Regulations2 (Amendment)

THE administrator of the
Government of the Commonwealth of Australia, acting with the advice of the
Federal Executive Council, hereby make the following Regulations under the Defence Act 1903.

Commencement
1. These Regulations shall
come into operation on 3 July 1985.
Part II—heading
2. The heading to Part II
of the Defence Force Regulations is amended by omitting “AND DISCIPLINE”.
Powers of Navy or Army officers,
&c., when acting with Air Force
3. Regulation 5 of the
Defence Force Regulations is amended by omitting “shall, for the purposes of command and arrest, in relation
to that member or part of the Air Force be treated as, and have all the powers,
other than powers of punishment, he would have,”
and substituting “shall be
entitled to exercise powers of command in relation to that member or part of
the Air Force as”.

4. Regulation 6 of the
Defence Force Regulations is amended by omitting “shall, for the purposes of command and arrest, in relation
to that member or part of the Army be treated as, and have all the powers,
other than powers of punishment, he would have,”
and substituting “shall be
entitled to exercise powers of command in relation to that member or part of
the Army as”.

Defence Force Regulations is amended by omitting “shall, for the purposes of command and arrest, in relation
to that member or part of the Navy be treated as, and have all the powers,
other than powers of punishment, he would have,”
and substituting “shall be
entitled to exercise powers of command in relation to that member or part of
the Navy as”.
Corresponding ranks
6. Regulation 8 of the
Defence Force Regulations is amended by omitting Item 12 from the table in
sub-regulation (1) and substituting the following item:
“12
Midshipman....................... Officer
cadet....................... Officer
cadet”.
Attachment of members
7. Regulation 39 of the
Defence Force Regulations is amended by omitting from sub-regulation (3) “and arrest” (wherever occurring).
Sentences imposed by service
tribunals of other countries
8. Regulation 46 of the
Defence Force Regulations is amended by omitting from sub-regulation (1) “or by virtue of a law of Australia” and substituting “the Defence
Force Discipline Act 1982”.
