An Act relating to Currency, Coinage and Legal Tender.
PART I-PRELIMINARY
Short title amended; No. 32, 1918, s. 2.
1. This Act may be cited as the Decimal Currency (Transitional) Act 1963-1973.*

2. (1) Parts I and V of this Act shall come into operation on the day on which this Act receives the Royal Assent.*

5. This Act extends to all the external Territories except Papua New Guinea and the Territory of Christmas Island.

Definitions.

Division 1-Preliminary

18. In this Part, unless the contrary intention appears-
''prescribed machine'' means-
(a) a machine or instrument used, or intended for use, solely or principally for the purpose of calculating or recording amounts of money, including-
(i) an accounting machine or any similar machine;
(ii) an adding machine or any similar machine;
(iii) a machine for franking postal articles;
(iv) a cash register;
(v) a machine or instrument for use in connexion with a punched card system; and
(vi) price-computing scales; and
(b) any other machine or instrument included in a class or kind of machines or instruments declared by the Treasurer, by notice in the Gazette, to be a prescribed class or kind of machines or instruments for the purposes of this Part,
being a machine or instrument designed for use in connexion with the existing currency system or any similar system of currency;
''the decimal currency system'' means the system of currency provided for by Part II of the Currency Act 1965;
''the existing currency system'' means the system of currency provided for by the Coinage Act 1909-1947.

Powers of Treasurer.SECT

19. (1) The Treasurer may, on behalf of the Commonwealth, do such things, make such arrangements and enter into such agreements as he considers necessary for the purpose of facilitating the transition from the existing currency system to the decimal currency system and, in particular but without limiting the generality of the foregoing-
(a) he may, on behalf of the Commonwealth, make such arrangements, or enter into such agreements, as he thinks fit for or in relation to the conversion or adaptation, for use in connexion with the decimal currency system, of such prescribed machines as he thinks fit; and
(b) he may approve the making of payments by the Commonwealth, of such amounts as he determines, by way of compensation in respect of such other prescribed machines as he thinks fit.
(2) An arrangement or agreement under paragraph (a) of the last preceding sub-section may make provision-
(a) for the Commonwealth to bear the whole or a part of the cost of converting or adapting a prescribed machine for use in connexion with the decimal currency system; and
(b) for the making of advances by the Commonwealth to the person with whom the arrangement or agreement is made for the purpose of assisting the person in carrying out his obligations under the arrangement or agreement.

32. The following amounts are payable out of the Consolidated Revenue Fund, which is appropriated accordingly:-
(a) any amount payable by the Commonwealth under an arrangement or agreement entered into under paragraph (a) of sub- section (1) of section nineteen of this Act; and
(b) any payment approved under paragraph (b) of that sub- section.

(a) No date for the commencement of Parts II, III, IV and VI of the Currency Act 1963 was fixed before their repeal by section 7 of the Decimal Currency Board Act 1965 and by section 11 of the Decimal Currency Board (Abolition) Act 1969.
The Decimal Currency Board Act 1965 substantially amended the Currency Act 1963 and altered the citation of that Act, as amended, to the Decimal Currency Board Act 1963-1965. The Decimal Currency Board (Abolition) Act 1969 substantially amended the Decimal Currency Board Act 1963-1965 and altered the citation of that Act, as amended, to the Decimal Currency (Transitional) Act 1963-1969.
2. Section 20 and Division 3 of Part V (sections 21-31) were repealed by sub- section 9 (1) of the Decimal Currency Board (Abolition) Act 1969. Sub-sections 9 (2), (3), (4) and (5) of that Act provide as follows:
''(2) All property and rights that, immediately before the commencement of this section, were vested in the Board are, by force of this section, vested in the Commonwealth.
''(3) Where the Board was a party to a contract or agreement subsisting immediately before the commencement of this section, the contract or agreement shall continue in full force and effect but, in its operation after the commencement of this section, has effect as if-
(a) the Commonwealth were substituted for the Board as a party to the contract or agreement; and
(b) any reference in the contract or agreement to the Board were a reference to the Commonwealth.
''(4) All liabilities and obligations to which the Board was subject immediately before the commencement of this section become, by force of this section, liabilities and obligations of the Commonwealth.
''(5) The Consolidated Revenue Fund is appropriated to the extent necessary for the purpose of the making by the Commonwealth of any payment that the Commonwealth is liable to make by reason of the operation of this section.''
