Defence Force Retirement and Death Benefits Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Force Retirement and Death Benefits Act 1973.

Commencement

1. These Regulations shall be deemed to have come into operation on 30 August 1982.

Prescribed basic annual rate of pay

2. Regulation 4 of the Defence Force Retirement and Death Benefits Regulations is amended—

(a) by omitting from sub-paragraph (a) (i) “or”;

(b) by omitting from sub-paragraph (a) (ii) “after 7 February 1973” and substituting “during the period commencing on 8 February 1973 and ending on 30 August 1982”;

(c) by adding at the end of paragraph (a) the following sub-paragraph:

“(iii) after 30 August 1982—the rate specified in Schedule 7 to the Defence Force (Salaries) Regulations as the rate of salary at pay level 1 in relation to the rank of Private; or”;

(d) by omitting from sub-paragraph (b) (i) “or”;

(e) by omitting from sub-paragraph (b) (ii) “after 8 February 1973” and substituting “during the period commencing on 9 February 1973 and ending on 30 August 1982”; and

(f) by adding at the end of paragraph (b) the following word and sub-paragraph:

“; or (iii) after 30 August 1982—a rate ascertained in accordance with sub-paragraph (a) (iii).”.
