Debt Collectors Licensing Amendment

Regulations 2004

Made by the Governor in Executive Council.

1.             Citation

These are the Debt Collectors Licensing Amendment
Regulations 2004.

2.             Commencement

These regulations come into operation on the day on which Part 2 Jurisdiction) Amendment and Repeal Act 2004 comes into operation or on the day of their publication in the Gazette, whichever is the later.

3.             The regulations amended

The amendments in these regulations are to the Debt Collectors
Licensing Regulations 1964*.

4.             Regulation 5 amended

(1) Regulation 5(1) is amended as follows:
(a)

by deleting “Court that granted the licence” and “ Commissioner ”;

(b)

by deleting “Clerk of the Court shall as soon as practicable notify the officer in charge of police at the police station nearest the Court of the fact.” and inserting instead —

Commissioner shall as soon as practicable notify the

Commissioner of Police of the fact.

”.

(2) Regulation 5(2) is amended by deleting “Clerk of the Court”
and inserting instead —
“ Commissioner ”.
(3) Regulation 5(4) is amended by deleting “Court” in both places
where it occurs and inserting instead —
“ Commissioner ”.

(4) Regulation 5(6) is amended by deleting “Clerk of the Court”
and inserting instead —
“ Commissioner ”.

5.             Regulation 6 replaced

Regulation 6 is repealed and the following regulation is inserted instead —

6.             Lodging of application

An application for the grant, renewal or transfer of a licence to the Commissioner under the Act shall be lodged in duplicate in the prescribed form with the Commissioner.

6.             Regulation 7 amended

(1) Regulation 7(1) is amended by deleting “Clerk of the Court at
which the licence was issued.” and inserting instead —
“ Commissioner. ”.
(2) Regulation 7(2) is repealed and the following subregulation is
inserted instead —

(2) Where a duplicate licence is issued that licence shall be
endorsed as follows —

This licence is issued under section 9(5) of the Debt licence number ...............

”.

7.             Regulation 8 amended

Regulation 8 is amended by deleting “Clerk of the Court of a licence granted by the Court” and inserting instead —

“ Commissioner of a licence ”.

8.             Regulation 9 amended

Regulation 9 is amended by deleting “Clerk of the Local Court at which the licence was issued notifying the Clerk” and inserting instead —

“ Commissioner notifying the Commissioner ”.

9.             Regulation 12 amended

Regulation 12 is amended by deleting “Clerk of the Court from which the licence issued,” and inserting instead —

“ Commissioner, ”.

10.           First Schedule amended

(1) The First Schedule Form 1 is amended as follows:
(a) by deleting the line commencing “To the Local Court”;
(b) by deleting “issued by the Local Court at .....................”.
(2) The First Schedule Form 2 is amended as follows:
(a) by deleting the line commencing “In the Local Court”;
(b)

by deleting “Clerk of the Local Court at” and inserting “ Commissioner for Fair Trading ”.

(3) The First Schedule Form 3 is deleted.
(4) The First Schedule Form 4 is amended by deleting “Clerk of the
Local Court at” and inserting instead —
“ Commissioner for Fair Trading ”.
(5) The First Schedule Form 5 is amended as follows:
(a) by deleting the line commencing “To the Clerk”;
(b) by deleting “by the Local Court at ...........................,”.
(6) The First Schedule Form 6 is amended as follows:
(a) by deleting the line commencing “To the Clerk”;
(b) by deleting “by the Local Court at ...............................”.
11.

Second Schedule amended the Local Court with whom these presents are lodged” and inserting instead —

“ Commissioner ”.
