This order in council may be cited as the Deer (Open Season) Order 1992 . Application 2. This order applies to— (a) Red deer ( Cervus elaphus ); and (b) Fallow deer ( Cervus dama ); and (c) Chital deer ( Cervus axis ).
2 Deer (Open Season) Order 1992 Open season declared 3. An open season is declared under section 29 of the Actfor the following periods— (a) in the case of Red deer and Fallow deer—the period starting on 14 March 1992 and ending on 26 September 1992; (b) in the case of Chital deer—the period starting on 1 February 1992 and ending on 31 December 1992. Districts in which open season applies 4. The open season applies— (a) in the case of Red deer—in the fauna districts of Esk, Crow’s Nest, Rosalie, Nanango, Kilkivan, Murgon, Kilcoy, Caboolture, Landsborough, Woocoo and Tiaro; and (b) in the case of Fallow deer—in the fauna district of Stanthorpe; and (c) in the case of Chital deer—in the fauna district of Dalrymple. Taking of deer by holder of an open season fauna permit (taking for sale) 5.(1) The terms, conditions and restrictions mentioned in this section apply to the taking of Red deer, Fallow deer and Chital deer during the open season by a holder of an open season fauna permit (taking for sale). (2) The taking of the deer is to be effected only by a ground trap at a designated site. (3) The holder must not site or re-site traps to be used for the taking of the deer without the prior written permission of the Director. (4) The holder must not establish a number of trap sites exceeding the number specified in the permit. (5) The holder must not take— (a) in the case of Red deer or Fallow deer—more than 30 specimens of each species of deer; or (b) in the case of Chital deer—more than 100 specimens of the deer.
3 Deer (Open Season) Order 1992 (6) In relation to each specimen of the deer taken, the holder must pay to the Crown the royalty prescribed under the Act. (7) The holder must, within 14 days after each month, give to the Director a return in the prescribed form that includes details of numbers and species of the deer taken during the month. Taking of deer by holder of an open season fauna permit (personal use) 6.(1) The terms, conditions and restrictions mentioned in this section apply to the taking of Red deer, Fallow deer and Chital deer during the open season by a holder of an open season fauna permit (personal use). (2) The taking of the deer is to be effected by shooting the deer in a humane way using— (a) a centre-fire rifle with a minimum calibre of 6 mm (0.243 inches); or (b) a muzzle loading rifle with a minimum calibre of 11.45 mm (0.45 inches) and a projectile of a type known as a “Minie” with a minimum weight of 14.91 grams (230 grains); or (c) a long bow having a pull weight of not less than 22.5 kg and a minimum draw of 70 cm or its equivalent for a compound bow with a broad-head arrow having a minimum of 2 sharpened cutting blades; or (d) a crossbow having a pull weight of 36.5 kg and a broad-head arrow having a minimum of 2 sharpened cutting blades. (3) The holder must fully attach to the skin of the deer taken a plastic tag supplied to the holder by the Director by— (a) threading the band of the tag through a strip of skin of the deer; and (b) inserting the spearpoint of the tag into the locking head until the tag snaps closed; and
4 Deer (Open Season) Order 1992 (c) twisting the band of the tag onto the seal to confirm that the tag is securely locked into the skin of the deer. (4) A tag supplied to the holder— (a) remains the property of the Crown; and (b) may be recalled by the Director at any time by written notice given to the holder; and (c) if recalled, must be delivered as specified in the notice; and (d) is not transferable; and (e) must not be attached to deer by any other person without the prior written permission of the Director; and (f) must not be removed from deer to which it is attached without the prior written permission of the Director. (5) The holder must not— (a) have possession of a tag that has not been supplied to that holder for the purposes of the permit; or (b) without the prior written permission of the Director, attach to deer a tag that has not been supplied to that holder for the purposes of the permit. (6) Deer taken by the holder— (a) must be used only for the holder’s personal use; and (b) must not be sold, disposed of or used for any other purpose. (7) The holder must not take more than 2 specimens of each species of Red deer, Fallow deer and Chital deer. (8) The holder must, within 14 days after the expiration of the holder’s permit, give a return to the Director in the form of the record card attached to the permit.
