An Act to amend the Defamation Act, 1974, with respect to certain publications to or by the Equal Opportunity Tribunal. [Assented to, 22nd April, 1981.]

Defamation (Anti-Discrimination) Amendment.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

Short title.

1. This Act may be cited as the "Defamation (Anti-

Discrimination) Amendment Act, 1981".

Commencement.

2. (1) Except as provided by subsection (2), this Act shall

commence on the date of assent to this Act.

(2) Section 3 shall commence on the day appointed and notified under section 2 (2) of the Anti-Discrimination (Amendment) Act, 1981.

Amendment of Act No. 18, 1974.

1. The Defamation Act, 1974, is amended—

   Sec. 17D.

   (Matters arising under Anti-Discrimination Act, 1977.)

   (a) (i) by inserting in section 17D (1) after the matter

"1977, to" the words "or by a member of the Equal

Opportunity Tribunal constituted under that Act,
to or by";

(ii)   by omitting from section 17D (1) the word "Board" where secondly occurring and by inserting instead the word "Tribunal";

(iii)   by omitting from section 17D (2) (a) the words "Anti-Discrimination Board" and by inserting instead the words "Equal Opportunity Tribunal";

(b) by omitting clause 2 (12) of Schedule 2 and by inserting instead the following subclause :—

(12) proceedings at an inquiry conducted by the Equal Opportunity Tribunal constituted under the Anti-Discrimination Act, 1977, or an investi- gation conducted by the Anti-Discrimination Board constituted under that Act; or
