Benefits Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Force Retirement and Death Benefits Act 1973.

Commencement

1. These Regulations shall come into operation on 31 December 1984.

2. Regulation 3 of the Defence Force Retirement and Death Benefits Regulations is repealed and the following regulation substituted:

Interpretation

“3. In these Regulations, unless the contrary intention appears—

‘Determination 0101’ means Determination 0101, Salary of Permanent Force Members, made under section 58b of the Defence Act 1903;

‘the Act’ means the Defence Force Retirement and Death Benefits Act 1973.”.

Prescribed basic annual rate of pay

3. Regulation 4 of the Defence Force Retirement and Death Benefits Regulations is amended—

(a) by omitting from sub-paragraph (a) (ii) “or” (last occuring);

(b) by omitting from sub-paragraph (a) (iii) “after 30 August 1982” and substituting “during the period commencing on 1 September 1982 and ending on 30 December 1984”;

(c) by adding at the end of paragraph (a) the following sub-paragraph:

“(iv) after 30 December 1984—the rate specified in Schedule 5 to Determination 0101; or”;

(d) by omitting from sub-paragraph (b) (ii) “or”;

(e) by omitting from sub-paragraph (b) (iii) “after 30 August 1982” and substituting “during the period commencing on 1 September 1982 and ending on 30 December 1984”; and

(f) by adding at the end of paragraph (b) the following word and sub-paragraph:

“; or (iv) after 30 December 1984—the rate specified in Schedule 5 to Determination 0101.”.
