1  Name

This instrument is Defence Determination, Conditions of Service Amendment (Aviation – increment placement, progression and transfer) Determination 2018 (No. 21).

2  Commencement

This instrument commences on 31 May 2018.

3  Authority

This instrument is made under section 58B of the Defence Act 1903.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Aviation – increment placement, progression and transfer

Defence Determination 2016/19, Conditions of service

1	Subsection 3.2.47D.1 (Increment placement – general)
After "the minimum increment for ", insert "the rank to which they were last promoted under paragraph 13(1)(a) of the Defence Regulation 2016”.
2	Section 3.2.47K (Air Force member who is not an aviation specialist – eligibility)
After "becomes an Air Force Officer Aviation member", insert "the day after the conditions are met".
3	Subparagraph 3.2.47K.a.i (Air Force member who is not an aviation specialist – eligibility)
Omit “holds”, substitute “has been promoted under paragraph 13(1)(a) of the Defence Regulation 2016 to”.
4	Subparagraph 3.2.47K.b.i (Air Force member who is not an aviation specialist – eligibility)
Omit “holds”, substitute “has been promoted under paragraph 13(1)(a) of the Defence Regulation 2016 to”.
5	Subsection 3.2.47N.1 (Transfer from other salary structures into the Officer Aviation Pay Structure)
Omit “section”, substitute “subsection”.
6	Subsection 3.2.47N.1 (Transfer from other salary structures into the Officer Aviation Pay Structure)
Before the note, insert:
Exception: An Other Rank member who is directed to act at a higher rank.
7	Subsection 3.2.47N.2 (Transfer from other salary structures into the Officer Aviation Pay Structure)
Omit “If the CDF decides to transfer a member”, substitute “If a member is transferred”.
