REGULATIONS UNDER THE DEFENCE ACT 1903-1973, THE NAVAL DEFENCE ACT 1910-1973 AND THE AIR FORCE ACT 1923-1973.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Act 1903-1973, the Naval Defence Act 1910-1973 and the Air Force Act 1923-1973.

Amendments of the Defence Force (Salaries) Regulations

Submarine allowance.

1. Regulation 15 of the Defence Force (Salaries) Regulations is amended—

(a) by adding at the end of the definition of “ qualified member ” in sub-regulation (1) the words “ and includes a member who is undergoing that part of the course of initial training for submariners known as ‘ Part III of Initial Submarine Training ’ ”; and

(b) by inserting in sub-regulation (2), after the word “ position ”, the words “ or who is serving on board a submarine of the Royal Navy or at a submarine base operated by the Royal Navy ”.

Senior chaplains allowance.

2. Regulation 16 of the Defence Force (Salaries) Regulations is amended by omitting the figures “ $255.00 ” and substituting the figures “ $268.00 ”.

Diving allowance and ship’s diver’s allowance.

3. (1) Regulation 17 of the Defence Force (Salaries) Regulations is amended—

(a) by inserting in sub-regulation (2), after the word “ diver ” (first occurring), the words “ who is a member of the Military Forces or the Air Force ”;

(b) by omitting, from sub-regulation (2) the word “ Able ” (wherever occurring);

(c) by inserting after sub-regulation (2) the following sub-regulations:—

“ (2a) Subject to sub-regulations (2b) and (3), an allowance called ‘ ship’s diver’s allowance ’ is payable at the rate of $5.50 a day to a diver who is a member of the Naval Forces in respect of each day during which he performs the duties of a diver.

“ (2b) The total amount of ship’s diver’s allowance payable to a member in respect of his performance of the duties of a diver during a month shall not exceed $22.00.”; and

(d) by inserting in sub-regulation (3), after the word “ allowance ”, the words “ or ship’s diver’s allowance ”.

(2) Where a member would have been entitled to receive a greater amount in respect of his performance of the duties of a diver during the period from and including 1 July 1974 to and including the date of commencement of this regulation if the amendments effected by sub-regulation (1) had come into operation on 1 July 1974, the member shall be paid an allowance equal to the difference between the amount which he has been, or is entitled to be, paid in respect of his performance of those duties during that period and the amount to which he would have been entitled if the amendments effected by sub-regulation (1) had come into operation on 1 July 1974.

Schedules 2 to 9 (inclusive).

4. Schedules 2 to 9 (inclusive) to the Defence Force (Salaries) Regulations are repealed and the following Schedules substituted:—

Amendment of Statutory Rules 1973 No. 269.

5. (1) Statutory Rules 1973 No, 269 are amended by omitting sub-regulation (1) of regulation 5.

(2) Sub-regulation (1) shall be deemed to have come into operation on 1 January 1974.

Special allowance—Senior Medical and Dental Officers.

6. (1) An allowance is payable to a medical officer or dental officer who holds, or has at any time on or after the prescribed day held, the rank of—

(a) Commodore in the Naval Forces;

(b) Brigadier in the Military Forces; or

(c) Air Commodore in the Air Force,

in respect of service in that rank at the rate of—

(d) where the member holds or held the rank specified in paragraph (a) or (b)—

(i) in respect of service in that rank during the period from and including 17 May 1974 to and including 30 May 1974—$729.00 a year; and

(ii) in respect of service in that rank after 30 May 1974—$747.00 a year; or

(e) where the member holds or held the rank specified in paragraph (c)—

(i) in respect of service in that rank during, the period from and including. 16 May 1974 to and including 29 May 1974—$729.00 a year; and

(ii) in respect of service in that rank after 29 May 1974—$747.00 a year.

(2) In sub-regulation (1), “ prescribed day ” means—

(a) in relation to a member of the Naval Forces or of the Military Forces—17 May 1974; and

(b) in relation to a member of the Air Force—16 May 1974.

Transitional—Medical and Dental Officers.

7. (1) The rate of salary payable to a medical officer or dental officer who held, during the prescribed period, a rank described in column 1, 2 or 3 of the following table shall be, in respect of any period of service in that rank during that period, the rate specified in column 4 opposite to the description of the rank held by the member:—

(2) In this regulation, the “ prescribed period ” means—

(a) in relation to a member of the Naval Forces or of the Military Forces—the period from and including 17 May 1974 to and including 30 May 1974; and

(b) in relation to a member of the Air Force—the period from and including 16 May 1974 to and including 29 May 1974.

Transitional—other members.

8. (1) The rate of salary payable to a member in respect of any period of service during the prescribed period, being a period of service during which he was included in a class of members to which Schedule 7, 8 or 9 to the Defence Force (Salaries) Regulations is the appropriate Schedule, shall be the rate that would have been payable to the member if the following Schedules had, at the commencement of the prescribed period, been substituted for the first-mentioned Schedules:—

(2) In this regulation, the “ prescribed period ” means—

(a) in relation to a member of the Naval Forces or of the Military Forces—the period from and including 19 April 1974 to and including 30 May 1974; and

(b) in relation to a member of the Air Force—the period from and including 18 April 1974 to and including 29 May 1974.

Application.

9. (1) The amendments of regulation 15 of the Defence Force (Salaries) Regulations effected by regulation 1 of these Regulations apply to and in relation to members of the Defence Force as if those amendments had come into operation on 23 April 1974.

(2) The amendments of regulation 16 of the Defence Force (Salaries) Regulations and of Schedules 2,3, 4 and 6 of those Regulations effected by regulations 2 and 4 of these Regulations apply to and in relation to—

(a) members of the Naval Forces or of the Military Forces—as if those amendments had come into operation on 12 July 1974; and

(b) members of the Air Force—as if those amendments had come into operation on 11 July 1974.

(3) The amendments of Schedules 5, 7, 8 and 9 to the Defence Force (Salaries) Regulations effected by regulation 4 of these Regulations apply to and in relation to—

(a) members of the Naval Forces or of the Military Forces—as if those amendments had come into operation on 31 May 1974; and

(b) members of the Air Force—as if those amendments had come into operation on 30 May 1974.
