REGULATIONS UNDER THE DEFENCE FORCE RETIREMENT AND DEATH BENEFITS ACT 1973-1974.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Force Retirement andDeath Benefits Act 1973-1974.

Amendments of the Defence Force Retirement and Death Benefits

(Annual Rates of Pay) Regulations

Schedule 2.

1. (1) Schedule 2 to the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations is amended by omitting items 1 and 2 and substituting the following items:—

(3) Sub-regulation (1) has effect and shall be deemed to have taken effect in relation to members of the Defence Force, the descriptions applicable to whom are set out in item 1 or 2 of Schedule 2 to the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations as amended by sub-regulation (1), from and including 1 March 1975.

(4) Sub-regulation (2) has effect from and including, and shall be deemed to have taken effect on—

(a) in relation to members of the Naval Forces or the Military Forces the descriptions applicable to whom are set out in item 3, 4 or 5 of Schedule 2 to the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations as amended by sub-regulation (2)—21 March 1975; and

(b) in relation to members of the Air Force, the descriptions applicable to whom are set out in those items—20 March 1975.

Schedule 3.

2. (1) Schedule 3 to the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations is repealed and the following Schedule substituted:—

(2) Sub-regulation (1) has effect from and including, and shall be deemed to have taken effect on—

(a) in relation to members of the Naval Forces or the Military Forces the descriptions applicable to whom, are set out in Schedule 4 to the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations as amended by that sub-regulation—1 November 1974; and

(b) in relation to members of the Air Force the descriptions applicable to whom are set out in that Schedule—31 October 1974.

Special annual rate of pay—Chaplains.

4. (1) For the purposes of the definition of “annual rate of pay” in sub-section 3 (1) of the Defence Force Retirement and Death Benefits Act 1973-1974, the annual pay applicable to a member of the Defence Force referred to in the following table—

(a) in the case of a member of the Naval Forces or the Military Forces—on a day during the period from and including 12 July 1974 to and including 31 October 1974; or

(b) in the case of a member of the Air Force—on a day during the period from and including 11 July 1974 to and including 30 October 1974,

is the rate specified in the fourth column of that table opposite to the description of the member:—

(2) Sub-regulation (1) has effect from and including, and shall be deemed to have taken effect on—

(b) in relation to members of the Air Force the descriptions applicable to whom are set out in that Schedule—11 July 1974.

Special annual rate of pay—members undergoing training.

5. (1) For the purposes of the definition of “ annual rate of pay ” in subsection 3 (1) of the Defence Force Retirement and Death Benefits Act 1973-1974, the annual pay applicable to a member of the Defence Force referred to in the following table—

(a) in the case of a member of the Naval Forces or the Military Forces—on a day during the period from and including 20 September 1974 to and including 31 October 1974; or

(b) in the case of a member of the Air Force—on a day during the period from and including 19 September 1974 to and including 30 October 1974,

is the rate specified In the third column of that table opposite to the description of the member:—
