Defence (Areas Control) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Defence Act 1903.

1.   Amendment

1.1   The Defence (Areas Control) Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3 (Construction of buildings without approval prohibited in some areas)

2.1   Paragraph 3 (1) (b):

Omit “Schedule 6.”, substitute “the Schedule referred to in the description.”.

3.   Regulation 4 (Construction of buildings higher than 7.5 metres without approval prohibited in some areas)

3.1   Paragraph 4 (1) (b):

Omit “Schedule 6.”, substitute “the Schedule referred to in the description.”.

4.   Regulation 5 (Construction of buildings higher than 15 metres without approval prohibited in some areas)

4.1   Paragraph 5 (1) (b):

Omit “Schedule 6.”, substitute “the Schedule referred to in the description.”.

5.   Regulation 6 (Construction of buildings higher than 45 metres without approval prohibited in some areas)

5.1   Paragraph 6 (1) (b):

Omit “Schedule 6.”, substitute “the Schedule referred to in the description.”.

6.   Regulation 7 (Construction of buildings higher than 90 metres without approval prohibited in some areas)

6.1   Paragraph 7 (1) (b):

Omit “Schedule 6.”, substitute “the Schedule referred to in the description.”.

7.   Regulation 19 (Delegation)

7.1   Paragraph 19 (1) (b):

Omit “an Administrative Service Officer Class 8”, substitute “a Senior Officer Grade A”.

8.   Schedule 1

8.1   After item 1, insert:

“2 The area of land near Royal Australian Air Force Base Learmonth in the State of Western Australia delineated by hachuring on Plan No. 8 in Schedule 7.”.

9.   Schedule 2

9.1   After item 1, insert:

“2 Each of the areas of land near Royal Australian Air Force Base Learmonth in the State of Western Australia delineated by hachuring on Plans Nos. 3, 7, 8 and 9 in Schedule 7.”.

10.   Schedule 3

10.1   After item 1, insert:

“2 Each of the areas of land near Royal Australian Air Force Base Learmonth in the State of Western Australia delineated by hachuring on Plans Nos. 1, 2, 3, 4, 6, 7, 8 and 9 in Schedule 7.”.

11.   Schedule 4

11.1   After item 1, insert:

“2 Each of the areas of land near Royal Australian Air Force Base Learmonth in the State of Western Australia delineated by hachuring on Plans Nos. 1, 2, 3, 4, 6, 7 and 9 in Schedule 7.”.

12.   Schedule 5

12.1   After item 1, insert:

“2 Each of the areas of land near Royal Australian Air Force Base Learmonth in the State of Western Australia delineated by hachuring on Plans Nos. 1, 2, 3, 4, and 5 in Schedule 7.”.

13.   New Schedule 7

13.1   At the end of Schedule 6, add:

SCHEDULE 7

Regulations 3 to 7 (inclusive)

 and Schedules 1 to 5 (inclusive)
