Defence Force (Salaries) Regulations2 (Amendment)

I, THE MINISTER OF STATE FOR ADMINISTRATIVE SERVICES acting for and on behalf of the Minister of State for Defence, hereby make the following Interim Determination under section 12 of the Defence Amendment Act 1979.

Separation Allowance

1. Regulation 12 of the Defence Force (Salaries) Regulations is amended by omitting sub-regulation (4) and substituting the following sub-regulation:

“(4) An allowance is not payable under this regulation to a member during a period in respect of which he is entitled to an allowance under—

(a) Sub-paragraph 10 (a) (i), 10 (b) (i) or 10 (c) (i) of Determination 0118, Special Action Forces Allowance;

(b) paragraph 9 (a) of Determination 0203, Sea-going Allowance; or

(c) sub-paragraph 6 (a) (i) or 6 (b) (i) of Determination 0204, Submarine Service Allowance,

being determinations under section 58b of the Defence Act 1903.”.

Interpretation

2. Regulation 14c of the Defence Force (Salaries) Regulations is amended by inserting in paragraph (e) of the definition of “rate of salary”, “Determination 0118, Special Action Forces Allowance;” after “Married Trainee’s Allowance;”.

Application

3. This Interim Determination shall take effect on the day on which Determination 0118, Special Action Forces Allowance, is made under section 58b of the Defence Act 1903.
