Defence Force (Reserves) (Financial) Regulations2 (Amendment)

I, THE MINISTER OF STATE FOR ADMINISTRATIVE SERVICES acting for and on behalf of the Minister of State for Defence, hereby make the following Interim Determination under section 12 of the Defence Amendment Act 1979.

Pay of certain officers

1. Regulation 4 of the Defence Force (Reserves) (Financial) Regulations is amended–

(a) by omitting the table in sub-regulation (1) and substituting the following table:

2. Regulation 5aa of the Defence Force (Reserves) (Financial) Regulations is repealed and the following regulations substituted:

Pay of certain members during prescribed period

“5aa. (1) Notwithstanding any other provision in these Regulations or any provision in the Service Financial Regulations, the amount payable in respect of reserve service rendered on a day during the prescribed period to a member who on that day is included in an employment category, employment classification, mustering or grade thereof specified in the following table shall be–

(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman–$34.45;

(b) in the case of a member who holds the rank of Able Seaman, Lance Corporal or Leading Aircraftman–$35.15; and

(c) in the case of a member who holds the rank of Leading Seaman or Corporal and has completed–

(i) less than 1 year’s service in that rank–$36.55; and

(ii) not less than 1 year’s service in that rank–$37.75.

(ii) not less than 1 year’s service in that rank–$36.55.

(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman–$31.45;

(b) in the case of a member who holds the rank of Able Seaman, Lance Corporal or Leading Aircraftman–$32.15; and

(c) in the case of a member who holds the rank of Leading Seaman or Corporal and has completed–

(i) less than 1 year’s service in that rank–$33.55; and

(ii) not less than 1 year’s service in that rank–$34.70.

“(4) Notwithstanding any other provision in these Regulations or any provision in the Service Financial Regulations, the amount payable in respect of reserve service rendered on a day during the prescribed period to a member who on that day is included in an employment category, employment classification, mustering or grade thereof specified in the following table shall be-

(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman–$29.80;

(b) in the case of a member who holds the rank of Able Seaman, Lance Corporal or Leading Aircraftman and has completed–

(i) less than 1 year’s service in that rank–$30.50; and

(ii) not less than 1 year’s service in that rank–$31.20; and

(c) in the case of a member who holds the rank of Leading Seaman or Corporal and has completed–

(i) less than 1 year’s service in that rank–$32.60; and

(ii) not less than 1 year’s service in that rank–$33.55.

“5ab. Notwithstanding any other provision in these Regulations, the amount payable to a member in respect of reserve service rendered by him on a day during the prescribed period is the amount which would otherwise be payable to him, but for this regulation, less any amounts to which he is entitled under regulation 18 of the Naval Financial Regulations, in respect of reserve service on that day.

“5ac. In regulations 5aa and 5ab, ‘prescribed period’ means the period from and including 5 November 1981 to and including the day immediately before the day on which the making of those regulations was notified in the Gazettes.”.

Pay of members other than officers and trainees

3. Regulation 8 of the Defence Force (Reserves) (Financial) Regulations is amended–

(a) by omitting paragraphs (1) (a), (1) (b) and (1) (c) and substituting the following paragraphs:

“(a) in the case of a member who holds the rank of Seaman, Private or Aircraftman–the amount specified in that Schedule in relation to that rank and the pay level appropriate, under the Service Financial Regulations, to the member; and

(b) in any other case–the amount specified in that Schedule in relation to–

(i) the rank held by the member;

(ii) the pay level appropriate, under the Service Financial Regulations, to the member; and

(iii) the number of years that is equal to the number of years of service that the member has completed in that rank.”; and

(b) by omitting sub-regulations (1a), (1b), (1ba), (1c), (1d), (1e) and ( 1f) and substituting the following sub-regulation:

“(1a) In this regulation, a reference to service that a member has completed in a rank shall, in relation to a member other than a member referred to in sub-regulation 12 (5),be a reference to the service actually completed by the member in that rank.”.

Repeal

4. Regulation 11 of the Defence Force (Reserves) (Financial) Regulations is repealed.

Service of a member in a rank

5. Regulation 12 of the Defence Force (Reserves) (Financial) Regulations is amended by omitting sub-regulations (5) and (6) and substituting the following sub-regulations:

“(5) Subject to sub-regulations (11), (12) and (13), where the Minister, in the period ending immediately before the day on which the making of this sub-regulation was notified in the Gazette, made an approval under the relevant provision in respect of a member who has been downgraded, reverted or reduced to a lower rank being a rank specified in Part II or Part III of Schedule 5, the number of years of service that the member has completed in that rank shall, for the purposes of sub-paragraph 8 (1) (b) (iii), be–

(a) in the case of a member who has been downgraded, reverted or reduced for reasons of inefficiency–the number of years that the member has actually completed in that rank including any previous service rendered by the member in that rank; and

(b) in the case of a member who has been downgraded, reverted or reduced for reasons other than inefficiency–the number of years equal to the sum of the member’s actual service in that rank including any previous service rendered by the member in that rank and the service actually rendered by the member in the rank from which he has been downgraded, reduced or reverted.

“(6) In sub-regulation (5), ‘relevant provision’ means–

(a) in the case of a member of the Navy–paragraph 31a (4) (b) of the Naval Financial Regulations;

(b) in the case of a member of the Army–paragraph 12ba (5) (b) of the Military Financial Regulations; and

(c) in the case of a member of the Air Force–paragraph 549a (4) (b) of the Air Force Regulations.”.

Application of certain provisions of Service Financial Regulations

6. Regulation 16 of the Defence Force (Reserves) (Financial) Regulations is amended by omitting from sub-regulation (1) “Part I of” (wherever occurring).

7. Schedules 1, 4 and 5 of the Defence Force (Reserves) (Financial) Regulations are repealed and the following Schedules substituted:

8. Paragraph 1 (a) and clauses 2, 3, 4, 5, 6 and 7 of this Interim Determination shall be deemed to have come into operation on 5 November 1981.
