DECEASED HUSBAND'S [ASSENTED TO 16TH SEPTEMBER, 1931.] BROTHER MARRIAGE B E it enacted by the King's Most Excellent Majesty, ACT OF 1931. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Deceased Short title. Husband"s Brother Marriage Act of 1931." 2. From and after the passing of this Act, no M!1rnage marriage otherwise lawful between any woman and the ;lth a d brother of her deceased husband shall, within Queensland, h~ ~ ~ ~ : d' 8 be voidable or in any wise impeachable upon the ground br? ~h~ ~ not only of such affinity between the parties thereto, any ~~~ 4~ ';ic. law, usage, or custom to the contrary notwithstanding: No. 25, s. 1. Provided that this Act shall not render valid any such marriage in any case where either of the parties of such marriage shall thereafter before the passing of this Act have lawfully intermarried with any other person; nor shall the passing of this Act deprive or be held to have deprived any person of any property which such person may have lawfully inherited prior to the coming into operation of this Act. 3. This Act shall extend and apply to any such~ etrospee­ marriage as aforesaid notwithstanding that an action, bve t' . SUI' t, or proceedm' g for a dec1aration 0 f null"Ity m respect coepretraainIOn In of any such marriage was, had, taken, or commenced cases. prior to the passing of this Act, but in respect of which action, suit, or proceeding the court had not, at the passing of this Act, made any such declaration of nullity; and the provisions of this Act shall apply and extend to the intent that any such marriage (being the subject of any such action, suit, or proceeding as aforesaid) shall not be voidable or in any wise impeach- able upon the ground only of such affinity between the parties thereto, and to this extent this Act shall have retrospective operation.
