Defence Force (Salaries) Regulations (Amendment) (Cth)
I, THE
MINISTER OF STATE FOR AVIATION acting for and on behalf of the Minister of
State for Defence, hereby make the following Interim Determination under
section 12 of the

“4a. (1) Where a member was, before he became a member to whom these Regulations apply, a member to whom the relevant legislation applied, the period of service of the member in a rank shall, for the purposes of these Regulations, be taken to include a period equal to one-half of the total of any period in an arm of the Defence Force, other than a period referred to in clause 34 of the relevant legislation, that was counted, or deemed to be counted, for the purposes of the relevant legislation in accordance with clauses 27 to 41, inclusive, of the relevant legislation as service for pay by the member, whilst he was a member to whom the relevant legislation applied, in that rank, or in a rank that is opposite that rank, in column 1, 2 or 3 of Schedule 1, 2, 3 or 4 of the relevant legislation, or in a higher rank.
“(2) In sub-regulation (1)—
(a) ‘relevant legislation’ means—
(i) the Defence Force (Reserves) (Financial) Regulations as in force from time to time prior to the day on which
Determination 0199, Pay of Reserve Force Members, is made under section 58b of the
Defence Act 1903; or(ii) Determination 0199, Pay of Reserve Force Members, made under section 58b of the
Defence Act 1903: (b) ‘clause 34’ and ‘clauses 27 to 41’ of the ‘relevant legislation’ means—
(i) sub-regulation 12 (7) and regulation 12 respectively of the Defence Force (Reserves) (Financial) Regulations as in force from time to time prior to the day on which Determination 0199, Pay of Reserve Force Members, is made under section 58b of the
Defence Act 1903; or(ii) clause 34 and clauses 27 to 41 of Determination 0199, Pay of Reserve Force Members, made under section 58b of the
Defence Act 1903: and(c) ‘Schedule 1, 2, 3 or 4’ of the ‘relevant legislation’ means—
(i) Schedule 1, 3, 4 or 5 respectively of the Defence Force (Reserves) (Financial) Regulations, as in force from time to time prior to the day on which Determination 0199, Pay of Reserve Force Members, is made under section 58b of the
Defence Act 1903; or(ii) Schedule 1, 2, 3 or 4 of Determination 0199, Pay of Reserve Force Members, made under section 58b of the
Defence Act 1903. ”.
