REGULATIONS UNDER THE DEFENCE FORCE (PAPUA NEW GUINEA) RETIREMENT BENEFITS ACT 1973.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Force (Papua New Guinea) Retirement Benefits Act 1973.

DEFENCE FORCE (PAPUA NEW GUINEA) RETIREMENT BENEFITS REGULATIONS

Citation.

1. These Regulations may be cited as the Defence Force (Papua New Guinea) Retirement Benefits Regulations.

Commencement.

2. These Regulations shall be deemed to have effect on and from 19 June 1973.

Interpretation.

3. In these Regulations and in the Schedules to these Regulations—

“ recruit ” means a member who—

(a) holds the rank of recruit or ordinary seaman in the Naval Forces; or

(b) is taken to be a recruit for the purposes of regulation 9 of the Military Regulations;

“ the Act ” means the Defence Force (Papua New Guinea) Retirement Benefits Act 1973;

“ the commencing day ” means the day on which these Regulations are notified in the Gazette;

“ the Military Regulations ” means the Military Financial (Pacific Islanders) Regulations;

“ the Naval Regulations ” means the Naval Forces (Papua New Guinea Division) Regulations.

Classes of members.

4. For the purposes of these Regulations the respective members who have the description specified in the heading to a Schedule each constitute a class of members.

Daily rate of pay.

5. (1) This regulation applies for the purposes of the definition of “ daily rate of pay ” in sub-section 3 (1) of the Act.

(2) Subject to sub-regulations (4) and (5), the daily rate of pay applicable to a member in relation to a particular time during the period commencing on 19 June 1973 and ending on the commencing day is a rate equal to the daily rate of pay specified in this regulation or in the Schedules to these Regulations as in force on the commencing day, applicable to that member under this regulation.

(3) The daily rate of pay applicable to a member in relation to a particular time after the commencing day is a rate equal to the daily rate of pay applicable to the member under this regulation or, where the last-mentioned rate has been amended and the amendment is deemed to have taken effect on a day on or before the particular time, a rate equal to that amended rate.

(4) The daily rate of pay applicable to a member who—

(a) is included in a class of members described in the heading to Schedule 1; and

(b) holds a rank specified in the following table,

in relation to a particular time during the period commencing on 19 June 1973 and ending on 5 July 1973 is the rate specified in column 3 of the following table in relation to the rank held by the member opposite the number of years equal to the number of years of service that the member has completed in the rank:—

(5) The daily rate of pay applicable to a member who is a chaplain in relation to a particular time during the period commencing on 19 June 1973 and ending on 5 July 1973 is the rate specified in column 2 of the following table in relation to the classification of the member opposite to the number of years equal to the number of years of service that the member has completed in the classification:—

(6) Subject to the succeeding provisions of this regulation, the daily rate of pay applicable to a member included in a class of members described in the heading to a Schedule is—

(a) if the reference in that Schedule to the rank held by the member is not followed by a reference to under one year or by a reference to a number of years—the rate specified in column 3 of that Schedule opposite to the description of the rank held by the member; or

(b) in any other case—the rate specified in column 3 of the Schedule in relation to the rank held by the member opposite the number of years equal to the number of years of service that the member has completed in the rank.

(7) The daily rate of pay applicable to a member who is a dental officer and holds the rank of Lieutenant is the rate specified in column 2 of the following table in relation to his length of service in that rank specified in column 1 of that table:—

(9) Subject to sub-regulations (10) and (11), the daily rate of pay applicable to a recruit is—

(a) in the case of the recruit who has less than six months service—Two dollars thirty-four cents;

(b) in the case of an unmarried recruit who is not more than nineteen years of age and has not less than six months but less than one year’s service—Two dollars forty-five cents;

(c) in the case of an unmarried recruit who is not more than nineteen years of age and has not less than one year’s but less than two years’ service—Two dollars fifty-nine cents;

(d) in the case of an unmarried recruit who is aged twenty years and has not less than six months but less than two years’ service—Two dollars fifty-nine cents; or

(e) in the case of any other recruit—Two dollars seventy-three cents.

(10) The daily rate of pay applicable to a member who is an apprentice and who is undergoing training in Papua New Guinea is—

(a) where the member is unmarried, has not attained nineteen years of age and has served as an apprentice for less than one year—Two dollars forty-five cents;

(b) where the member is unmarried, has not attained twenty-one years of age and has served as an apprentice for less than two years—Two dollars fifty-nine cents; or

(c) in any other case—Two dollars seventy-three cents.

(11) The daily rate of pay applicable to a member who is an apprentice and is undergoing training in Australia is the rate specified in column 2 of the following table in relation to his length of service as an apprentice specified in column 1 of that table:—

Retiring age.

6. (1) For the purposes of the definition of “ retiring age for rank held ” in sub-section 3 (1) of the Defence Force (Papua New Guinea) Retirement Benefits Act 1973, the age for compulsory retirement of a member who is an officer is the age specified in column 3 of the following table opposite to the rank held by the member specified in column 1 or column 2, whichever is applicable to the member, of that table:—

(2) For the purposes of the definition of “ retiring age for rank held ” in sub-section 3 (1) of the Act, the age for compulsory retirement of a member who is an enlisted member is—

(a) in the case of an enlisted member of the Naval Forces—Fifty years; and

(b) in the case of an enlisted member of the Military Forces—Fifty-five years.

Cheques, manner of signing.

7. For the purposes of section 29 of the Act cheques drawn on a bank account of the Board shall be signed by two officers authorized by the Chairman of the Board to sign cheques drawn on such an account.
