1  Name

This instrument is Defence Determination (Housing and Sydney apartment trial – amendment) 2018 (No. 6).

2  Commencement

This instrument commences 8 February 2018.

3  Authority

This instrument is made under section 58B of the Defence Act 1903

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Housing amendments

Defence Determination 2016/19, Conditions of service

1 Paragraph 7.6.34.2.f (Reasons for rejecting a reasonable offer)

Omit the paragraph, insert:

f.

The member is participating in the Puckapunyal housing trial and the home is unsuitable for either of the following reasons.

i.

For a member’s spouse or partner to undertake specific employment or study.

ii.

For a member’s recognised dependant with special needs to access professional services.

2 Paragraph 7.6.35.1.c (Changing Service residences)

Omit the paragraph, substitute:

c.

The Service residence will no longer be available to the member due to sale or major renovation.

3 Subsection 7.8.5A.1 (Puckapunyal housing trial)

Omit from the note "reapply", substitute "apply".

4 Annex 7.A (Contributions for Service residence or rent band choice accommodation)

Omit from the see note "Division 7", substitute "Division 8".
