REGULATIONS UNDER THE DEFENCE ACT 1903-1970, THE NAVAL DEFENCE ACT 1910-1971 AND THE AIR FORCE ACT 1923-1965.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Act 1903-1970, the Naval Defence Act 1910-1971 and the Air Force Act 1923-1965.

Amendments of the Defence Force (Salaries) Regulations

Interpretation.

1. Regulation 4 of the Defence Force (Salaries) Regulations is amended by inserting in sub-regulation (1), after the definition of “ member ”, the following definition:—

“ ‘ officer ’ does not include a member of the Naval Forces who holds the rank of Warrant Officer, Chief Petty Officer or Petty Officer; ”.

Separation allowance.

2. Regulation 12 of the Defence Force (Salaries) Regulations is amended—

(a) by inserting in paragraph (a) of sub-regulation (5), after the word “ entitled ”, the words “, at the time of his posting, ”; and

(b) by inserting in paragraph (b) of sub-regulation (5), after the word “ entitled ”, the words “, at the time of his posting, ”.

Uniform maintenance allowance.

3. Regulation 14 of the Defence Force (Salaries) Regulations is amended by omitting from paragraph (b) of sub-regulation (2) the word “ paragraph ” and substituting the words “ paragraph (c) or ”.

Senior Chaplain’s allowance.

4. Regulation 16 of the Defence Force (Salaries) Regulations is amended by omitting the figures “ $223.00 ” and substituting the figures “ $227.00 ”.

Rations and quarters charge.

5. Regulation 19 of the Defence Force (Salaries) Regulations is amended—

(a) by omitting sub-regulations (2), (3) and (4);

(b) by omitting from sub-regulation (5) the words “ Subject to sub-regulation (6), a ” and substituting the word “ The ”; and

(c) by inserting in paragraph (g) of sub-regulation (5), after the word “ detention ”, the word “, suspension ”.

Interpretation for the purposes of the restricted application of the Air Force Regulations.

6. Regulation 31 of the Defence Force (Salaries) Regulations is amended by omitting from sub-regulation (2) the words “ In these Regulations ” and substituting the words “ In the Air Force Regulations ”.

Schedules 1 to 9(inclusive).

7. Schedules 1 to 9 (inclusive) to the Defence Force (Salaries) Regulations are repealed and the following Schedules substituted:—

Schedule 11.

9. Schedule 11 to the Defence Force (Salaries) Regulations is amended—

(a) by omitting from the item relating to sub-regulation 9 (1b) the word “ after”  (second occurring in the second column) and substituting the words “ on or after ”;

(b) by inserting after the item relating to sub-regulation 9 (1b) the following item:—

“ Sub-regulation 9 (3) .........

 Omit paragraph (a), substitute the following:—

‘ (a) the daily rate of salary that would, but for this sub-regulation, be payable under regulation 7 of, and Schedule 2, 3 or 4 (whichever is applicable to the member) to, the Defence Force (Salaries) Regulations or under regulation 9 of, and item 5, 6, 7, 8, 10 or 11 (whichever is applicable to the member) of Schedule 9 to, those Regulations, as the case may be, to an officer to whom this sub-regulation applies ,’

 Omit paragraph (b)

 Omit from paragraph (d) ‘, 41 or 47 ’ ”;

(c) by inserting after the item relating to sub-regulation 109 (1) the following items:—

“ Sub-regulation 117b (3) ...

Omit ‘ diving pay ’ substitute ‘ diving allowance under the Defence Force (Salaries) Regulations ’.

“ Sub-regulation 117b (4) ...

Omit ‘diving pay payable’ substitute ‘ diving allowance payable under the Defence Force (Salaries) Regulations ’.”;

(d) and by omitting the item relating to sub-regulation 253 (5).

Schedule 14.

10. Schedule 14 to the Defence Force (Salaries) Regulations is amended by inserting after the words:—

“ Sub-regulation 571a (2a) ”,

the words:—

“ Sub-regulation 571h (2) ”.

Schedule 15.

11. Schedule 15 to the Defence Force (Salaries) Regulations is amended—

(a) by omitting the item relating to regulation 542c and substituting the following item:—

“ Regulation 542c ..............

 Omit, substitute the following:—

‘ 542c. Regulations 556f and 556g do not apply to, or in relation to, an officer who—

(a) holds a rank specified in Schedule 1 to the Defence Force (Salaries) Regulations or a higher rank; or

(b) being a medical officer or a dental officer within the meaning of those terms as defined in the Defence Force (Salaries) Regulations holds the rank of Wing Commander or a higher rank ’ ”;

(b) by inserting after the item relating to sub-regulation 571c (2) the following item:—

“ Sub-regulation 571h (1) ...

 Omit, substitute the following:—

‘(1) Regulations 568 and 570, sub-regulations (1), (3), (4), (5) and (6) of regulation 569 and sub-regulations (3) and (4) of regulation 571a apply to and in relation to an officer who is a category MS member and who:—

(a) holds a rank specified in Schedule 1 to the Defence Force (Salaries) Regulations or a higher rank: or

(b) being a medical officer or a dental officer within the meaning of those terms as defined in the Defence Force (Salaries) Regulations, holds a rank of Wing Commander or a higher rank.’.”.

Application.

12. (1) The amendments effected by regulations 4, 7 and 11 apply to and in relation to—

(a) members of the Air Force—as if those amendments had come into operation on 31st May, 1973; and

(b) members of the Naval Forces or of the Military Forces—as if those amendments had come into operation on 1st June, 1973.

(2) The amendments effected by the remaining provisions of these Regulations apply to and in relation to members on and from the date of notification of these Regulations in the Gazette.
