An Act to vest certain land now belonging* to the Board of Water Supply and Sewerage in trustees upon the trusts declared in a certain Crown grant of a site for an institution for the deaf and dumb and blind; and for other

purposes. [5th December, 1903.]

WH E R E A S the Board of Water Supply and Sewerage leased for one thousand eight hundred and ninety-eight, certain land belonging to a term of ninety-nine years from the first day of November,
the said board, and described in the Schedule to this Act,: And whereas the lease so granted is now held by the trustees of the New South Wales Institution for the Deaf and Dumb and the Blind : And whereas it is desirable to vest the said land upon trust for the said institution for an estate in fee-simple : Be it therefore enacted by the King ' s Most Excellent Majesty, by and with the advice and consent of the Legislat ive Council and Legislat ive Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the " Deaf, Dumb, and Bl ind Institution Vesting Act, 1903."

The Board of Wate r Supply and Sewerage is divested of a l l its right, title, and interest to and in the said land, and all leases by the said board, and a l l dealings with such leases are annulled and rendered void, but saving the right of any person or corporation to recover any rent due in respect of such leases and dealings.

The said land is vested for an estate in fee-simple in Ellis Bobinson, Esqui re ; Sir J ames Eairfax ; the Honorable Sir Arthur B e n w i c k ; John Hay Goodlet, Esquire; and James llobinson Love, Esqui re ; upon the trusts declared and subject to the conditions and reservations contained in the Crown grant of five acres as a site for an institution for the deaf and dumb and blind, dated the twenty-third day of J u l y , one thousand eight hundred and seventy-four, and registered volume one hundred and eighty-six, folio seventy-three, in the Eegistrar-General 's Office, Sydney, but free from al l other trusts and from any dedication or reservation.

4. When any of the said trustees or any trustee to be appointed by virtue of this Act dies, resigns, ceases to reside in New South Wales , or becomes incapable of acting in the trusts created by this Act, the Governor may, by writ ing under his hand, name and appoint a new trustee in the place of any trustee so dying, resigning, ceasing to reside or becoming incapable ; and thereupon the said land shall be conveyed and assured by the surviving or continuing trustee or trustees or by the personal representative of the last surviving trustee or his personal representative or assigns upon the trusts, and for the intents and purposes hereinbefore created and declared of and concerning the said lands.

5. The trustees for the t ime being of the said land may make rules and regulations for the use of the said land or any part thereof upon the trusts hereinbefore mentioned.

6. The amount of the unimproved value of the said land, as estimated by the Secretary for l 'ubl ic Works , shall be credited to the Board of Water Supply and Sewerage in the accounts kept in the Treasury.
