Defence Force (Reserves) (Financial) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923.

Commencement

1. These Regulations shall come into operation on 30 September 1983.

Interpretation

2. Regulation 2 of the Defence Force (Reserves) (Financial) Regulations is amended—

(a) by omitting from sub-regulation (1) the definition of “member” and substituting the following definition:

“ ‘member’ means a person who is a member of the Reserve Forces or the Emergency Forces, other than a person who is a member within the meaning of the Defence Force (Salaries) Regulations;”; and

(b) by omitting from sub-regulation (3) “regulation 182 of the Naval Forces Regulations” and substituting “sub-section 32a(4) of the Naval Defence Act 1910”.

Pay of certain officers

3. Regulation 4 of the Defence Force (Reserves) (Financial) Regulations is amended—

(a) by omitting “Citizen Military Forces or the Citizen Air Force” and substituting “Australian Army Reserve or the Australian Air Force Reserve”; and

(b) by omitting from Column 1 of the table “Consultant Colonel, CMF,” (wherever occurring) and substituting “Consultant Colonel, Active Australian Army Reserve,”.

Payment of supplementary amount

4. Regulation 5a of the Defence Force (Reserves) (Financial) Regulations is amended—

(a) by omitting from the definition of “member” in sub-regulation (1) “year” (wherever occurring) and substituting “period”; and

(b) by omitting the definition of “training year” in sub-regulation (1) and substituting the following definition:

“ ‘training period’ means the training period applicable to a member, or a class of members to which a member belongs, pursuant to a determination under the Naval Forces Regulations, Australian Military Regulations or Air Force Regulations, as the case may be.”; and

(c) by omitting from sub-regulation (2) “year” (wherever occurring) and substituting “period”.

Pay of members other than officers and trainees

5. Regulation 8 of the Defence Force (Reserves) (Financial) Regulations is amended—

(a) by omitting from paragraph (2) (c) “years of training” and substituting “training periods”; and

(b) by omitting sub-regulation (3).
