Defence Force (Salaries) Regulations (Amendment) (Cth)
I, THE
MINISTER OF STATE FOR ADMINISTRATIVE SERVICES acting for and on behalf of the
Minister of State for Defence, hereby make the following Interim Determination
under section 12 of the
Dated 23 February 1982.

Minister of State for Administrative Services for and on behalf of the Minister of State for Defence
(a) by omitting from sub-regulation (5) “9 (3)” (wherever occurring) and substituting “regulation 9a”; and
(b) by inserting in sub-regulation (5) “(if any)” after “service allowance” (wherever occurring).
(a) by omitting sub-regulation (1) and substituting the following sub-regulation:
“(1) Subject to sub-regulations (1a) and (2), the rate of salary payable to a member who is included in the class of members the description of which is specified in the heading to Schedule 7 is—
(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman—the rate specified in that Schedule in relation to that rank and the pay level appropriate, under the Service Financial Regulations, to the member; and
(b) in any other case—the rate specified in that Schedule in relation to—
(i) the rank held by the member;
(ii) the pay level appropriate, under the Service Financial Regulations, to the member; and
(iii) the number of years that is equal to the number of years of service that the member has completed in that rank.”; and
(b) by omitting sub-regulations (2), (3), (4), (5), (6), (7), (7a), (8), (9), (10), (11), (12), (13) and (14) and substituting the following sub-regulations:
“(2) In this regulation, a reference to service that a member has completed in a rank shall, in relation to a member other than a member referred to in sub-regulation (3), be a reference to the service actually completed by the member in that rank.
“(3) Where the Minister, in the period ending immediately before the day on which the making of this sub-regulation was notified in the
Gazette, made an approval under the relevant provision in respect of a member who has been downgraded, reverted or reduced to a lower rank being a rank specified in Part II or Part III of Schedule 7, the number of years of service that the member has completed in that rank shall, for the purposes of sub-paragraph (1) (b) (iii), be—(a) in the case of a member who has been downgraded, reverted or reduced for reasons of inefficiency–the number of years that the member has actually completed in that rank including any previous service rendered by the member in that rank; and
(b) in the case of a member who has been downgraded, reverted or reduced for reasons other than inefficiency–the number of years equal, to the sum of the member’s actual service in that rank including any previous service rendered by the member in that rank and the service actually rendered by the member in the rank from which he has been downgraded, reduced or reverted.
“(4) In sub-regulation (3), ‘relevant provision’ means—
(a) in the case of a member of the Navy–paragraph 3a (4) (b) of the Naval Financial Regulations;
(b) in the case of a member of the Army—paragraph 12ba (5) (b) of the Military Financial Regulations; and
(e) in the case of a member of the Air Force—paragraph 549a (4) (b) of the Air Force Regulations.”.
“8a. (1) Notwithstanding any other provision in these Regulations or any provision in the Service Financial Regulations, the rate of salary payable in respect of service on a day during the prescribed period to a member who on that day is included in an employment category, employment classification, mustering or grade thereof specified in the following table shall be—
(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman—$14,800;
(b) in the case of a member who holds the rank of Able Seaman, Lance Corporal or Leading Aircraftman—$15,100; and
(c) in the case of a member who holds the rank of Leading Seaman or Corporal and has completed—
(i) less than 1 year’s service in that rank—$ 15,700; and
(ii) not less than 1 year’s service in that rank—$ 16,200.

(ii) not less than 1 year’s service in that rank—$15,700.

“(3) Notwithstanding any other provision in these Regulations or any provision in the Service Financial Regulations, the rate of salary payable in respect of service on a day during the prescribed period to a member who on that day is included in an employment category, employment classification, mustering or grade thereof specified in the following table shall be—
(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman—$13,500;
(b) in the case of a member who holds the rank of Able Seaman, Lance Corporal or Leading Aircraftman—$13,800; and
(c) in the case of a member who holds the rank of Leading Seaman or Corporal and has completed—
(i) less than 1 year’s service in that rank—$ 14,400; and
(ii) not less than 1 year’s service in that rank—$14,900.

“(4) Notwithstanding any other provision in these Regulations or any provision in the Service Financial Regulations, the rate of salary payable in respect of service on a day during the prescribed period to a member who on that day is included in an employment category, employment classification, mustering or grade thereof specified in the following table shall be—
(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman—$12,800;
(b) in the case of a member who holds the rank of Able Seaman, Lance Corporal or Leading Aircraftman and has completed—
(i) less than 1 year’s service in that rank—$ 13,100; and
(ii) not less than 1 year’s service in that rank—$ 13,400; and
(c) in the case of a member who holds the rank of Leading Seaman or Corporal and has completed—
(i) less than 1 year’s service in that rank—$14,000; and
(ii) not less than 1 year’s service in that rank—$ 14,400.

“8b. Notwithstanding any other provision in these Regulations, the rate of salary payable to a member in respect of service on a day during the prescribed period shall, for the purposes of these Regulations, be the amount which would otherwise be payable to him, but for this regulation, less the sum of any amounts to which he is entitled under—
(a) in the case of a member who holds the rank of Commander or a higher rank, the rank of Lieutenant Colonel or a higher rank or the rank of Wing Commander or a higher rank—regulation 10 of the Defence Force (Salaries) Regulations;
(b) regulation 10a of the Defence Force (Salaries) Regulations;
(c) regulation 18 of the Naval Financial Regulations; or
(d) regulation 38 of the Naval Financial Regulations, regulation 13 of the Military Financial Regulations or regulation 552 of the Air Force Regulations,
in respect of service on that day.
“8c. In regulations 8a and 8b,
‘prescribed period’ means the period from and including 5 November 1981 to and
including the day immediately before the day on which the making of those
regulations was notified in the
(a) by omitting from sub-regulation (1) “sub-regulations (2) and (3)” and substituting “sub-regulation (2) and regulation 9a”; and
(b) by omitting sub-regulation (3).
“9a. (1) In this regulation—
‘notional salary’, in relation to a trainee, means the salary that would have been payable to the trainee from time to time but for sub-regulation 9 (1);
‘trainee’ means a member undergoing training in a capacity specified in Item 9 or 10 of Schedule 9.
“(2) Where the rate of salary payable from time to time to a trainee in accordance with sub-regulation 9 (1) is less than the rate of his notional salary he shall be paid salary at that higher rate.
“(3) Where a trainee, immediately before he became a trainee, was paid service allowance, the reference in sub-regulation (2) to the rate of his notional salary includes a reference to the rate from time to time of service allowance that would be payable to him had he not become such a trainee.”.
(a) by omitting sub-regulation (1) and substituting the following sub-regulation:
“(1) Subject to sub-regulation (2), an allowance called ‘service allowance’ is payable to a member in respect of his service at the rate of—
(a) in the case of a member referred to in Schedule 9—$ 1,652; and
(b) in any other case—$2,500.”;
(b) by omitting paragraphs (2) (a) and (2) (b) and substituting the following paragraph:
“(a) holds the rank of Commander or a higher rank, the rank of Lieutenant Colonel or a higher rank or the rank of Wing Commander or a higher rank;”; and
(c) by omitting sub-regulation (3).
