the rate that would have been payable to him if he had not become a member referred to in regulation 9.

(3) Uniform maintenance allowance is not payable to a member who is

(a) a member of the Regular Army Emergency Reserve;

(b) a member of the Citizen Forces:

(c) a Junior Recruit under the age of seventeen years;

(d) a Junior Musician in the Naval Forces, or an Apprentice Musician in the Military Forces, under the age of seventeen years;

(e) an Apprentice in the Naval Forces, not being an Apprentice who has commenced the eighth term of his apprenticeship training; or

(f) any other Apprentice in his first, second or third year of apprentice training other than an apprentice in the third year of his training who has been posted from the apprentice training establishment.

Submarine allowance.

15. (1) In this regulation—

“ prescribed position ” means—

(a) a position on the complement of a submarine; or

(b) a position on the complement of a naval establishment which is a submarine base, being a position the duties of which are required to be performed by a qualified member;

“ qualified member ” means an officer who is a qualified submarine officer or a man who is a qualified submarine man.

(2) An allowance, called “ submarine allowance ”, is payable to a qualified member who is posted to a prescribed position at the rate of—

(a) where the member holds the appointment of Commander, Submarines—$730.00; or

(b) in any other case—

(i) where the member is a category M member or a category MS member—$1,223.00; or

(ii) where the member is a category O member—$1,095.00.

Senior Chaplain’s allowance.

16. An allowance, called “ Senior Chaplain’s allowance ”, is payable at the rate of $223.00 to an officer of the Chaplain’s Branch of the Naval Forces who holds an appointment of Senior Chaplain.

Diving allowance.

17. (1) In this regulation—

“ diver ” means a member who has the qualifications specified by the Service Board as the qualifications required to be held by a diver;

“ clearance diver ” means a diver who also has the additional qualifications specified by the Naval Board as the additional qualifications required to be held by a clearance diver.

(2) Subject to sub-regulation (3), where the daily rate of salary payable to a diver is lower than the daily rate of salary payable to a clearance diver who holds the rank of Able Seaman and is included in the class of member to which pay level five is the appropriate pay level, the diver shall be paid, in respect of each day during which he performs the duties of a diver, an allowance, called “ diving allowance ”, equal to the difference between his daily rate of salary and the daily rate of salary of a member who holds the rank of Able Seaman and is included in that class of members.

 

(3) A member who is entitled under the Service Financial Regulations to flight pay is not entitled to payment of diving allowance under this regulation,

Extra risk allowance.

18. (1) An allowance, called “ extra risk allowance ”, is payable to a member who, as a result of the nature of his employment in the Defence Force, has paid, in respect of a policy or policies of life insurance, a higher premium or higher premiums than he would have been required to pay, in respect of that policy or those policies, if he had not been so employed.

(2) The amount of extra risk allowable is at a rate—

(a) equal to the amount of the difference between the annual premium or premiums paid by the member and the annual premium or premiums that would have been paid if the member had not been so employed; or

(b) of $150.00,

whichever is the less.

Rations and quarters charge.

19. (1) Subject to this regulation, where a member lives in service accommodation or is admitted to hospital, a deduction, called “ rations and quarters charge ”, shall be made from his salary at the rate per day ascertained in accordance with the following table:—

(2) The rates prescribed by sub-regulation (3) apply to and in relation to a member who lives in service accommodation or is admitted to hospital on and after 31st May, 1973, in the case of members who are members of the Air Force and on and after 1st June, 1973, in the case of other members.

(3) The rate per day of rations and quarters charge payable in respect of the prescribed period by a member—

(a) who is a category O member, other than such a member referred to in paragraph (b), is $1.32;

(b) who is a category O member and was paid or entitled to be paid marriage allowance but not separation allowance under the Service Financial Regulations as in force before the commencement of these Regulations—the amount ascertained by deducting from $1.32 an amount equal to the amount by which the rate of marriage allowance per day that was paid or payable to the member exceeds 63 cents per day; or

(c) who is a member referred to in paragraph 10 (2) (a) or 10 (2) (b).

(4) The rations and quarters charge shall not be deducted from the salary of a member, who is a category O member, lives in service accommodation in the prescribed period and was paid or entitled to be paid both marriage allowance and separation allowance under the Service Financial Regulations as in force before the commencement of these Regulations.

 

(5) Subject to sub-regulation (6), a rations and quarters charge shall not be deducted from the salary of a member in respect of any day or period in respect of which the member—

(a) being a category M member or a category MS member, is required to live in in service accommodation by the exigencies of the service or is in hospital;

(b) is required to live aboard a sea-going ship;

(c) is entitled to hard lying allowance for that day or in respect of that period;

(d) is required to serve in the field;

(e) is a member of a survey party, construction party or a force on exercises who is required to camp out overnight away from the barracks or other place at which he is normally quartered and is absent from the barracks or place for one meal;

(f) is confined in a sick bay on a sea-going ship or in a field type hospital unit; or

(g) is under detention or close arrest.

(6) The rations and quarters charge shall continue to be deducted from the salary of a member who lives in in service accommodation in respect of any absence by him from that accommodation where he proceeds on leave of absence and the period of the leave of absence is 72 hours or less.

(7) When calculating the liability of a member for the rations and quarters charge in respect of a period of longer than one day—

(a) the first day of that period shall be taken into account; and

(b) the last day of that period shall not be taken into account.

Hard lying allowance.

20. (1) In this regulation—

“ harbour vessel ” means a ship that is not liable, in the ordinary course of duty with the Defence Force, to be ordered to sea;

“ prescribed voyage ” means a sea voyage of not less than twenty-four hours’ duration or a voyage of less than twenty-four hours’ duration where the members on board are required to remain on board overnight while the ship is at sea.

(2) Subject to sub-regulations (4) and (5), an allowance, called “ hard lying allowance ” is payable to a member who, in the course of his service with the Defence Force, is required to undertake a prescribed voyage in a harbour vessel or in a sea-going ship in respect of the duration of that voyage.

(3) The rate at which hard lying allowance is payable to a member is $1.00 per day.

(4) A member who is in receipt of—

(a) sea-going allowance payable in accordance with regulation 13; or

(b) submarine allowance payable in accordance with regulation 15,

is not eligible to be paid hard lying allowance under this regulation.

(5) Hard lying allowance is not payable to an officer in respect of a voyage in a vessel other than a harbour vessel unless—

(a) the living conditions on board the ship are inferior to a marked extent to the living conditions on a destroyer on normal naval service; or

(b) the accommodation provided for the officer is not superior to that provided for a man performing the duties of the position on the complement for which the most senior member (other than an officer) is provided, not being a position in respect of coxswain duties.

Salary to be payable fortnightly.

21. (1) The salary and annual allowances (other than extra risk allowance) payable to a member under this Part accrue due from day to day and are payable fortnightly.

 

(2) Extra risk allowance is payable annually in respect of each premium year for which the extra premium has been paid.

Calculation of fortnightly or daily amounts.

22. (1) Subject to sub-regulation (3), the amount of salary payable to a member in respect of a fortnight and the amount of an allowance at an annual rate payable to a member in respect of a fortnight, shall be calculated in accordance with the formula—

where A is that rate of salary, or the rate of the allowance, as the case requires.

(2) Subject to sub-regulation (3), the amount of salary payable to a members and the amount of an allowance payable to a member, in respect of a period of less than a fortnight, shall be calculated in accordance with the formula—

where F is the amount of salary or allowance payable to a member in respect of a fortnight ascertained in accordance with the formula specified in sub-regulation (1), and X is the number of days in the period.

(3) Where an amount ascertained in accordance with sub-regulation (1) or includes a fraction of a cent, the amount shall, if the fraction is one-half or greater, be deemed to be increased by one cent and, if the fraction is less than one-half, the fraction shall be disregarded.

Part III—Modifications of the Naval Financial Regulations in their Application to Members to whom Part II Applies

Restricted application of Naval Financial Regulations to members of the Permanent Naval Forces and members of the Citizen Naval Forces, &c., rendering continuous naval service.

23. (1) The provisions of the Naval Financial Regulations as in force immediately before the prescribed day specified in Schedule 10 shall cease to apply to and in relation to—

(a) members of the Permanent Naval Forces; and

(b) members of the Citizen Naval Forces, and of the Naval Emergency Reserve Forces, rendering continuous full-time, service.

(2) Subject to sub-regulation (1), the provisions of the Naval Financial Regulations as in force immediately before the prescribed day continue to apply to and in relation to the members of the Naval Forces referred to in sub-regulation (1) but, in their continued application to and in relation to those members, the provisions of the Naval Financial Regulations specified in Schedule

are modified as set out in that Schedule.

(3) Notwithstanding sub-regulations (1) and (2), the Naval Financial Regulations as in force immediately before the prescribed day continue to apply to and in relation to members of the Naval Forces, other than members referred to in sub-regulation (1), in the same manner and to the same extent as they applied immediately before that day.

Interpretation for the purposes of the restricted application of the Naval Financial Regulations.

24. (1) This regulation applies notwithstanding anything contained in regulation 4 or in any other provision of the Naval Financial Regulations.

(2) In the Naval Financial Regulations in their application to and in relation to members of the Naval Forces referred to in sub-regulation 23 (1)—

(a) “ married member ” means a member who is a “ category M member ” or “ category MS member ” within the meaning of regulation 4 of these Regulations;

 

(b) “ child ” has the same meaning as in regulation 4 of these Regulations;

(c) “ dependant ” has the same meaning as in regulation 4 of these Regulations;

(d) “ member ” means a member referred to in sub-regulation 23 (1) of these Regulations;

(e) a reference to a member other than a married member or to an unmarried member has the same meaning as the expression “ category O member ” has in regulation 4 of these Regulations;

(f) a reference to active pay or to pay shall be read as a reference to salary payable in accordance with Part II of these Regulations;

(g) a reference to the daily rate of active pay or pay of a member shall be read as a reference to the rate of salary of the member payable in accordance with Part II of these Regulations;

(h) a reference to a home shall be read as a reference to a home within the meaning of sub-regulation 4 (2) of these Regulations;

(i) “ de facto wife ” has the same meaning as in regulation 4 of these Regulations;

(j) a reference to a wife shall be read as including a reference to a de facto wife;

(k) “ category M member ”, “ category MS member ” and “ category O member ” have the same respective meanings as in regulation 4 of these Regulations.

Interpretation for the purposes of the continued application of regulations 31a, 32, 32a and 264 of the Naval Financial Regulations.

25. In the application of regulations 31a, 32, 32a and 264 of the Naval Financial Regulations to and in relation to the members of the Naval Forces referred to in sub-regulation 23 (1)—

(a) a reference to the table in sub-regulation 31a (2) (however expressed) of the Naval Financial Regulations shall be read as a reference to Part II and Part III of Schedule 7 to these Regulations;

(b) a reference to a rate specified in paragraph (a) (in the second column) of an item in the prescribed table shall be read as a reference to the lowest rate of annual salary specified in Part II or Part III of Schedule 7 in relation to a member who holds the same rank as that referred to in that item as that item operated immediately before the prescribed day; and

(c) a reference to the rate specified in another paragraph (in the second column) of an item in the prescribed table shall be read as a reference to whichever of the rates specified in column 4 of Part II or Part III of Schedule 7 to these Regulations in relation to a member who holds the same rank as that referred to in that item and has, or is deemed to have, the period of service in that rank specified in the following table opposite to the paragraph in that item applicable to the member:—

Part IV—Modifications of the Military Financial Regulations in their Application to Members to whom Part II Applies

Restricted application of Military Financial Regulations to members of the Permanent Military Forces and members of the Citizen Military Forces rendering continuous military service.

27. (1) The provisions of the Military Financial Regulations as in force immediately before the prescribed day specified in Schedule 12 shall cease to apply to and in relation to—

(a) members of the Permanent Military Forces; and

(b) members of the Citizen Military Forces rendering continuous full-time service.

(2) Subject to sub-regulation (1), the provisions of the Military Financial Regulations as in force immediately before the prescribed day continue to apply to and in relation to the members of the Military Forces referred to in sub-regulation (1) but in their continued application to and in relation to those members the provisions of the Military Financial Regulations specified in Schedule 13 are modified as set out in that Schedule.

(3) Notwithstanding sub-regulations (1) and (2), the Military Financial Regulations as in force immediately before the prescribed day continue to apply to and in relation to members of the Military Forces, other than members referred to in sub-regulation (1), in the same manner and to the same extent as they applied immediately before that day.

28. (1) This regulation applies notwithstanding anything contained in regulation 5 or in any other provision of the Military Financial Regulations.

29. In the application of regulations 12ba and 12bc of the Military Financial Regulations to and in relation to members of the Military Forces referred to in sub-regulation 27 (1) —

(a) a reference to the table in sub-regulation 12ba (3) (however expressed) of the Military Financial Regulations shall be read as a reference to Part II or Part III of Schedule 7, or to Part II or Part of Schedule 8, as the case requires, to these Regulations;

(b) a reference to the rate specified in paragraph (a) (in the second or third column) of an item in the prescribed table shall be read as a reference to the lowest rate of annual salary payable to a member who holds a rank specified in Part II or Part III of whichever of those Schedules is applicable in relation to a member who holds the same rank as that referred to in that item as that item operated immediately before the prescribed day; and

30. (1) The provisions of the Air Force Regulations as in force immediately before the prescribed day specified in Schedule 14 shall cease to apply to and in relation to—

(a) members of the Permanent Air Force; and

(b) members of the Citizen Air Force and the Air Force Emergency Force rendering continuous full-time Air Force service.

(2) Subject to sub-regulation (1) the provisions of the Air Force Regulations as in force before the prescribed day continue to apply to and in relation to the members of the Air Force referred to in sub-regulation (1) but in their continued application to and in relation to those members the provisions of the Air Force Regulations specified in Schedule 15 are modified as set out in that Schedule.

(3) Notwithstanding sub-regulations (1) and (2), the Air Force Regulations as in force on the day immediately before the prescribed day continue to apply to and in relation to members of the Air Force, other than members referred to in sub-regulation (1), in the same manner and to the same extent as they applied immediately before that day,

31. (1) This regulation applies notwithstanding anything contained in regulation 4 or in any other provision of the Air Force Regulations.

(2) In these Regulations in their application, to and in relation to members of the Air Force referred to in sub-regulation 30 (1)—

(a) “ married member ” means a member who is a “ category M member ” or “ category MS member ” within the meaning of regulation 4 of these Regulations;

(b) “ child ” has the same meaning as in regulation 4 of these Regulations;

(c) a reference to a member other than a married member or to an unmarried member has the same meaning as the expression “ category O member ” has in regulation 4 of these Regulations;

(d) “ category M member ”, “ category MS member ” and “ category O member ” have the same respective meanings as in regulation 4 of these Regulations;

(e) a reference to active pay or to pay shall be read as a reference to salary payable in accordance with Part II of these Regulations;

(f) a reference to the daily rate of active pay or of pay of a member shall be read as a reference to the rate of salary of the member payable in accordance with Part II of these Regulations;

Ranks of airmen.

32. Regulation 101 of the Air Force Regulations is amended by omitting sub-regulation (5) and substituting the following sub-regulations:—

“ (1) The ranks held by airmen shall be as follows:—

(a) Warrant Officer;

(b) Flight Sergeant;

(c) Sergeant;

(d) Corporal;

(e) Leading Aircraftman;

(f) Aircraftman;

(g) Air Cadet;

(h) Cadet Aircrew;

(i) Aircraftman (Recruit);

(j) Airman Apprentice.

“ (1a) For the purposes of these Regulations, airmen holding the ranks specified in paragraphs (b), (c) and (d) of sub-regulation. (1) are non-commissioned officers, airmen holding the ranks specified in paragraphs (e) and (f) of sub-regulation (1) are aircraftmen (men in ranks) and members holding the ranks specified in paragraphs (g), (h), (i) and (j) of sub-regulation (1) are members under training.”.

Interpretation of regulations 549a and 549b of the Air Force Regulations.

33. In the application of regulations 549a and 549b of the Air Force Regulations to and in relation to members of the Air Force referred to in sub-regulation 31 (1)—

(a) a reference to the table in sub-regulation 549a (1) (however expressed) of the Air Force Regulations shall be read as a reference to Part II or Part III of Schedule 7, or to Part II or Part III of Schedule 8, as the case requires, to these Regulations;

(b) a reference to the rate specified in paragraph (a) (in the second or third column) of an item in the prescribed table shall be read as a reference to the lowest rate of annual salary payable to a member who holds a rank specified in Part II or Part III of whichever of those Schedules is applicable in relation to a member who holds the same rank as that referred to in that item as that item operated immediately before the prescribed day; and

(c) a reference to the rate specified in a paragraph (in the second or third column) of an item in the prescribed table shall be read as a reference to whichever of the rates specified in column 4 of Part II or Part III of whichever of those Schedules is applicable in relation to a member who holds the same rank as that referred to in that item and has, or is deemed to have, the period of service in that

Part VI—Non-Reduction and other Special Provisions

Non reduction and other special provisions.

34. (1) Notwithstanding regulation 2 o£ these Regulations, where, in. the prescribed period, the amount of the active pay and allowances to which a member would have been, entitled under the Service Financial Regulations if those Regulations as in force before the amendments effected by these Regulations had continued to apply to and in relation to the member is less than the salary and allowances to which the member has become entitled in the prescribed period under these Regulations and the allowances under the Service Financial Regulations in their continued application to the member, the member shall be entitled, by force of this regulation, to payment of an amount equal to the amount of the excess.

(2) For the purposes of the payment, in respect of the prescribed period, of salary and allowances to a member under these Regulations and the Service Financial Regulations in their continued application to and in relation to a member, the amount of the active pay and allowances to which the member was entitled under the Service Financial Regulations as in force before the amendments effected by these Regulations in the prescribed period shall, subject to this regulation, other than sub-regulations (3) and (4), be set-off against the amount of salary and allowances payable to the member under these Regulations and the Service Financial Regulations in their continued application to and in relation to the member.

(3) Where the sum of the rate of active pay payable to a member undergoing training in a capacity referred to in Schedule 9 on the day immediately before the prescribed day and of the amount of any of the following allowances payable on the day immediately before the prescribed day to the member, namely, marriage allowance, separation allowance and provision allowance, is more than the daily rate of salary payable under regulation 9 to a member undergoing training in that capacity, the member shall be paid a daily allowance equal to the amount of the excess but if, at any time, the daily rate of the salary payable under regulation 9 to the member is increased, the allowance referred to in this regulation shall be reduced by an amount equal to the amount of the increase or, if the amount of the increase exceeds the difference, the allowance referred to in this sub-regulation ceases to be payable.

(4) In the application of the last preceding sub-regulation to and in relation to a member who is required, on and after 31st May, 1973, in the case of a member of the Air Force and on. and after 1st June, 1973, in the case of any other member, to pay the rations and quarters charge at the rates specified in sub-regulation 19 (1), the daily rate of pay of the member on the commencement of the prescribed period shall be deemed to be increased by 38 cents per day.

(5) Where a member was entitled under the Service Financial Regulations as in force before the amendments effected by these Regulations to be paid, in respect of any day in the prescribed period, hard lying money or submarine pay.

 

or both, and the member is not entitled under Part II of these Regulations, to payment of hard lying allowance, sea-going allowance or submarine allowance in respect of that day, the amount of hard lying money or submarine pay, or both, for that day to which the member was entitled under the Service Financial Regulations as so in force shall, be disregarded for the purposes of sub-regulation (2) and his entitlement to hard lying money or submarine pay for that day shall be deemed not to have been affected by the reason that these Regulations are deemed to have been in force in the prescribed period.

(6) Where—

(a) a member was entitled under the Service Financial Regulations as in force before the commencement of these Regulations to payment of hard lying money or submarine pay, or both, in respect of any day in the prescribed period;

(b) the member is entitled under Part II of these Regulations to hard lying allowance, sea-going allowance or submarine allowance in respect of that day; and

(c) the amount referred to in paragraph (a) is greater than the amount referred to in paragraph (b),

the following provisions shall apply:—

(d) both of those amounts shall be disregarded for the purposes of sub-regulation (2);

(e) the entitlement of the member referred to in paragraph (a) shall be deemed not to have been affected by the reason that these Regulations are deemed to have been in force in the prescribed period; and

(f) the member shall be deemed not to be entitled to the allowance referred to in paragraph (b).

(7) Where a member was entitled under the Service Financial Regulations as in force before the amendments effected by these Regulations to be paid diving pay or diving allowance in respect of any day in the prescribed period and the member is not entitled under Part II of these Regulations to payment of diving allowance in respect of that day, the amount of the diving pay or diving allowance to which the member was entitled under the Service Financial Regulations as so in force shall be disregarded for the purposes of sub-regulation (2) and his entitlement to diving pay or diving allowance for that day shall be deemed not to have been affected by the reason that these Regulations are deemed to have been in force in the prescribed period.

(8) Where—

(a) a member was entitled under the Service Financial Regulations as in force before the amendments effected by these Regulations to be paid diving pay or diving allowance in respect of any day in the prescribed period;

(b) the member is entitled to payment under Part II of these Regulations of diving allowance in respect of that day; and

(c) the amount referred to in paragraph (a) is greater than the amount referred to in paragraph (b),

the following provisions shall apply:—

(d) both of those amounts shall be disregarded for the purposes of sub-regulation (2);

(e) the entitlement of the member referred to in paragraph (a) shall be deemed not to have been affected by the reason that these Regulations are deemed to have been in force in the prescribed period; and

 

(f) the member shall be deemed not to be entitled to the allowance referred to in paragraph (b).

(9) Where a member claims extra risk allowance in respect of the whole or any part of the prescribed period and the member would, if these Regulations had not been in force in the prescribed period, have been entitled under the Naval Financial Regulations to supplementary flying pay, under the Air Force Regulations to an addition to flying pay, flight pay, flying instructional pay or flight training pay or under the Military Financial Regulations to an increase in the amount of flying allowance or flight pay, the amount of the extra risk allowance to which the member is entitled in the prescribed period shall be reduced—

(a) in the case of a member of the Naval Forces—by an amount of 15 cents for each day in respect of which he was entitled to supplementary flying pay;

(b) in the case of a member of the Air Force—by an amount equal to the addition, to flying pay, flight pay, flying instructional pay or flight training pay to which the member was entitled in the prescribed period; or

(c) in the case of a member of the Military Forces—by an amount equal to the increase in the amount of flying allowance or flight pay to which the member was entitled,

during the whole or the part of the prescribed period to which the claim relates and the entitlement of the member to the amount of 15 cents per day, to the amount of the addition or to the amount of the increase shall be deemed not to have been affected by reason that these Regulations are deemed to have been in operation in the prescribed period.

(10) Where a member was entitled under the Service Financial Regulations as in force before the amendments effected by these Regulations to be paid special responsibility allowance, pilotage allowance or turret kit allowance, the amount of the allowance shall be disregarded for the purposes of sub-regulation (2) and his entitlement to the allowance shall be deemed not to have been affected by the reason that these Regulations are deemed to have been in force in the prescribed period,

(11) Where a member was entitled to survey party allowance at the rate specified in sub-regulation 120 (2), 120 (4) or 120 (5) of the Naval Financial Regulations, as in force before the amendments effected by these Regulations, or in sub-regulation 37 (2) or 37 (4) of the Military Financial Regulations as so in force, the amount of the allowance at that rate shall be disregarded for the purposes of sub-regulation (2) and the member’s entitlement to the allowance at that rate shall be deemed not to have been affected by the reason that these Regulations are deemed to have been in force in the prescribed period.

Determinations and approvals to continue toapply.

35. All determinations and approvals by the Naval Board having force and effect for the purposes of the Naval Financial Regulations as in force before the amendments effected by these Regulations shall have, on and after that date, the same force and effect for the purposes of these Regulations and of the provisions of the Naval Financial Regulations in so far as those provisions continue to apply to and in relation to members of the Naval Forces referred to in sub-regulation 23 (1) of these Regulations as if made for the purposes of these Regulations and those provisions that continue so to apply.

Refund of pay retained.

36.Where, in pursuance of the Naval Financial Regulations, amounts that have been deducted from a member’s pay under regulation 29, 33 or 79 of those Regulations have not been refunded to him, an amount equal to those amounts shall be paid to the member.

 

Determinations and approvals to continue to apply.

37. All determinations and approvals by the Military Board having force and effect for the purposes of the Military Financial Regulations as in force before the amendments effected by these Regulations shall have, on and after that date, the same force and effect for the purposes of these Regulations and of the provisions of the Military Financial Regulations in so far as those provisions continue to apply to and in relation to members of the Military Forces referred to in sub-regulation 27 (1) of these Regulations as if made for the purposes of these Regulations and those provisions that continue so to apply.

Determinations and approvals to continue to apply.

38. All determinations and approvals by the Air Board having force and effect for the purposes of the Air Force Regulations as in force before the amendments effected by these Regulations shall have, on and after that date, the same force and effect for the purposes of these Regulations and of the provisions of the Air Force Regulations in so far as those provisions continue to apply to and in relation to members of the Air Force referred to in sub-regulation 30 (1) of these Regulations as if made for the purposes of these Regulations and of those provisions that continue so to apply.

Refund of retained pay.

39. Where, in pursuance of the Air Force Regulations as in force immediately before the amendments effected by these Regulations, amounts that have been deducted from a member’s pay under regulation 548 or 551 of those Regulations have not been refunded to him, an amount equal to those amounts shall be paid to the member.
