Defence Determination 2016/19, Conditions of service  

1  Name

This instrument is Defence Determination, Conditions of Service Amendment (Victoria Cross for Australia, long service leave, travel and overseas public holidays) Determination 2019 (No. 4).

2  Commencement

This instrument commences on insert 24 January 2019.

3  Authority

This instrument is made under section 58B of the Defence Act 1903.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Defence Determination 2016/19, Conditions of service

1 Subsection 4.7.4.2 (Expenses related to representational duties)

Omit the subsection, substitute:

2.

The CDF may approve the payment or reimbursement of costs for the following expenses that are directly related to the member's representational duties.

a.

The purchase of civilian clothing for the member or the member's dependants.

b.

The hire of civilian clothing for the member or the member's dependants.

c.

Laundry and dry cleaning costs.

d.

Babysitting costs for a child who is a dependant, if any of the following are attending a representational activity.

i.

The member and their spouse or partner.

ii.

If the member does not have a spouse or partner, the member.

2A.

The CDF must only approve a payment or reimbursement under subsection 2 if satisfied that the costs and the frequency of the payment or reimbursement are reasonable for the member's representational duties.

2 Paragraph 5.5.28.1.c (Pro rata entitlement)

Omit the paragraph, substitute:

c.

The member has reached the later of the following.

i.

Their retirement age.

ii.

The day on which the member ceases to be allowed to work beyond their retirement age.

3 Annex 9.5.B (Amounts for travel after 21 days – meals), Part 2, table item 1

Omit "$764.45", substitute "$765.45".

4 Subsection 15.1.4.3 (Public holidays overseas)

Omit the subsection, substitute:

Unless otherwise required for duty, a member is granted short absence from duty for a public holiday in the location where the member would, but for the short absence, be performing duty.

5 Subsection 15.1.4.4 (Public holidays overseas), examples

Omit the examples.

6 Subsection 15.2.7.2 (Disposable income for ADF members), table

Omit from table item 6 "Chapter 4 Part 3 Division 4", substitute "Chapter 4 Part 3 Division 1".

7 Paragraph 16.2.3.b (Member this Part does not apply to)

Omit "section 16.2.8", substitute "section 16.2.6".
