1  Name

This instrument is the Defence (Defence Areas—Talisman Sabre 2019) Declaration 2019.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under section 58 of the Defence Regulation 2016.

4  Declaration of Defence Area – Bowen

(1)  The Bowen area is declared to be a Defence Area for the Defence purpose of preparing for, and conducting, Exercise Talisman Sabre 2019 and post-exercise activities (including, but not limited to, the participation of members of the Defence Force and the United States Armed Forces in amphibious landings in the area).

(2)  Entry into the Bowen area is prohibited during particular periods as determined under subsection 59(1) of the Defence Regulation 2016.

(3)  The Bowen area is the areas of land and sea in and near the town of Bowen in Queensland that are depicted with dots on the map (the Bowen map) set out in Schedule 1 to this instrument.

(4)  The following land parcels are areas of land depicted with dots on the Bowen map, and are included in the Bowen area:

(a)  225/HR917

(b)  177/HR1562

(c)  110/HR1562

(d)  24/SP122337.

(5)  The areas of sea depicted with dots on the Bowen map are included in the Bowen area. The following are to be used for the purposes of determining the areas of sea so depicted:

(a)  the relevant geographical coordinates shown on the map;

(b)  the high water mark of the relevant coastlines shown on the map.

5  Declaration of Defence Area – Midge point

(1)  The Midge Point area is declared to be a Defence Area for the Defence purpose of preparing for, and conducting, Exercise Talisman Sabre 2019 and post-exercise activities (including, but not limited to, the participation of members of the Defence Force and the United States Armed Forces in amphibious landings in the area).

(2)  Entry into the Midge Point area is prohibited during particular periods as determined under subsection 59(1) of the Defence Regulation 2016.

(3)  The Midge Point area is the areas of land and sea in and near the town of Midge Point in Queensland that are depicted with dots on the map (the Midge Point map) set out in Schedule 2 to this instrument.

(4)  The following land parcels are areas of land depicted with dots on the Midge Point map, and are included in the Midge Point area:

(5)  The area of sea depicted with dots on the Midge Point map is included in the Midge Point area. The following are to be used for the purposes of determining the area of sea so depicted:

(a)  the relevant geographical coordinates shown on the map;

(b)  the high water mark of the relevant coastlines shown on the map.

6  Declaration of defence area – Stanage Bay

(1)  The Stanage Bay area is declared to be a Defence Area for the Defence purpose of preparing for, and conducting, Exercise Talisman Sabre 2019 and post-exercise activities (including, but not limited to, the participation of members of the Defence Force and the United States Armed Forces in amphibious landings in the area).

(2)  Entry into the Stanage Bay area is prohibited during particular periods as determined under subsection 59(1) of the Defence Regulation 2016.

(3)  The Stanage Bay area is the areas of land and sea near the town of Stanage Bay in Queensland that are depicted with dots on the map (the Stanage Bay map) set out in Schedule 3 to this instrument, which includes the Duke Islands inset on the Stanage Bay map.

(4)  The following land parcels are areas of land depicted with dots on the Stanage Bay map, and are included in the Stanage Bay area:
