Defence Force (Salaries) Regulations2 (Amendment)

I, THE MINISTER OF STATE FOR ADMINISTRATIVE SERVICES acting for and on behalf of the Minister of State for Defence, hereby make the following Interim Determination under section 12 of the Defence Amendment Act 1979.

Annual Rate of Salary during specified period

1. After regulation 9 of the Defence Force (Salaries) Regulations the following regulation is inserted:

“9a. (1) Notwithstanding any provision to the contrary in these Regulations, the rate of salary payable to a prescribed member in respect of service on a day during the period from and including 22 July 1980 to and including 14 January 1981 shall be deemed to have been the rate of salary that would have been applicable to him during that period if the following Schedules had been substituted for Schedules 1, 2, 4, 5, 6, 7 and 9 at the commencement of that period and had remained in force during the whole of that period:

“(3) In sub-regulation (1) and (2), “prescribed member” means a member who—

(a) held a rank specified in Schedule 1; or

(b) was included in a class of members the description of which is specified in the heading to Schedule 2, 4, 5, 6, 7 or 9.”.

Service allowance

2. Regulation 10 of the Defence Force (Salaries) Regulations is amended—

(a) by omitting from sub-regulation (1) “$1,612” and substituting “$1,652”; and

(b) by adding at the end thereof the following sub-regulation:

“(3) Notwithstanding sub-regulation (1), the rate of service allowance payable to a member shall, in respect of service—

(a) on a day during the period from and including 22 July 1980 to and including 14 January 1981, be deemed to have been $1,538; and

(b) on a day during the period from and including 15 January 1981 to and including 6 May 1981, be deemed to have been $1,595.”.

Special allowance senior medical and dental officers

3. Regulation 10a of the Defence Force (Salaries) Regulations is amended—

(a) by omitting from sub-regulation (1) “$4,201” and substituting “$1,613”; and

(b) by omitting sub-regulation (2).

Repeal of Schedules 1, 2, 4, 5, 6, 7 and 9

4. Schedules 1, 2, 4, 5, 6, 7 and 9 of the Defence Force (Salaries) Regulations are repealed and the following Schedules substituted:

5. Schedule 5 of the Defence Force (Salaries) Regulations is amended by omitting from column 4 “$38,119” and “$41,879” and substituting, respectively, “$40,707” and “$43,919”.

Application

6. The Defence Force (Salaries) Regulations as amended by paragraph 2 (a) and clause 4 of this Interim Determination shall be deemed to have come into operation on 7 May 1981.
