Defence Force (Salaries) Regulations (Amendment) (Cth)
I, THE
MINISTER OF STATE FOR AVIATION acting for and on behalf of the Minister of
State for Defence, hereby make the following Interim Determination under
section 12 of the
Dated 10 April 1984.

(a) by inserting in sub-regulation (1) “and regulations 8b and 8c” after “(1a) and (2)”;
(b) by inserting in sub-regulation (1d) “or regulation 8c” after “sub-regulation 8 (1)” first occurring;
(c) by inserting in sub-regulation (1d) “or regulation 8c, as the case may be,” after “sub-regulation 8 (1)” second occurring;
(d) by inserting in sub-regulation (2) “or regulation 8b” after “or (5)”; and
(e) by inserting in sub-regulation (5) “, other than a member to whom regulation 8b applies,” after “Schedule 7”.
8a. This regulation applies to a member who—
(a) is included in the class of members the description of which is specified in the heading to Schedule 7 or is a member undergoing training in a capacity specified in item 2 to Schedule 9;
(b) was a member of the Navy to whom the Minister for Defence, in a letter dated 9 August 1983, gave certain undertakings as a consequence of the joint recommendation by the Secretary, Department of Defence and the Chief of Defence Force Staff to phase out Naval fixed wing flying which was presented to the Minister for Defence on 21 April 1983; and
(c) ceased, during the period from and including 25 July 1983 to and including 1 January 1986, to be a member of the Fleet Air Arm of the Navy as a result of the phase out of Naval fixed wing flying.
“8b. (1) A member to whom regulation 8a applies who—
(a) is a member of the Air Force;
(b) holds the rank of Flight Sergeant; and
(c) was, immediately before he ceased to be a member of the Fleet Air Arm of the Navy, a member holding the rank of Chief Petty Officer,
shall, for the purposes of sub-regulation 8 (1), be deemed to be a member who holds the rank of Chief Petty Officer and a reference to the number of years of service that the member has completed or is deemed to have completed is a reference to a period of service equal to the sum of—
(d) the period of service that the member had completed or was deemed to have completed as a Chief Petty Officer in the Navy; and
(e) the period of service rendered by the member while he continues to fulfil the conditions specified in paragraphs (a) and (b).
(2) A member of the Army or the Air Force to whom regulation 8a applies, other than a member to whom sub-regulation (1) also applies, shall, on enlistment with a rank in the Army or the Air Force be deemed, for the purposes of sub-regulation 8 (1), to have completed the period of service in that rank that is equal to the period of service which he had completed, or was deemed to have completed, in the rank in the Navy which corresponds to that first-mentioned rank.
(3) For the purposes of sub-regulation (2), a rank specified in column 2 of the following table opposite to an item in column 1 of that table is a rank which corresponds to a rank specified in column 3 or 4 of that table opposite to that item:

“8c. (1) Where the rate of salary that would, but for this sub-regulation, be payable under sub-regulation 8 (1) to a member to whom regulation 8a applies is less than the rate of his notional salary, the rate of salary payable to him shall be that higher rate.
(2) For the purposes of sub-regulation (1), “notional salary”, in relation to a member, means the rate of salary specified in regulation 8d or in Schedule 8, as the case may be, in relation to—
(a) the rank held by the member immediately before he ceased to be a member serving in the Fleet Air Arm of the Navy;
(b) the pay level that was appropriate under the Service Financial Regulations to the member immediately before he ceased to be a member serving in the Fleet Air Arm of the Navy; and
(c) the number of years that is equal to the number of years that the member had completed, or was deemed to have completed, in that rank immediately before he ceased to be a member serving in the Fleet Air Arm of the Navy.
“8d. The rate of notional salary, in relation to a member, in respect of service on a day during the period from and including 25 July 1983 to and including 5 October 1983 is the rate specified in the following table in accordance with the provisions of paragraphs (a), (b) and (c) of sub-regulation 8c (2):
