1  Name

This instrument is the Defence Determination, Conditions of service (Star rank increment advancement) Amendment Determination 2020 (No. 12).

2  Commencement

This instrument commences on 9 July 2020.

3  Authority

This instrument is made under section 58B of the Defence Act 1903.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Star rank increment advancement amendments

Defence Determination 2016/19, Conditions of service

1	Subsection 3.2.30.1 (Increment advancement)
Omit “A member”, substitute “Subject to section 3.2.31, a member”.
2	Section 3.2.30 (Increment advancement)
After section 3.2.30, insert:

3.2.31    Member not eligible for increment advancement after 6 August 2020

A member who holds a rank of Brigadier or higher is not eligible for increment advancement after 6 August 2020.
3	Subsection 3.2.41.1 (Chaplain and dental officers – increment advancement and promotion)
Omit “A Chaplain”, insert: “Subject to subsection 1A, a chaplain”.
4	Subsection 3.2.41.1 (Chaplain and dental officers – increment advancement and promotion)
After the subsection, insert:
1A.	Subsection 1 does not apply after 6 August 2020 to a Chaplain holding a division 5 classification.
5	Subsection 3.2.43.1 (Legal Officers – increment advancement and promotion)
Omit “A legal officer”, insert: “Subject to subsection 1A, a legal officer”.
6	Subsection 3.2.43.1 (Legal Officers – increment advancement and promotion)
After the subsection, insert:
1A.	Subsection 1 does not apply after 6 August 2020 to a legal officer holding a rank of Brigadier or higher.
