Citation

1.

This Determination is Defence Determination 2017/24, Living-in accommodation and rent allowance – amendment.

2.

This Determination may also be cited as Defence Determination 2017/24.

2 Commencement

1.

Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

This instrument is made under section 58B of the Defence Act 1903.

Schedule 1—Amendments to Living-in accommodation

Defence Determination 2016/19, Conditions of service

1 Subsection 7.4.2.3 (Principles for the provision of living-in accommodation)

Omit "sharing arrangements", substitute "number of beds per room".

2 Subsection 7.4.19.2 (Member required to share room), table item 3

Omit the table item 3, substitute:

Schedule 2—Amendments to Rent allowance

1 Section 7.8.41 (Assistance with payments for rental home)

Omit the section, substitute:

7.8.41   Assistance with payments for rental home

This section applies to a member who intends to enter into a lease on a rental home for which they will be eligible for rent allowance.

2.

The member may apply for assistance for some of the costs of entering into a rental lease.

3.

The amount and type of assistance is provided in the following table.

an advance payment of up to a maximum of twice the member's fortnightly rent ceiling.

1. The advance must be repaid to the Commonwealth.

Note: Payments under this section are provided on a payday. It may take up to 19 days for the member to be paid the assistance. The timing of the payment will depend on the day within the pay cycle the application is approved.

3 Subsection 7.8.46.1 (Method of repayment)

Omit "paragraph 7.8.41.1.a or section 7.8.43", substitute "subsection 7.8.41.3, table items 1, 2 and 3,".

4 Paragraph 7.8.46.1.c (Method of repayment)

Omit "commencement of the lease", substitute "payday after the member received the advanced payment".
