Defence Force Regulations2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Defence Act 1903.

1.   Amendment

1.1   The Defence Force Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48.]

2.   Regulation 72A (Delegation of power to make determinations)

2.1   Omit the words before paragraph 72A (a), substitute:

 “(1) For section 58E of the Act, the Minister may by instrument delegate to a person mentioned in subregulation (2) the power under subsection 58B (1) of the Act to make determinations about the following matters:”.

2.2   Paragraph 72A (b):

Omit “Safety”, substitute “Safety,”.

2.3   Add at the end:

 “(2) The following persons may be delegates under subregulation (1):

  • (a)

    the Secretary to the Department;

  • (b)

    a Senior Executive Service officer under the Public Service Act 1922;

  • (c)

    any other officer of the Australian Public Service who, for the time being, holds, or is performing the duties of, an office in the Department for which the minimum rate of salary exceeds the maximum rate of salary for an office in the Department classified under section 28 of the Public Service Act 1922 as Senior Officer, grade C;

  • (d)

    an officer of the Navy who holds the rank of Captain, or a higher rank;

  • (e)

    an officer of the Army who holds the rank of Colonel, or a higher rank;

  • (f)

    an officer of the Air Force who holds the rank of Group Captain, or a higher rank.”.
